NOTIFICATION OF NEGOTIATIONS FOR BROWNFIELDS VOLUNTARY CLEANUP PROGRAM AGREEMENT FOR THE FOR THE KEMPF STORAGE SITE (DE-1481)
Pursuant to 7 Del. C. §9107(a)(1) of the Hazardous Substance Cleanup Act (HSCA), the Department of Natural Resources and Environmental Control (DNREC) is required to issue a public notice within twenty days after entering into negotiations for a Voluntary Cleanup Program (VCP) Agreement . The VCP Agreement that is the subject of this notice concerns a certified Brownfields site (Brownfields VCP Agreement). This Brownfields VCP Agreement is entered into with the Brownfields site owner who does not otherwise qualify for a Brownfields Development Agreement (BDA) under HSCA, 7 Del. C. Chapter 91, Subchapter II.
DNREC is negotiating a Brownfields VCP Agreement with Peninsula Ventures VIII, LLC regarding the Kempf Storage Site, located at 1101 East 7th Street/1220 East 8th Street in Wilmington. Known by New Castle County as tax parcel number 26-044.00-029 and 26-044.00-017, the 3.72 acre site may have had a release of hazardous substances as a result of past industrial use. Previous investigations revealed the presence of lead and arsenic, and polyaromatic hydrocarbons (PAHs) in soils surrounding the Site.
