Amendments to 7 DE Administrative Code 1140, "Delaware Low Emission Vehicle Program" 




The Department of Natural Resources & Environmental Control (DNREC) is proposing to adopt the California’s Low Emission Vehicle (LEV) III, Greenhouse Gas (GHG), and the Zero Emission Vehicle (ZEV) revisions (also known as the Advanced Clean Cars Program) under the Delaware LEV Program regulation, 7 Admin. C. 1140. 

The Advanced Clean Cars Program combines the control of smog-causing pollutants and GHG emissions into a single coordinated package of requirements for model years (MYs) 2015 to 2025 for LEV III standards and MYs 2017-2025 for GHG standards.  In addition, the Advanced Clean Cars Program proposes new rules to deliver increasing numbers of zero-emission vehicle technologies, such as full battery electric vehicles, plug-in hybrid electric vehicles, and hydrogen fuel cell vehicles, starting in MY 2016. 

In Delaware, the affected sources of mobile emissions by this regulation are passenger cars, light-duty trucks and medium-duty passenger vehicles.   The planned amendment will reduce emissions of criteria and other toxic air pollutants and improve air quality.


Delaware’s anticipated schedule for adopting the revisions to Regulation 1140:

  • Start Action Notice Approved - Completed on February 6, 2013
  • Draft Regulatory Language Available – March 2013
  • Public Workshop – June 2013
  • Proposed Regulatory Language Published in Delaware Register – July 2013
  • Public Hearing – August 2013
  • Secretary's Order – September 2013
  • Final Regulatory Language Published in Delaware Register – October 2013
  • Effective Date – October 2013


The DAQ held the 1st workgroup meeting on Thursday, March 28, 2013 at 10 am in the Blue Hen Corporate Center in Dover, to discuss the proposed amendments to Regulation 1140.

Comments received:  Delaware Automobile and Truck Dealers Association The DAQ will hold a 2nd workgroup meeting on Friday, May 3, 2013 at 10 am in the Kent County Complex building.  The address for the Kent County Complex Building is 555 S. Bay Road (Room 220), Dover.   The purpose of this meeting is to further discuss the Advanced Clean Cars Program.  MEETING CANCELLED!
