News Updates

 

New Extended Hours for Recycling Christmas Trees at Community Yard Waste Drop-off Sites!  The new Polly Drummond Hill Community Yard Waste Drop-off site in the Pike Creek area is now open everyday from 8:30 AM until 4:30 PM through January 21, 2008 for recycling holiday greenery and yard waste. Christmas trees and greenery, like other yard waste, should be free of foreign material such as plastic bags, wires, and ornaments. The site is for residents to bring yard trimmings from their own yards, and is located ½ mile north of Kirkwood Highway on Polly Drummond Hill Road, directly across from the entrance to the Judge Morris Estate. The other New Castle County community yard waste drop-off site is DNREC’s Mid-County site at the DART facility on the southwest corner of U.S. Routes 13 and 72 near Bear. This site is also open 7 days/ week from 8:30 AM until 4:30 PM through January 21. After January 21, the community yard waste sites will return to a weekend schedule, Friday-Sunday, 8:30 AM to 4:30 PM. A third yard waste drop-off site is scheduled to open soon in northern New Castle County.

 

In addition, five state parks will accept Christmas trees for recycling: Bellevue and Brandywine Creek in northern New Castle County, Killens Pond near Felton, Trap Pond near Laurel, and Cape Henlopen in Lewes. Note that Lums Pond and White Clay Creek State Parks will not accept trees this year; residents living near these parks are asked to take their Christmas trees to one of the new yard waste drop-off sites nearby for recycling. Upcoming Air and Waste-Related Hearings, Meetings & Events

 

January Meetings of the State Emergency Response Commission (SERC) and the Local Emergency Planning Committees (LEPCs) - LEPCs were appointed by the Delaware State Emergency Response Commission. The LEPC provides a forum for interaction and information sharing among businesses, government officials, emergency organizations, and the public. January 16–Recycling Public Advisory Council Meeting will be held from 1:30 to 3:30 PM at the Brandywine Hundred Library in Wilmington, located at 1300 Foulk Road. Topics likely to be discussed include: Measurement & Methodology Sub-Committee Report; DNREC/DSWA Yard Waste Diversion; Value of Landfill Diversion Sub-Committee; and the Recycling Assistance Grant Program. January 18 – Brownfields Advisory Committee Meeting is scheduled to meet from 9:00 AM to 12:30 PM at the DNREC field office located at 391 Lukens Drive in New Castle, Delaware. NOTIFICATION OF NEGOTIATIONS FOR BROWNFIELDS DEVELOPMENT AGREEMENTS (BDAs)

The Brownfields Development Program encourages the cleanup and redevelopment of any vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property (known as a brownfields developer) negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a BDA to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. SIRB is negotiating BDAs with the following brownfields developers:

  • Delaware Restaurants for the Ray Panella Ski Shop Property – The site is approximately 0.18 acres in size and is located at 3916 Concord Pike in Wilmington. A Phase II Environmental Site Assessment has been completed to identify any potential environmental contamination at the site. Due to a dry cleaning operation immediately north and upgradient from the site, the site may have had a release of hazardous substances, however, further investigation is necessary to make a determination.   • Bank of America for the Brandywine Fibre Property The site is approximately 1.22 acres in size and is located at 1421 Clifford Brown Walk in Wilmington.  Real estate assessments by previous owners of the site showed that it has been used for industrial operations including tanning and vulcanized fabric production. Duffield Associates conducted a Remedial Investigation/Feasibility Study which found various metals, and free petroleum product in soil at the site.   • Riverfront Development Corporation for the Former P & C Roofing Property The site is approximately 1.33 acres in size and is located at 720 S. Madison Street in Wilmington. The results of a Phase II Environmental Site Assessment conducted at the site identified the presence of arsenic and polynuclear aromatic hydrocarbons (PAHs). The site was also used previously for the Dravo Shipyard and Harlan and Hollingsworth business and historical fill may be present.   • Jackson & Sharp, LLC for the 1101 East 8th Street/ Former Carney Harris Property The site is approximately 1.19 acres in size and is located at 1101 East 8th Street in Wilmington. Brightfields, Inc. conducted a Phase II Environmental Site Assessment at the property in August 2007, the results of which indicated the presence of arsenic, lead, PAHs and polychlorinated biphenyls (PCBs) at the site. NOTIFICATION OF NEGOTIATIONS FOR BROWNFIELDS VOLUNTARY CLEANUP PROGRAM (VCP) AGREEMENT

Brownfields VCP Agreements are negotiated with brownfields site owners that do not otherwise qualify for BDAs under the Hazardous Substance Cleanup Act (HSCA).  BDAs are only available to parties that are not current site owners; the Brownfields VCP Agreement is available to provide a Brownfields site owner, who may already be liable as a potentially responsible party for the site, with a mechanism to remediate contamination while developing the site. Once the property is remediated, the brownfields owner will receive liability protection pursuant to HSCA for past releases of hazardous substances. SIRB is negotiating a Brownfields VCP Agreement with the following developer:

  • Michael Sparco regarding the 00 Mount Vernon Street Property. The site is about 0.57 acres in size and is located at 00 Mount Vernon Street in Smyrna.  As a result of past industrial uses, including use as a coal silo and gas station, a release of hazardous substances, such as arsenic and PAHs, may have occurred at the site. TITLE V PERMIT RENEWAL APPLICATION FOR THE PREMCOR REFINING GROUP, INC. IN DELAWARE CITY

NOTICE START DATE: 12/09/2007 NOTICE END DATE: 01/09/2008

The Premcor Refining Group, Inc., having a facility at 4550 Wrangle Hill Road in Delaware City, submitted a request for permit renewal pursuant to Regulation No. 30, Section 7. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC. Therefore a "draft" permit renewal has been prepared. The draft permit is a renewal of the facility's initial Title V permit AQM-003/00016–Part 1 issued on November 14, 2001.

 

A public hearing concerning the permitting action will NOT be held unless the Secretary of DNREC receives a request for such hearing by January 9, 2008. The application and the draft permit renewal may be inspected at the offices of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware and 715 Grantham Lane, New Castle, Delaware. REGULATION 1102 NATURAL MINOR PERMIT APPLICATIONS

Notice has been given that the facilities listed below have applied for Regulation 1102 Natural Minor permits. The applications may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware, or 715 Grantham Lane, New Castle, Delaware.   • E.I. DuPont de Nemours and Co., Red Lion Sulfuric Acid Regeneration Plant requested an amendment to their permit at their 766 Governor Lea Road, Delaware City facility. The plant currently has permitted nitrogen oxides (NOx) emission limitations of 1.26 pounds per hour and 12.2 tons per year.  DuPont's application requests increasing NOx emissions to 6.3 pounds per hour on a 3-hour rolling average basis from the main stack and 22.0 tons per year from the entire facility.  DuPont has also requested decreasing the facility's carbon monoxide (CO) emission limit from 23 tons per year to 12 tons per year.   • Diamond Materials requested a natural minor permit to construct and operate concrete crushing and screening equipment at the Dover Air Force Base. The crushers and screener have the potential to emit 4.1 tons of NOx, 3.1 tons of particulate matter, 1.1 tons of carbon monoxide, 0.2 tons of sulfur oxides (SOx) and 0.1 total tons of hydrocarbons. By permit, actual emissions will not exceed 4.1 tons of NOx, 0.3 tons of particulate matter, 1.1 tons of carbon monoxide, 0.2 tons of SOx and 0.1 total tons of hydrocarbons. TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice has been given that the facilities listed below have applied for Title V Synthetic Minor permits. The applications may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware, or 715 Grantham Lane, New Castle, Delaware. To submit comments, for additional information or for an appointment to review an application, please contact Joanna Austin at the Dover Office at (302) 739-9402. A public hearing concerning the permitting action below will NOT be held unless the Secretary of DNREC receives a request for such hearing by January 4, 2008. 

  • River Asphalt LLC has submitted an application for an asphalt plant permit amendment for their facility at 30548 Thorogoods Road in Dagsboro. River Asphalt LLC requests a limit for asphalt production based on stack testing data. These limits are necessary to restrict River Asphalt LLC potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility will only increase by 0.02 tons per year for sulfur dioxide.   • Orient Corporation of America has submitted an application for construction of an ammonia scrubber for their facility at 111 Park Avenue in Seaford. Orient Corporation of America requests a limit for ammonia emissions. This limit will be transferred to Orient Corporation of America's synthetic minor permit, and the limit will be enforceable by the USEPA and the state.  Total estimated emissions from the facility are 25.10 tons of ammonia.  Additional information is available at: http://www.dnrec.state.de.us/dnreceis/redirect.asp?ID=2657&MsgType=P.

Please join us in welcoming Krystal Stanley and Kathryn Durant, who have both accepted Environmental Scientist I positions with the Division’s Site Investigation and Restoration Branch. Congratulations to Shaikh Tayeb on his promotion to Engineer IV with the Division’s Air Quality Management Section, Engineering and Compliance. Congratulations also to Patrick Boettcher, with the Division’s Tank Management Branch (TMB) on his promotion to Hydrologist III.  Last, but certainly not least, a very fond farewell and best wishes to Emil Onuschak, Hydrologist V with TMB. Emil retired from his seasonal position with TMB on December 27, 2007.
