Three Sussex men charged with illegally removing archaeological resources from wildlife area 

TOWNSEND (March 16, 2011) – DNREC Division of Fish and Wildlife Enforcement agents on March 14 arrested three Sussex men in connection with an incident at the Cedar Swamp Wildlife Area near Townsend.

John W. Justice, age 44, of Lewes, Elmer N. Justice, age 68, of Laurel, and Mark D. Silicato, age 50, of Milford, were arrested and charged with one count each of illegally removing archaeological resources. Silicato was also cited for a boating safety violation. All three were issued summonses to appear in Superior Court and released.

Under Delaware law, it is illegal to remove archaeological resources – defined as artifacts or other material remains of past human life at least 50 years old – from state-owned lands without a permit from the Division of Historical and Cultural Affairs of the Delaware Department of State.
