Annual Tier II reports (often referred to as EPCRA Section 312 reports) in Delaware can be submitted on-line using Tier II Manager™. EPCRA Section 302 and 311 reports can be submitted on-line as well. The system is accessible through the Internet using typical Web browsers, and no special software is necessary. Facilities that have previously reported will not need to re-enter all their data. Instead, they can update and submit using their previous data already loaded in the system. Tier II Manager™ also offers the option to pay fees on-line by a variety of methods. For those that do not wish to report or pay on-line, the traditional forms of reporting and payment are still available. However, we strongly urge facilities to use the on-line reporting system. With Tier II Manager™, updated information submitted by facilities can be viewed immediately by emergency planners and responders, avoiding delays associated with processing of paper forms. In addition, the system has built in edit checks, to help avoid common errors.

Tier II reports for calendar year 2013 are due by March 1, 2014. However, there are several changes that will be effective beginning in 2014:


We are implementing a new version of our online reporting system, TIER II MANAGERTM. The new version has been developed using a new platform, to keep pace with changes in technology. While the system screens will have a new look and feel, the overall reporting process using the system will be similar to previous years.

U.S. EPA Changes to Tier II Data Elements

The U.S. Environmental Protection Agency (EPA) has made changes to the Tier II reporting requirements by adding several data elements and modifying several existing items. EPA has developed a fact sheet providing an overview of the changes . These changes are effective January 1, 2014, which will include the 2013 calendar year reports. The new version of Delaware’s online TIER II MANAGER TM system mentioned above will incorporate the EPA modifications, and reports submitted on- line using the new system will comply with the EPA changes.

Electronic Certification

Unlike previous years, Tier II Manager electronic certification Is now considered sufficient without a hardcopy signature. Facilities are no longer required to print the Fee Summary/Certification Letter, sign in ink, and mail it to DNREC for each online submission. If a facility: (1) uploads a Site Plot Plan into Tier II manager or has an accurate one already electronically on file in Tier II Manager, (2) pays all applicable fees online, and (3) submits their report online, then nothing will need to be mailed.

However, if a facility is mailing a check or submitting a hardcopy Site Plot Plan, then they must attach a hardcopy of the email notification they received from the system once the online submission is complete. This will ensure the mailed items are matched with the appropriate facility and online report submission.
