LEGAL NOTICE

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice is hereby given that Contractors Materials, LLC has submitted an application, pursuant to 7 DE Admin. Code 1102, Section 2.1, 11.2(i), and 12.3 for an amendment to allow recycled asphalt paving (RAP) up to forty (40) Percent at 4048 New Castle Avenue, New Castle, Delaware.  19720.

Contractors Materials, LLC requests a limit on the amount of asphalt produced. This limit was necessary to restrict Contractors Materials, LLC. potential to emit air pollutants, and the limit will be enforceable by the EPA and the state.  Total estimated emissions from the facility are Particulate Matter less than ten (10) microns (PM10) = 5.75 tons per year, Sulfur Oxides (SOX) = 0.85 ton per year, Nitrogen Oxides (NOX) = 6.5 tons per year, Carbon Monoxide (CO) = 32.50 tons per year, and Total Volatile Organic Compounds (VOCs) = 8.00 tons per year.

The application, the "draft" permit (APC-99/0284-OPERATION(NSPS)(SM) (Amendment 1) all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the "draft" permit may be inspected at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, DE 19901 or 715 Grantham Lane, New Castle, DE 19720.  To submit comments, for additional information or for an appointment to inspect the public file, please contact Ms. Joanna Austin in the Dover office at (302) 739-9402.

A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing within thirty (30) days from the date of this notice, ending Monday, November 30, 2009. A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit’s probable impact.
