LEGAL NOTICE

AMENDED PROPOSED PLAN OF REMEDIAL ACTION FOR THE
Amer Industrial TECHNOLOGIES OU-2

The Department invites public comment on a proposal to clean up the Amer Industrial Technologies Operable Unit 2 (OU-2) located at 100 Amer Road, Fox Point Industrial Park in Wilmington, Delaware.  The Site consists of two (2) tax parcels totaling 25 acres located on the western banks of the Delaware River.    Soil is impacted by lead over DNREC soil standards for residential use of the property.  Groundwater is impacted by lead but surface water has not been impacted. 

The remedy consisted of: 1) an environmental covenant restricting land use to commercial, limiting groundwater withdrawal, compliance with a contaminated material management plan (CMMP), 2) a CMMP for new construction or soil disturbing activities, 3) Excavate lead in Lead Area 1, consolidate and cap Lead Area 2, 4) Cap soil in Lead Area 3, and 5) Develop a DNREC approved Long-Term Stewardship (LTS) Plan to monitor the groundwater and cap.
