NOTICE OF SECRETARY’S DECISION

Silver Run Electric, LLC

The Secretary of the Department of Natural Resources and Environmental Control has issued Secretary’s Order Number 2018-W-0060 which authorizes Silver Run Electric, LLC to perform the following activities: To construct a 230-kilovolt (kV) alternating current (AC) electric transmission line, connecting the PSE&G Hope Creek Substation expansion on Artificial Island, Salem County, New Jersey, to the proposed Silver Run Substation located at 471 Silver Run Road, Middletown, Delaware.

The proposed Delaware-portion of the alignment begins at the Silver Run Substation, with overhead transmission lines running 2-miles east, spanning the Appoquinimink River and crossing the Augustine Wildlife Area, until reaching an off-shore transition structure in the Delaware River. From the transition structure, 3-miles of submarine cables are proposed to be installed via water jetting technology beneath the riverbed until reaching the New Jersey shoreline.  

Seven (7) transmission line structures will be located in State-regulated wetlands, resulting in 1,920 square feet of temporary impacts and 287.5 square feet of permanent impacts for vibratory caisson foundation construction. The total impact area to the Delaware side of the river is approximately 45.1-acres. Structures in wetlands will be installed via heavy lift helicopter construction and vibratory hammer. The public hearing on the application was held on November 1, 2018.

Any Person whose interest is substantially affected by this Order may appeal to the Environmental Appeals Board, as set forth in 7 Del.C. §6008 (c), within 20 days of this announcement of the decision.

Subaqueous Lands Permit Applications

Love Creek Marina, LLC (234-7.00-108.00 dredging site, 234-7.00-112.00 disposal site) To mechanically maintenance dredge to a depth of -3.45 feet below mean low water (-4 feet NAVD), removing approximately 1,982 cubic yards of sediment from existing slips at Love Creek Marina, and adjacent access areas to Love Creek, and to transport dredged material via water-tight trucks to an adjacent, upland disposal site located at 20581 John J. Williams Highway, in Lewes, Sussex County, DE

Ocean View Land Development, LLC (134-8.00-154.00) – To construct a 4 by 225 foot long footbridge in the intertidal zone of Whites Creek, to provide  pedestrian connection between the Sandy Cove Marina and Sandy Cove gazebo and crabbing pier at 37682 Sandy Trap Drive, Ocean View, Sussex County, DE

Subaqueous Lands Permit and Water Quality Certification Applications

Division of Watershed Stewardship (tax parcel N/A, linear project)-To place approximately 65,900 cubic yards of sand fill material for beach replenishment along the shorelines of Pickering Beach, Kitts Hummock and Bowers Beach, adjacent to the Delaware Bay in Kent County, DE
