Sediment and Stormwater Regulations - 2016 Revisions


A Superior Court decision Oct. 7, 2015 invalidated the 2013-2014 version of the Delaware Sediment and Stormwater Regulations on procedural grounds, because the accompanying Technical Document referenced by the regulations was not published in the Delaware State Register in accordance with Administrative Procedure Act requirements. Initially, this action to adopt the Technical Document was to be taken in order to have the Technical Document in the State Register published as a separate document referenced in 5101 Sediment and Stormwater Regulations. Following discussions with legislators and stakeholders, DNREC concluded that it would be most efficient to work with the Regulatory Advisory Committee (RAC) and others to identify any changes to the regulations and technical documents, and adopt them through a single process. Changes to the regulation and technical documents will then be proposed, published in the State Register of Regulations and be the subject of a public hearing.

Weather Closings and Delays:
In the event of inclement weather on the days of RAC or Subcommittee meetings scheduled at Tidewater Utilities, the meeting will be canceled if any of the following closings are in effect::

  • State of Emergency for the State of Delaware
  • State of Delaware Kent County offices closed

In the case of a weather delay, the meeting will begin at the planned opening time for State of Delaware Kent County offices if the meeting is scheduled for a start time prior to the office opening time.  For example, if the meeting is scheduled for 9 a.m. but State of Delaware Kent County offices are delayed in opening until 10 a.m., the meeting will begin at 10 a.m.

If Tidewater Utilities closes but State of Delaware offices are open, a meeting cancellation email will be sent to interested parties as soon as possible.
