DNREC issues $10,000 penalty to Kelley Transport and Refuse, LLC
of Denton, Md., for solid waste transportation violations in Delaware
DOVER (Jan. 6, 2015) – DNREC Secretary David Small has issued a Notice of Administrative Penalty and Secretary’s Order to Kelley Transport and Refuse, LLC for violations of Delaware’s laws and regulations governing the transportation of solid waste. The Secretary’s Order calls for $10,000 penalty and cost recovery for the Department of $1,500.
The Department determined that Kelley Transport and Refuse, LLC, business address 11026 Greensboro Road, Denton, Md., had transported solid waste without a valid permit – most recently on September 23, 2014 – despite reminders from DNREC that the company’s permit was expired and transportation without a valid permit is prohibited and subject to enforcement.
The company’s compliance history prior to these events also includes transporting solid waste without a permit; illegally transporting waste from out of state to a Delaware Solid Waste Authority landfill, and disposing of asbestos waste in a facility not permitted to accept such waste.
Kelley Transport and Refuse, LLC has 30 days to appeal the Secretary’s Order.
