LEGAL NOTICE

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice is hereby given that Mike Davidson Enterprises, LLC has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2(i), and 12.3 for construction of an aggregate drum dryer at 3051 Willow Grove Road, Camden-Wyoming, Delaware. 

Mike Davidson Enterprises, LLC has requested production and fuel oil sulfur limits to restrict emissions below the major source thresholds and comply with Minor New Source Review. These limits are necessary to restrict Mike Davidson Enterprises, LLC potential to emit air pollutants.  The limits will be enforceable by the EPA and the state.  The potential to emit from the new aggregate dryer is 20 TPY PM10, 40 TPY SO2, 48 TPY NOx, 110 TPY CO, and 28 TPY VOC.  Permitted emissions will not exceed 2.0 TPY PM10, 4.9 TPY SO2, 4.9 TPY NOx, 12 TPY CO, and 4.9 TPY VOC.

The application, the "draft" permit (APC-2010/0037-CONSTRUCTION (PTE)), all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the "draft" permit may be inspected at the office of the Division of Air and Waste Management, 156 S. A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending November 23, 2009. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
