 Seaford Salvage Scheduled for Tire Cleanup by the Division’s Scrap Tire Control and Cleanup Program – The Solid and Hazardous Waste Management Branch will begin removing tires from the Seaford Salvage scrap tire cleanup site in May 2008. The Seaford Salvage site is located in Bethel, with approximately 200,000 to 250,000 passenger vehicle tires at the site. The cleanup should take six to eight weeks to complete. For more information, please contact Laurene Eheman at (302) 739-9403, or visit: http://www.awm.delaware.gov/Info/Pages/ScrapTire.aspx.

Delaware Announces Agreement on Climate Registry Protocol for Voluntary Reporting of Greenhouse Gas Emissions – As part of North America’s largest climate change initiative, Delaware announced the agreement of a common greenhouse gas reporting standard, The Climate Registry’s General Reporting Protocol. The protocol defines the methodology for corporations, organizations, cities and counties to calculate, verify and publicly report greenhouse gas emissions and incorporates public comments from workshops held throughout North America. Free Recycling Assistance Available to Schools, Businesses, or Town Offices in Newport, New Castle and Georgetown – Schools, businesses or town offices in Newport, the City of New Castle and Georgetown are encouraged to contact the Northeast Recycling Council for free on-site technical assistance to implement or expand recycling activities at their facilities. DNREC and the Department of Correction Partner to Offer Marinas, Boat Storage Facilities Free Pickup and Recycling of Boat Shrink Wrap – The Division’s Solid and Hazardous Waste Management Branch, in partnership with the Delaware Department of Correction (DOC), has started a program to recycle marine shrink wrap collected from marinas and other boat storage facilities. Shrink wrap is used to cover thousands of boats in Delaware each year for winterization. Once boating season arrives, all that plastic is removed and trucked to landfills. The new program sends shrink wrap to recyclers instead, keeping it out of the landfill, reducing oil consumption, conserving resources and saving disposal costs for those who choose to participate. April 30 – Public Hearing for The Premcor Refining Group, Inc.’s Coastal Zone Permit Application will be held at 6:00 PM at the Delaware City Public Library at 250 5th Street in Delaware City. The application is for the installation of additional pollution control equipment in the Fluid Catalytic Cracking Unit (FCCU) which will decrease nitrogen oxide (NOx) emissions from the FCCU by 512.5 tons per year. The applicant will use this decrease in emissions to offset an additional 33 tons per year of nitrates, which will be added to their wastewater discharge. This is a pollution control project and will not increase production or capacity at the Delaware City Refinery. Violations

Delaware City Refinery – DNREC issued a stipulated penalty demand to The Premcor Refining Group, Inc. on March 7 for exceedances of Delaware’s ambient air quality standards (AAQS) for Total Suspended Particulate Matter during the fourth quarter of 2007.  Current coke storage and handling practices created emissions that caused two exceedances of the secondary standard.  The $20,000 penalty is due within 60 days of receipt of the demand. In 2007, Premcor exceeded the primary standard four times and the secondary standard sixteen times. Final Plan Approvals - Proposed Revisions to the State Implementation Plan (SIP) for the Attainment of the Fine Particle (PM2.5) National Ambient Air Quality Standard (NAAQS) and Delaware’s 2002 Base Year PM2.5 SIP Emission Inventory DNREC Secretary John A. Hughes issued two orders for the Final Plan on April 1, 2008. In April 2005, the USEPA designated 126 areas of the country as "non-attainment" areas under the annual PM2.5NAAQS. Among those non-attainment areas is the Philadelphia-Wilmington, PA-NJ-DE Non-Attainment Area (NAA). This NAA includes New Castle County in Delaware, and federal law requires the NAA to attain the NAAQS by April 2010. Delaware developed the State Implementation Plans in response to the non-attainment designation. Tapeta Footings Receives Coastal Zone Act Permit for the Manufacturing of Horse-Track Surface Material – DNREC Secretary John A. Hughes issued an order on April 2, 2008 for a Coastal Zone Act Permit to Tapeta Footings, Inc. to operate a new manufacturing facility at 391 Pigeon Point Road in New Castle. Tapeta submitted a revised permit application on Nov. 20, 2007. A public hearing was held on the application on Feb. 28, 2008. The proposed operation will take a mixture of sand, polymeric fibers, synthetic rubber, wax and washed polyethylene and/or crosslink polyvinylchloride (PVC), and blend them together to produce the Tapeta product, which is used as horse racetrack surface material. The operation may generate up to 150,000 tons of Tapeta per year, along with a total of 4.48 tons per year of associated air emissions. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE CROZIER CENTER PROPERTY SITE IN NEWARK NOTICE START DATE: 03/31/2008 NOTICE END DATE: 04/21/2008   The Brownfields Development Program encourages the cleanup and redevelopment of any vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property (known as a brownfields developer) negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a Brownfields Development Agreement (BDA) to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. SIRB negotiated a BDA with BPG Office Partners XIII Iron Hill LLC for the Crozier Center Property. The site is approximately 25.25 acres, located at 400 Christiana Road in Newark. The site may have had a release of hazardous substances as a result of its past use, including as dry cleaning operation. DNREC invites written public comments on this BDA. PROPOSED PLAN OF REMEDIAL ACTION FOR THE 38 VANDEVER AVENUE SITE IN WILMINGTON NOTICE START DATE: 03/26/2008  NOTICE END DATE: 04/14/2008  SIRB announced the Proposed Plan of Remedial Action for the 38 Vandever Ave. site in Wilmington. The site is approximately 0.3 acres in size, near the intersection of Palmer's Row and Vandever Avenue. The property was operated as a machine shop and foundry by the A.C. Layman Machine Company from approximately 1927 to 1992 and the past industrial use of the property may have resulted in the increased levels of polycyclic aromatic hydrocarbons (PAHs) and metals detected in soils.  Elevated metals and pesticide concentrations were also detected in groundwater. The property owner is planning to construct a 10,000 square foot steel framed building with the rest of the area to be paved, upon completion of the remedial action. 

DNREC invites written comments on the Proposed Plan. TITLE V MODIFICATION APPLICATION FOR DOW REICHHOLD SPECIALTY LATEX LLC IN DOVER NOTICE START DATE: 04/06/2008 NOTICE END DATE: 05/06/2008 Dow Reichhold Specialty Latex LLC, having a facility at 144 Fork Branch Road in Dover, has requested a federally enforceable Regulation No. 1102 construction permit for a 29,405-gallon styrene storage tank. The permit will not increase emissions of volatile organic compounds or hazardous air pollutants. Upon completion of construction, the Department will incorporate the operating conditions and limits of the Regulation No. 1102 Construction permit into the facility's existing Title V permit via an Administrative Amendment. The "draft/proposed" construction permit is being submitted to USEPA prior to the public comment period for concurrent processing.  If there are no significant comments, the "draft/proposed" construction permit will be issued as a final permit after expiration of the USEPA review period.

A public hearing on the above application will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding the application by May 6, 2008. The application, the "draft/proposed" construction permit, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the draft/proposed permit may be inspected at the offices of the Division of Air and Waste Management, 156 S. TITLE V PERMIT RENEWAL APPLICATION FOR CITY OF DOVER-VAN SANT NOTICE START DATE: 03/16/2008 NOTICE END DATE: 04/15/2008  The City of Dover – Van Sant, having a facility at Electric Avenue, Dover, Delaware, has submitted a request for permit renewal pursuant to Regulation No. 30, Section 7.  Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC. Therefore a "draft/proposed" permit renewal has been prepared. This "draft/proposed" permit renewal incorporates revised requirements from 40 CFR Part 60 Subpart GG; revised requirements from 40 CFR Part 75; changes requested by the City, the applicable requirements of Regulation No. 1141, and revisions to the permit for the current standard format.  All other permit conditions will transfer into the renewal permit. The "Draft/Proposed" permit renewal is being submitted to USEPA prior to the public comment period for concurrent processing.  If there are no significant comments, the "Draft/Proposed" permit renewal will be issued as a final permit after expiration of the USEPA review period.

TITLE IV AND REGULATION NO. 39 PERMIT RENEWAL APPLICATIONS FOR THE CITY OF DOVER-MCKEE RUN NOTICE START DATE: 03/16/2008  NOTICE END DATE: 04/15/2008 The City of Dover – McKee Run having a facility at 880 Buttner Place, Dover, Delaware, has submitted a request for permit renewal pursuant to 40 CFR Part 72.30(c) and Regulation No. 30, Section 7.  Based on the data and certifications contained in the applications, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC.  Therefore, the "draft/proposed" permit renewals have been prepared.  There has been no change to the applicable requirements and all existing permit conditions will transfer into the renewal permits. The "Draft/Proposed" permit renewal is being submitted to USEPA prior to the public comment period for concurrent processing.  If there are no significant comments, the "Draft/Proposed" permit renewal will be issued as a final permit after expiration of the USEPA review period.

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice has been given that the facilities listed below have applied for Title V Synthetic Minor permits. The applications and “draft" permits may be inspected at the office of the Division of Air and Waste Management, 156 S. State Street in Dover. To submit comments, for additional information or for an appointment to inspect the public file, please contact Joanna Austin in the Dover office at (302) 739-9402.

  • Honeywell International Specialty Materials submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for a facility-wide operating permit at 6100 Philadelphia Pike in Claymont. Honeywell requested a limit for less than 25 tons per year (TPY) of total volatile organic compound (VOC) emissions and less than 10 TPY for any single hazardous air pollutant (HAP) and 25 TPY aggregate HAPs facility-wide.  These limits are necessary to restrict Honeywell International's potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state.  Total estimated emissions from these limitations taken at the facility are 22 TPY VOCs, and less than 10 TPY HAPs.   • Prince Minerals, Inc., located at 301 Pigeon Point Road in New Castle, submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for Synthetic Minor Permit Amendment to incorporate changes in its Ball Mill unit operation at the 301 Pigeon Point Road facility.  An administrative amendment changing the company name from American Minerals to Prince Minerals will also be made in this permit amendment. Prince Minerals, Inc. requested a limit for production rate and operation hours on its Ball Mill operation. These limits are necessary to restrict Prince Minerals, Inc. potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total emissions from the Ball Mill Operations are limited to 1.9 tons per year of particulate matter.  Other permit emission limits remain unchanged. A public hearing concerning the permitting action will not be held unless the Secretary of DNREC receives a request for such hearing by April 22, 2008. REGULATION 1102 NATURAL MINOR PERMIT APPLICATIONS

Notice has been given that the facilities listed below have applied for a Regulation 1102 Natural Minor permit. The applications may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware, or 715 Grantham Lane, New Castle, Delaware. A public hearing on the following applications will NOT be held unless the Secretary of DNREC receives a request for that application by April 14, 2008:

  • Rohm and Haas Electronic Materials in Newark submitted a permit application to install two (2) new cold solvent degreasers at Building 5.These new degreasers will replace the existing two cold solvent degreasers.
  • Hercules Inc., Corporate Office in Wilmington submitted a permit application to install an Emergency Generator – EG-1, Caterpillar D-349, rated heat input 9.1 mmBTU/hour. Total maximum annual emissions from this unit shall not exceed:  0.59 ton of nitrogen oxides (NOx), 0.03 tons of sulfur dioxide (SO2), and 0.01 tons of particulate matter less than 10 microns in size (PM10). 
  • Contractual Carriers. Inc. requested a permit amendment to increase the amount of used motor oil in the CB-500 used oil heater at their 104 Allen Drive facility in Newark.  By permit, the used oil used to fire the heater shall meet the following requirements for the listed constituents and properties:  Arsenic-5 parts per million (ppm) maximum; Cadmium-2 ppm maximum; Chromium-10 ppm maximum; Lead-100 ppm maximum;  Total Halogens-1,000 ppm maximum; Sulfur 1% by weight maximum; Flash Point 100 degrees Fahrenheit minimum.

 Employee News

Congratulations to Karen Anderson of the Division’s Environmental Crimes Unit, who was promoted from Enforcement Officer Trainee to Enforcement Officer I, and Jae-Soo Chang of the Division’s Solid and Hazardous Waste Management Branch, who was promoted to Engineer II, both effective March 30. Congratulations also to Amee Dominguez on her 5-year anniversary with the Division’s Solid and Hazardous Waste Management Branch (SHWMB), and Ted Allen and Tom Lilly, on their 10-year and 15-year anniversaries, respectively, with the Division’s Air Quality Management Section, all in March. Congratulations also to Paul Will (SIRB) and Avery Dalton (SHWMB) on their 15-year anniversaries in April.

Kudos to Rob Underwood, Bill Miller and Jim Short of the Solid and Hazardous Waste Management Branch who all implemented a very successful mulching operation at the New Castle County yard waste sites. The mulching operation produced about 2,500 cubic yards at the DART site and about 1,900 cubic yards at Polly Drummond site for a total of about 4,400 cubic yards of mulch.  Several users of the sites expressed their gratitude not only for a free site to dispose of yard waste, but also for the high quality mulch.  The team of Rob, Bill and Jim has done a great job of making the yard waste sites a resounding success.

Special thanks also to Karissa Hendershot of SIRB for preparing a map of all the hazardous chemical release sites and wells in and around the Delaware City Industrial area. Karissa’s efforts required extensive coordination with the Division of Water Resources and the Division of Public Health as well as the USEPA.
