LEGAL NOTICE
NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE FORMER CHRYSLER NEWARK PLANT SITE (DE-0105)
Pursuant to 7 Del. C. § 9126 (b) of the Hazardous Substance Cleanup Act (HSCA), the Department of Natural Resources and Environmental Control (DNREC) is required to solicit public comments regarding the execution of a Brownfields Development Agreement (BDA). A BDA is an agreement between DNREC and a Brownfields Developer with respect to a certified Brownfields site that sets forth a scope of work and schedule of remedial activities during the development of the site.
DNREC’s Site Investigation and Restoration Branch (DNREC-SIRB) negotiated a BDA with the University of Delaware regarding the Former Chrysler Newark Plant located at 550 S. College Avenue in Newark, Delaware. Known by New Castle County as tax parcel numbers 18-039.00-002 and 18-036.00-002, the approximate 271 acre Site had release(s) of hazardous substances as a result of past use as an auto assembly plant. DNREC invites written public comments on this BDA. The public comment period begins on November 2, 2009 and will close at the end of the business day (4:30 p.m.) on November 23, 2009. Written comments should be submitted to Lindsay Hall or Wendy March at the office of DNREC-SIRB, 391 Lukens Drive, New Castle, DE 19720.
