LEGAL NOTICE

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice is hereby given that Edgemoor Materials, Inc. has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2(i), and 12.3, for the construction of a 300 ton/hour counter-flow drum mixer at 1230 Railcar Avenue, Wilmington, Delaware. 

Edgemoor Materials, Inc. requests a limit for a maximum production of 500,000 tons of hot mix asphalt.  These limits are necessary to restrict Edgemoor Materials, Inc. potential to emit air pollutants, and the limit will be enforceable by the EPA and the state.  Total estimated emissions from the facility are: Volatile Organics = 8.00 TPY; Nitrogen Oxide = 13.75 TPY; Sulfur Oxide = 18.33 TPY; Carbon Monoxide = 32.50 TPY; Particulate Matter = 12.33 TPY.

The application, the "draft" permit APC-87/0060-CONSTRUCTION (Amendment 6)(NSPS)(SM), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the "draft" permit may be inspected at the office of the Division of Air and Waste Management, 156 S. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending Tuesday, November 3, 2009. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
