NOTICE OF PUBLIC HEARING CANCELLATION
7 DE Admin. Code 1150 - Outer Continental Shelf Air Regulations
On Dec. 2, 2018, the Department of Natural Resources and Environmental Control, Division of Air Quality (DAQ) published a public notice that a public hearing would be conducted on the proposed amendments to 7 DE Admin. Code 1150. DAQ has cancelled that public hearing, which was scheduled for Jan. 7, 2019 at the Department’s offices located at 600 W. Water Street in Dover beginning at 6 p.m.
DAQ’s proposed amendments to 7 DE Admin. Code 1150 would incorporate updates to the state outer continental shelf (OCS) regulation, based upon the amendments to the federal OCS regulation at 40 CFR Part 55 which have been finalized since the state regulation was adopted in 2010.
On December 3, 2018, the Environmental Protection Agency (EPA) proposed an update to the federal OCS regulations to incorporate by reference the latest versions of Delaware’s regulations into Appendix A of 40 CFR Part 55. After further consideration, the Department has decided to cancel the January 7, 2019 public hearing until the EPA has issued a final rule related to their proposal. Once EPA has issued a final rule, the Department will reissue a proposed amendment to 7 DE Admin. Code 1150 and announce a new public hearing date.
