LEGAL NOTICE

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice is hereby given that River Asphalt, LLC, has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2.9, and 12.3 to install a 300 ton per hour drum mixer for its asphalt plant located at 30548 Thorogoods Road, Dagsboro, Delaware. 

River Asphalt, LLC, requests that its current asphalt plant emissions limits under Permit: APC-2006/0134 be maintained.  These limits are necessary to remain a synthetic minor source under 7 DE Admin. Code 1102 and the limit will be enforceable by the EPA and the State.  Total estimated emissions from the new drum mixer will increase by 1.6 TPY VOCS and 1.2 TPY CO.

The application, the "draft" permit (APC-2013/0069), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the "draft" permits may be inspected at the office of the Division of Air Quality, Blue Hen Corporate Center, 655 S. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending January 15, 2013. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
