Sections and Programs

 

The Division of Waste & Hazardous Substances (WHS) oversees the handling, transferring, and storing of solid and hazardous materials by regulating, monitoring, inspecting, enforcing and responding to emergencies. The Division’s responsibilities include programs for:

  • Maintaining and installing underground and aboveground storage tanks, and overseeing cleanup of tanks that may leak, as well as maintaining boiler safety. 
  • Responding to environmental emergencies, working to prevent industrial accidents and ensure emergency planning and the community’s right-to-know about hazardous chemicals and wastes at nearby facilities. 
  • Remediating sites contaminated by hazardous substances. 
  • Reusing, recycling, transporting and disposal of solid and hazardous waste.

Director’s Office: administers and directs the operations of the Division of Waste & Hazardous Substances’ Emergency Prevention & Response, Remediation Section, Compliance & Permitting Section, and Tank Management Section. The director’s office carries out cost recovery procedures to recoup state monies used in the cleanup of environmental violations and emergency incidents, develops and implements policies and procedures for the division, coordinates legal assistance for the division, and coordinates division outreach.

Remediation Section (formerly the Site Investigation & Restoration Section) is responsible for the identification, evaluation and remediation of hazardous substances and waste sites in the state, from brownfields to federal superfund sites to leaking underground and aboveground storage tank cleanup sites and RCRA corrective action sites.

Compliance and Permitting Section (formerly the Solid and Hazardous Waste Management Section) ensures - through regulation and permitting mechanisms - that waste generated, transported, treated, recycled, reused or disposed in Delaware is managed in an environmentally safe manner. The section also encourages, through voluntary means, waste reduction, reuse, and recycling activities. (Also see Delaware's Green Industries Program.) This section also manages the underground and aboveground storage tank compliance programs.

Emergency Response and Strategic Services Section administers and assists with emergency response, accidental release prevention, boiler safety, public communications and manages financial support for the Division of Waste and Hazardous Substances. Emergency Response within the Section responds statewide 24/7 to oil spills, hazardous material incidents, and possible terrorist threats, as well as coordinates responses with local fire departments and various local, state, and federal agencies. The section also implements the Emergency Planning and Community Right-to-Know and Accidental Release Prevention Programs. In addition, the boiler safety staff have the responsibility of inspecting and overseeing the construction, installation and repair of all boilers and pressure vessels that are installed in the State of Delaware, except those exempted by Title 29 Chapter 80, (8028, and 8029) located in a "place of public assembly."  The Strategic Services Branch within the section provides communications and financial support to Division staff.
