News Updates
Emergency Response – On July 17, the Division’s Emergency Response Team (ERT) responded to a State Emergency Response Team Level I incident at Agilent Technologies in Stanton. Several fire companies and the New Castle County decontamination emergency response unit also responded. Fifty (50) gallons of tetrahydrofuran, a volatile and flammable liquid solvent, spilled in the building. The ERT conducted the initial entry into the building in Level B personal protective clothing and equipment to asses the extent of the spill and determine clean-up strategies.
Delaware City Refinery Update – Last month, the Division’s Air Quality Management Section issued five operating permits to the Premcor Delaware City Refinery for operations related to the Pollution Control Upgrade Project (PCUP). They include the crude unit, crude unit heater 21-H-701, the sulfur recovery unit, and the new wet gas scrubbers at the fluid coker unit and fluid catalytic cracking unit. The resulting annual reductions in sulfur dioxide (SO2) from the two wet gas scrubbers are expected to be greater than 37,000 tons or an approximately 90% reduction in SO2 emissions from these units, with a greater than 60% reduction for the overall refinery SO2 emissions.
Last week, a leak developed at the refinery in one of the reboilers of the Cansolv regenerator stripper of the fluid catalytic cracking unit's (FCCU) wet gas scrubber. The regenerator is the section where the SO2 is stripped from the rich amine, which gets regenerated as a lean amine and circulated back to the absorber in the process. In order to carry out repairs to the reboiler, the Cansolv system was temporarily taken out-of-service. During the projected week-long repair, the carbon monoxide boiler and Belco pre-scrubber will not be bypassed at any time. Since the carbon monoxide boiler and pre-scrubber remain functional and operating, exceedances of Delaware Reportable Quantities and /or opacity are not anticipated. Premcor indicated that the repairs will likely be completed by July 31. DNREC provided regulatory oversight. Recycling at the State Fair – On July 16, Division of Air and Waste Management representatives placed recycling containers throughout the fairgrounds located at the Delaware State Fair in Harrington, at entranceways and along heavily traveled walkways, for convenience and easy access. There were also recycling containers placed in front of DNREC’s education building located on East Rider Road. The recycling containers include bright yellow lids with green bodies; they are labeled with bottle and can images and the signage that states: “Recycle Here.” DNREC’s Americorps volunteers gathered cans and bottles from the containers for deposit at the nearest Delaware Solid Waste Authority Recycle Delaware Center. Information on recycling and proper management of yard waste was available at DNREC’s Education Building.

Secretary’s Order
Secretary’s Order No. 2007-A-0026, signed July 16, amends Subparts T and RRR of Regulation No. 38, Emission Standards for Hazardous Air Pollutants for Source Categories. The amendments make the regulation consistent with recent federal regulatory changes by permanently exempting the smaller area source solvent degreasers (Subpart T) and aluminum sweat furnaces (Subpart RRR) from Title V permitting requirements. Subparts T and RRR were revised from their current adoption by reference language to full-text requirements and were renumbered consistent with the Code of Delaware Regulations. The effective date of these amendments is August 11. FINAL REMEDIAL ACTION PLAN FOR THE FORMER HERCULES (AKA DELAWARE NATIONAL) GOLF COURSE TECHNICAL ASSISTANCE SITE IN WILMINGTON Notice Start Date: 07/18/2007 Notice End Date: 08/17/2007
The Site Investigation and Restoration Branch (SIRB) concurred with the Proposed Remedial Action (PRA) plan as amended being the Final Remedial Action (FRA) plan for the Former Hercules (aka Delaware National) Golf Course Technical Assistance site. The site is located on Hercules Road, west of Newport Gap Pike (Route 41) and south of Lancaster Pike (Route 48) in Wilmington. The site is comprised of two parcels totaling approximately 162 acres. The northern parcel (tax parcel # 08-026.00-052) is approximately 101 acres and has been used as a golf course since 1947. The southern parcel (# 08-033.00-001) is approximately 61 acres, and remains wooded and unoccupied. Toll Brothers, Inc. plans to construct approximately 160 single family residential units on a portion of the wooded property. DNREC is providing technical assistance on the cleanup project under a Memorandum of Understanding (MOU) with New Castle County.

NOTIFICATION OF PUBLIC COMMENT PERIOD FOR BROWNFIELDS VOLUNTARY CLEANUP PROGRAM (VCP) OR BROWNFIELDS DEVELOPMENT AGREEMENTS (BDAs) SIRB has entered into a BDA or Brownfields VCP agreement for the two sites listed below. The agreements are to perform an investigation and, if necessary, a remedial action, for the purpose of addressing risks posed by past releases of hazardous substances at these sites. Following cleanup, liability protection may also be granted. The BDA is only available to parties that are not current site owners. Current site owners of a certified Brownfields property may enter into a different agreement, the Brownfields VCP Agreement, designed for site owners who may already be liable as a potentially responsible party. - BROWNFIELDS VCP AGREEMENT FOR THE HOWARD STREET COMMERCIAL REDEVELOPMENT PROPERTY – The site is located between 316 and 600 South Market Street in Wilmington, and consists of 8.7 acres. Previous investigations at the site indicated that metals, polychlorinated biphenyls (PCBs) and polycyclic aromatic hydrocarbons exceeded DNREC’s cleanup action levels. Portions of the site were owned or operated by Penn Del Metal Recycling, Baltimore and Ohio Railroad, and a gasoline station, as well as other commercial operations. The public comment period began on July 16, 2007 and will close at the end of the business day (4:30 PM) on August 6, 2007. SIRB negotiated a BDA with Mr. Emmett T. Foster and Mrs. Cheryl Foster regarding the 0 Miller Road site. Surface soils testing at the site revealed elevated concentrations of arsenic, iron and manganese. FINAL PLAN OF REMEDIAL ACTION REGARDING THE FORMER AMOCO POLYMER PLANT-OPERABLE UNIT-2 IN NEW CASTLE

SIRB adopted the proposed plan of remedial action as the final plan of remedial action for the Former Amoco Polymer Plant site, Operable Unit-2 (OU-2). The site is located on 950 River Road in New Castle, Delaware. The Former Amoco Polymer Plant was divided into two operable units (OU-1 and OU-2) for the purpose of performing a remedy. DNREC issued a final plan of remedial action for OU-1 in October 2002. DNREC issued the proposed plan of remedial action for OU-2 in December 2003, however, there was a delay in issuing the final plan for OU-2 due to unauthorized construction activities on the upland portion of OU-2.
OU-2 occupies approximately 50 acres along the Army Creek Marsh within both upland and wetland areas of the Former Amoco Polymer Plant site. OU-2 is bordered by OU-1 to the south, River Road and the Delaware River to the east, Army Creek to the north, and two Federal Superfund Sites, Army Creek Landfill and Delaware Sand and Gravel (DS&G), to the west. Numerous investigations to evaluate the Army Creek Marsh confirmed that deposits of process residuals (i.e., plastic and chemicals) remain on portions of OU-2. SIRB announced the proposed plan of remedial action for the Former Harper-Thiel site. The site is located at 3201 Miller Road in Wilmington. The current owner of the site is the Wilmington UDAG (Urban Development Action Grant) Corporation; however, at this time there are no specific redevelopment plans for the site. The previous owners used the property for the electroplating of chrome, nickel, cadmium and copper from 1946 until 2000. The operations at the site resulted in releases of hazardous substance(s) into the soils and groundwater.

PROPOSED AMENDMENT TO SUBPART N OF REGULATION NO. 38, EMISSION STANDARDS FOR HAZARDOUS AIR POLLUTANTS FOR SOURCE CATEGORIES

The purpose of the amendment to Subpart N of Regulation No. 1138 is to be consistent, where appropriate, with the federal requirements applicable to chromium electroplating facilities. One of the federal changes, which the Department proposes to include, will permanently exempt small area sources from Title V permitting requirements. These sources will still be subject to the maximum achievable controls technology (MACT) requirements through their air permits under Regulation 1102, Permits. In addition, Subpart N of Regulation No. 38 will be converted from an "adoption by reference" format to providing the complete regulatory text and will be renumbered consistent with the Delaware Administrative Code format.
A public hearing on the Proposed Amendment to Regulation No. 38 will be held Thursday, August 23, 2007, beginning at 6:00 PM in the DNREC Auditorium, 89 Kings Highway, in Dover. Notice has been given that Magellan Terminals Holdings, L.P., has requested federally enforceable Regulation 2 construction permits for their facility at 1050 Christina Avenue in Wilmington. The construction permits will result in a Title V permit modification to construct eleven volatile organic liquid (VOL) storage tanks for gasoline and other VOL storage; reconstruct/modify an existing truck loading rack with associated vapor recovery unit from four uncontrolled top-loading submerged-fill bays to controlled seven bottom-loading bays to handle gasoline, distillate fuel oil, and ethanol; construct a marine tank vessel gasoline loading platform with associated natural gas fired vapor combustion unit to load barges; and install a 600 kW emergency generator. The permit modification will increase volatile organic compound emissions by 22.38 tons per year.

- Corrado Construction Co., LLC’s application, pursuant to Delaware Air Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for a synthetic minor construction permit at 210 Marsh Lane, New Castle. Corrado requests a limit for diesel fuel usage equal to or less than 74,160 gallons in a 12-month rolling period. These limits are necessary to restrict Corrado’s potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. - Bracebridge Corporation/Bank of America – Deerfield Complex's application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for the construction of a diesel fired emergency generator at 655 Paper Mill Road in Newark. Bracebridge Corporation/Bank of America – Deerfield Complex requests the following limits: nitrogen oxides (NOx) – 0.046 tons per year (TPY), carbon monoxide (CO) – 0.016 tons per year, sulfur dioxide (SO2) – 0.015 tons per year, particulate matter (PM) – 0.0022 tons per year, and volatile organic compounds (VOCs) – 0.0023 tons per year. These limits are necessary to restrict Bracebridge Corporation/Bank of America – Deerfield Complex's potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility are 22 tons per year of NOX, 21 tons per year of CO, 2.04 tons per year of SO2, 1.25 tons per year of PM, and 4.0 tons per year of VOCs. - Sea Watch International, Limited's application pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for the construction of one 24.5 mmBTU/hr boiler fired on natural gas as a primary fuel and No. 5 fuel oil as a secondary fuel at 242 South Rehoboth Boulevard in Milford. Sea Watch International, Limited requests a rolling 12 month limit of 90 million cubic feet of natural gas and 60,000 gallons of No. 5 fuel oil to restrict emissions below the five ton per year applicability threshold of Regulation No. 1125, Section 4, Minor New Source Review, and to restrict facility-wide emissions of NOx and sulfur oxides (SOx) below the major source thresholds. These limits are necessary to restrict Sea Watch International, Limited's potential to emit air pollutants and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the new boiler are 4.98 TPY NOx, 2.18 TPY CO, 2.42 TPY SOx, 1.16 TPY PM and 0.34 TPY VOCs. TITLE V RENEWAL APPLICATIONS
Notice is hereby given that Mountaire Farms of Delmarva (Selbyville Processing Plant) having a facility in Selbyville, Delaware has submitted a renewal application pursuant to Regulation No. 30, Title V State Operating Permit Program, to operate equipment at the facility. Based on data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the Environmental Protection Agency (EPA) and Department of Natural Resources and Environmental Control. Therefore, a "draft" Permit:AQM-005/00073(R2) has been prepared which incorporates all applicable requirements for all regulated air pollutants and which requires the facility to comply with the terms and conditions of the permit and be liable for all violations of the permit conditions and applicable federal and state rules. Mountaire Farms of Delmarva has agreed to reduce the sulfur content of No. 6 fuel oil from 2.0 weight percent (wt %) to 1.0 wt %. Emissions of SO2 will be reduced from 170 TPY to 84 TPY. The "draft" permit updates AP-42 emission factors, changes the status of Boiler Nos.3, 4 and 5 and a 15,000 gallon No. 6 fuel oil tank from Emission Units to Insignificant Activities (with applicable requirements), and incorporates miscellaneous equipment as Insignificant Activities (emergency generator (with applicable requirements), garage heaters, underground gasoline and diesel tanks, refrigeration units, and motor vehicle air conditioners).

- Allen's Hatchery, Inc. – Allen's Milling Division's permits to construct or a 7,000 bushel per hour grain dryer, and grain receiving, storage, and shipping operations at their 20765 Wesley Church Road, Seaford facility. The grain processing operation has the potential to emit (PTE) 83.76 TPY of PM10, 3.41 TPY of SOx, 44.08 TPY of NOx,, 7.0 TPY of CO, and 1.14 TPY of VOCS. A public hearing on the following application will NOT be held unless the Secretary of DNREC receives a request for that application by August 13, 2007:
· Sussex County Council requests Permit:APC-2007/0131-CONSTRUCTION/OPERATION to operate a 1500 kW emergency generator at their South Coastal Regional Wastewater Facility, Station 40, in Frankford, Sussex County. The generator has a potential to emit (PTE) of 0.36 TPY of HC, 6.68 TPY of NOx, 1.59 TPY of CO, and 0.14 TPY of PM. Sussex County Council has agreed to a 300 hour per rolling twelve (12) month period operating limit to comply with the 5 TPY NOx threshold in Regulation No. 1125, Minor New Source Review. Permitted emissions are 0.21 TPY of HC, 4.00 TPY of NOx, 0.954 TPY of CO, and 0.081 TPY of PM.
· Delaware Solid Waste Authority, requests a permit to construct two (2) emergency generators rated at 80 kW and 150 kW at their Central Solid Waste Management Center in Sandtown, Kent County. The emissions from the emergency generators will be included in the Company's facility wide emission limit. Permits: APC-2007/0166-CONSTRUCTION and APC -2007/0167-CONSTRUCTION.
· Contract Crushing Construction, Inc., requests a permit to operate a 150 ton per hour Nordburg LT-1213 portable crusher, Fintec 542 screener and conveyor at the following locations: Diamond Materials, Wilmington, P&A LLC, Delmar, Independence Construction materials, Dover, and the Tilcon Delaware facilities located in Georgetown, Delmar, Dover, Gumboro, Seaford and Wilmington. The portable crushing plant has the potential to emit (PTE) 23.7 tons per year NOx, 5.1 tons per year SOx, 15.1 tons per year CO, 5.2 tons per year VOC and 11.9 tons per year PM. By Permit# 2006/0138 actual emissions will not exceed 7.78 tons per year NOx, 1.68 tons per year SOx, 4.95 tons per year CO, 1.72 tons per year VOC and 3.52 tons per year PM. Permit# 2006/0138-O-A1.
