DNREC Issues $29,600 Penalty to Little Creek Properties LLC of Wilmington for Wastewater Discharges at Two Mobile Home Parks in Dover

DOVER, Del. - Delaware Department of Natural Resources and Environmental Control Secretary John A. Hughes has issued a Notice of Administrative Penalty Assessment and Secretary’s Order to Little Creek Properties, LLC of Wilmington for violations of Delaware’s on-site wastewater treatment and disposal systems regulation. The Order includes a cash penalty of $29,600 and an additional $4,440 as cost recovery reimbursement to the Department for expenses associated with its investigation.

Little Creek Properties, LLC owns and operates two mobile home parks in Dover, Del., Grand View Mobile Home Park, 1492 North Little Creek Road, and M & S Mobile Home Park, 1506 North Little Creek Road. Both mobile home parks utilize on-site wastewater treatment and disposal systems.

On November 26, 2007 the Department issued a Notice of Violation to the owner of Grand View Mobile Home Park in response to an inspection on November 14, 2007 where sewage was observed surfacing and discharging onto the ground of the property. The Notice required the owner to correct the problem and provide the Department with documentation outlining their actions. On January 4, 2008 a letter was sent to the owner outlining the timeframe for approval and required connection to the municipal sewer system or construction of a new on-site wastewater treatment and disposal system on the property. Subsequent meetings and communications with Little Creek Properties, LLC requesting corrective action and documentation have failed to result in compliance.

A letter dated April 30, 2007 was sent to Little Creek Properties, LLC in response to the Department’s inspection April 25, 2007 of M & S Mobile Home Park which found sewage discharging onto the ground of the property. Numerous meetings and communications with the owner have failed to result in the elimination of sewage from surfacing and discharging onto the ground and repairs to the disposal system as required by the Department.

Little Creek Properties, LLC has thirty days to request a public hearing.
