DNREC Issues Penalty Assessment to Coatings Inc. of Wilmington for Air Permit Violations

Delaware Department of Natural Resources and Environmental Control Secretary John A. Hughes has issued a Notice of Administrative Penalty Assessment and Secretary’s Order to Coatings Inc. of Wilmington for violation of Delaware’s air pollution regulations concerning its permit. The Order includes a cash penalty of $1,000 and an additional $150 as cost recovery reimbursement to the department. 

On May 12, 2003, Coatings Inc. was issued an air quality permit for spray painting at 210 Hay Road in Wilmington. In October 2006, the department contacted the company to schedule a compliance inspection and learned it had moved its operation from 210 Hay Road to 30 Commerce St. in Wilmington and had begun spray painting operations at its Commerce Street facility on Jan. 1, 2005, without requesting a permit for its new location, as required.

 Coatings Inc. subsequently applied for a permit, which was issued by DNREC on March 26, 2007. The company has 30 days to request a public hearing.
