PUBLIC NOTICE
Intent to Revoke Waste Transporter Permit

Pursuant to authorities granted by 7 Del. C., Chapters 60 and 63 and Delaware’s Regulations Governing Hazardous Waste, the Department of Natural Resources and Environmental Control (DNREC), Solid and Hazardous Waste Management Section (SHWMS) is providing notice of its intent to revoke the hazardous waste transporter permit issued to Horwith Trucks, Inc. located in Northampton, Pennsylvania.

The decision to revoke the permit is based on information submitted by Horwith Trucks, Inc. indicating that it has incurred no less than 14 violations of failing to contain regulated waste, including hazardous waste, within the transport vehicle in the last five (5) years. While the violations were not incurred in Delaware, the SHWMS has concerns about Horwith Truck’s ability to comply with its Delaware permit and prevent releases in the state. This is particularly true, as the company has incurred increasing monetary penalties following each incidence of release, yet has not successfully implemented an effective program to ensure waste is contained in the vehicle, as the three (3) most recent violations occurred in September, October, and November of this year. 

Revocation of the permit shall become effective 30 days from the date of the publication of this Notice, unless a written request for a public hearing is received by DNREC on or before February 22, 2013.  If DNREC does not receive a timely written request for a public hearing, the revocation will become final without further action.
