Legislative Updates and Functionally Equivalent Practices for the Sediment & Stormwater Program


The 148th General Assembly took legislative actions related to DE Code Title 7, Ch. 40 (Delaware Sediment & Stormwater Law), including Senate Bill 253 and House Bill 194. SB253 exempted residential land disturbing activity less than 1 acre from the post construction stormwater management requirements of the regulations, and required agricultural structures to be approved through standard plans. HB194 exempted minor linear utility projects from post construction stormwater management requirements as well. 

One of the provisions included in the changes to Title 7, Ch. 40 under SB 253, is an allowance for applicants to use practices and procedures that are deemed to be functionally equivalent to the Post-Construction Stormwater Best Management Practices (BMP) Standards & Specifications that were published with the April 2016 Emergency Regulations. These practices that have been vetted through Delaware's Regulatory Advisory Committee (RAC) and proposed for adoption have been determined to meet the functionally-equivalent criteria. The Sediment & Stormwater Program will maintain this list of functionally-equivalent practices while the RAC continues to meet and finalize their recommendations for formal revisions to the state's Sediment & Stormwater Regulations.
