Expedited Hearing Set for May 27 on Underground Storage Tank Ruling
for Christy Tire in Georgetown
DNREC’s Tank Management Branch will hold an Expedited Evidentiary Hearing at 1 p.m. Wednesday, May 27 on an underground storage tank ruling for Christy Tire in Georgetown. The hearing will be held at DNREC’s Tank Management Branch office located at 391 Lukens Drive in New Castle.
Salman Choudhary and Christy Management LLC are the current owner and operator of Christy Tire, an abandoned fueling station located at 501 East Market Street in Georgetown. The station includes four gasoline underground storage tanks.
On May 7, 2008 DNREC’s Tank Management Branch issued a Notice of Violation to Christy Tire for violations of Delaware’s underground storage tank regulations and required the company to submit documented proof of compliance for maintenance and protection operations for their underground storage tanks. The company has failed to submit information to the department that their tank system is in compliance with the regulations.
In a certified letter dated April 23, 2009, DNREC’s Tank Management Branch notified Christy Tire of the Department’s intentions to classify the storage tanks as ineligible to receive product deliveries.
At the expedited hearing Christy Tire may present evidence regarding the proposed ruling. At the conclusion of the hearing, DNREC will issue a written ruling regarding whether a Delivery Prohibition Tag will be affixed to the underground storage tanks located at the facility.
If the outcome of the Expedited Evidentiary Hearing is to prohibit product deliveries, the company can submit a written appeal within 30 days to the Department.
