Public Hearing on Proposed Changes
to Underground Tank Regulations Set for April 21

The Department of Natural Resources and Environmental Control will hold a public hearing regarding proposed changes to Delaware’s underground storage tank (UST) regulations at 7 p.m. Tuesday, April 21 in the conference room at DNREC’s New Castle office, 391 Lukens Drive, New Castle.

The proposed changes would incorporate federal requirements, clarify language and help ensure protection of human health, safety and the environment. They include:

  • Requirements prohibiting installation of new USTs within 150 feet of public or industrial and within 100 feet of domestic wells to ensure protection of drinking water supplies.
  • Addition of requirements for a tank operator training program as required by the Federal Energy Policy Act of 2005 to be in place by Aug. 8, 2009.
  • Addition of clarification language to specific sections in response to public comment.
  • Corrections to errors in the last edition of the UST regulations, issued Jan. 11, 2008.

The public and interested parties are invited to attend the hearing and make comments or to submit comments in writing. Written comments may be addressed to Jill Williams Hall, DNREC Tank Management Branch, 391 Lukens Drive, New Castle, DE 19720, and must be received by the end of the comment period as designated by the hearing officer at the hearing.

Copies of the proposed regulations are available online at www.dnrec.delaware.gov/info/Pages/Rules.aspx. Copies also may be viewed during regular business hours at the Lukens Drive office as well as DNREC’s main Dover office, the Richardson & Robbins Building at 89 Kings Highway, Dover, and the Sussex County office on Route 113, Sussex Suites, Unit 6, in Georgetown.
