LEGAL NOTICE

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice is hereby given that ICM of Delaware, Inc. having facilities at 3700 Bay Road, Dover, Delaware, and County Road 323, Georgetown, Delaware has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2.9, and 12.3 to amend permit limits for a RAP Crusher and Screener Units.  

The emissions at each site from the crusher unit shall not exceed by 1.38 TPY NOx, 0.09 TPY SO2, 0.3 TPY CO, 0.11 TPY THC and 0.5 TPY PM and from screener unit shall not exceed by 1.03 TPY NOx, 0.07 TPY SO2, 0.22 TPY CO, 0.09 TPY THC, and 1.86 TPY PM. These limits are necessary to restrict ICM of Delaware’s potential to emit air pollutants and the limit will be enforceable by the EPA and the state.

The application, the "draft" permit (APC-2012/0092-OPERATION), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the "draft" permit may be inspected at the office of the Division of Air Quality, Blue Hen Corporate Center, 655 S. Bay Road, Suite 5 N, Dover, DE 19901.  To submit comments, for additional information or for an appointment to inspect the public file, please contact Ms. Laura Bogus in the Dover office at (302) 739-9402.

A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending January 15, 2013. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
