DNREC issues penalty order to Formosa Plastics
Corp. of Delaware for air pollution violations
DOVER (Dec. 3, 2012) – DNREC Secretary Collin O’Mara has issued a Notice of Administrative Penalty Assessment and Secretary’s Order to Formosa Plastics Corporation of Delaware for violations of state and federal air quality regulations, state statute and its permit. The order includes a cash penalty of $60,500 and an additional $9,075 as cost recovery reimbursement to DNREC for expenses associated with the department’s investigation.
Formosa produces polyvinyl chloride (“PVC”) resin from vinyl chloride monomer (“VCM”) and vinyl acetate monomer (“VAM”) at its facility located at 780 Schoolhouse Road in Delaware City. This resin is sold to companies for use in making various products such as containers, flooring and toys.
This Order addresses numerous air quality violations that occurred between August 11, 2010 and July 12, 2012. Each violation is cited in the penalty order which can be found on the DNREC website at http://www.dnrec.delaware.gov/Info/Pages/SecOrders_Enforcement.aspx.
Formosa Plastics Corporation of Delaware has 30 days to request a public hearing.
