DNREC issues penalty to DuPont Performance Polymers
Kalrez-Tralee Park for hazardous waste violations
DOVER (Dec. 6, 2012) – DNREC Secretary Collin O’Mara has issued a Notice of Administrative Penalty and Secretary’s Order to DuPont Performance Polymers Kalrez-Tralee Park for violations of Delaware’s laws and regulations governing hazardous waste management.
DuPont operates a synthetic rubber mechanical seal manufacturing facility at 5 Tralee Park Marrows Road in Newark. DNREC conducted a compliance assessment on September 19, 2011 and identified 27 violations of Delaware’s Regulations Governing Hazardous Waste. The violations include failing to properly label and close containers of hazardous waste, universal waste, and used oil.
Among other violations were: failing to transfer contents of a leaking container to a container in good condition; failing to maintain manifests demonstrating proper disposal of hazardous waste; failing to conduct weekly inspections, failing to maintain an adequate contingency plan; and operating a hazardous waste storage facility without a permit.
Based on the September 19, 2011 assessment, a Notice of Administrative Penalty and Secretary’s Order has been issued to DuPont Performance Polymers Kalrez-Tralee Park. The order includes a penalty of $7,810 and $1,172 in cost recovery for DNREC’s investigation.

DuPont has 30 days to appeal the order.
