Pursuant to the provisions of 7 Del. C., 7203, and the Department’s Regulations Governing the Use of Subaqueous Lands, the Wetlands and Subaqueous Lands Section of the Division of Water, Department of Natural Resources and Environmental Control (Department) proposes to adopt a Statewide Activity Approval (SAA) for Shellfish Aquaculture in specific, designated “Shellfish Aquaculture Development Areas (SADA)”.  This Statewide Activity Approval (SAA) may be used to authorize shellfish aquaculture activities within specific portions of the SADA previously established by the Division of Fish and Wildlife under 7 DE Admin Code 3800 Shellfish Aquaculture Regulation.

The areas include Indian River Bay (IR-A), Rehoboth Bay (RB-A, RB-B, RB-C), and Little Assawoman Bay (LA-B and LA-D), specifically.  The intent of the SAA is to facilitate the issuance of subaqueous lands permits in these specific areas in support of the Division of Fish and Wildlife’s commercial shellfish aquaculture program.

Dulcine B. Dinsmore (2-34-34.12-55.01) To utilize an existing 6 by 55 foot long pier, a 12 by 13 foot long dock, 3 free standing pilings, and to construct a 4 by 12 foot long set of access stairs in the Indian River at 32506 River Road, Millsboro, Sussex County, DE

David Edmonson (3-34-19.00-315.00) To remove a jet ski lift and to authorize a 10 by 16 foot long floating PWC dock connecting to a previously authorized structure in Bald Eagle Creek at 109 Blackpool Road, Rehoboth Beach Yacht and Country Club Rehoboth Beach, DE

Adam Gelof (3-34-7.00-193.00) To install a boatlift with 4 associated pilings, to remove an old section of dock and to replace it with a 3 by 10 foot long gangway and a 6 by 12 foot long floating dock in Holland Glade at 56 Glade Circle East, The Glade, Rehoboth Beach, Sussex County, DE

If you have any comments, please return this memo to this office by April 12, 2016.

A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a public hearing is in the public interest or if a written meritorious objection to the application is received within 20 days from this notice.  A public hearing request shall be deemed meritorious if it exhibits familiarity with the application and provides a reasoned statement of the action’s probable impact.
