Leaf-Burning Ban in Delaware With autumn leaves falling, DNREC’s Air Quality Management Section would like to remind Delaware residents that burning leaves is prohibited statewide. The leaf-burning ban, in effect since February 1995, is important to protect people and the environment from harmful chemicals that are produced by open burning. Instead, why not compost leaves with yard trimmings and certain food scraps?  When properly composted, these wastes can be turned into natural soil additives for use on lawns and gardens. Illegal burning can be reported by calling 1-800-662-8802, or for cellular users, call #DNR, toll-free(Verizon customers only). Valero Delaware City Refinery Update – The 2nd new wet gas scrubber required under a 2001 Consent Decree, the fluid catalytic cracking unit flue gas sulfur dioxide (SO2) scrubber, is on schedule for mechanical completion with an in-service date of December 31, 2006.  The 1st new wet gas scrubber, the fluid coker unit flue gas SO2 scrubber, was placed in service on September 21, 2006. This scrubber continues to operate successfully at the facility and emits visible white steam as part of the process. Upcoming Air and Waste Related Hearings, Meetings & Events

 

October 25 – Public Hearing for Coastal Zone Act Permit Amendment for DuPont Edge Moor Facility will be held at 6:00 PM in the DNREC field office located at 391 Lukens Drive in New Castle. DNREC will conduct the public hearing to review a request for an amendment of Coastal Zone Act Permit No. 360, issued to DuPont on April 29, 2005 to make a new variety of titanium dioxide called R948. The purpose of the proposed amendment is to remove a 15,000 ton per year limitation to allow up to 190,000 tons per year of total plant capacity, as constrained by a separate Title V permit issued by DNREC's Division of Air and Waste Management. October 26 – Regulation 1102 Air Permitting Workshop will be held from 8:30 AM to 1:00 PM at the Del Tech Terry Campus located at 100 Dennys Road in Dover.  Designed for small business owners or employees who are assigned environmental compliance duties, for environmental contractors, or for anyone who needs to understand air permitting, the workshop will explain the value stream mapping procedures that Air Quality Management is now using as a tool to streamline the process of obtaining an air permit under Regulation No. 1102. NOTIFICATION OF NEGOTIATIONS FOR A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE NAGA FOODS SITE IN WILMINGTON  Notice Start Date: 10/11/2006 Notice End Date: 11/11/2006

DNREC is negotiating a Brownfields Development Agreement (BDA) with Naga Food Products, Inc. for the redevelopment of the Naga Foods site located at 1331 North Heald Street in Wilmington. A BDA is an agreement between DNREC and a Brownfield developer with respect to a Certified Brownfield site that sets forth a scope of work and schedule of remedial activities during the development of the site. The site may be contaminated with the hazardous substances as a result of past industrial use. FINAL PLAN OF REMEDIAL ACTION FOR THE SPEAKMAN TOWNHOMES SITE IN WILMINGTON

Notice Start Date: 10/22/2006 Notice End Date: 11/11/2006

DNREC has adopted the proposed plan of remedial action as the final plan of remedial action for the Speakman Townhomes site.  The site is located at the intersection of East 30th and North Spruce Streets, in Wilmington, Delaware. The site is approximately 8 acres in size, and consists of a asphalt parking lot and a portion of a manufacturing facility. In March 2006, DNREC approved the Brownfields Investigation (BFI) of the site, which indicated revealed that several contaminants of concern exceeded their respective values for Delaware's Uniform Risk-Based Standards for unrestricted (residential) use.

 

Copies of the proposed and final plans are available at the Wilmington Library or at the office of DNREC–SIRB, 391 Lukens Drive, New Castle, DE 19720. The plan are also posted on DNREC-SIRB's website at http://sirb.awm.dnrec.state.de.us under the subject "Announcements." DNREC invited comments on the proposed plan, however, DNREC did not receive any comments. TITLE V PERMIT RENEWAL APPLICATION FOR DSWA IN WILMINGTON

Notice Start Date: 10/22/2006 Notice End Date: 11/21/2006

The Delaware Solid Waste Authority's (DSWA’s) Northern Solid Waste Management Center (NSWMC) has submitted a request for a Title V air quality permit renewal for the facility located at 1706 E. 12th Street in Wilmington, Delaware.  Based on the data and certifications contained in the application, the Air Quality Management Section concludes that DSWA meets all applicable requirements promulgated by the US Environmental Protection Agency and DNREC.  Therefore, a "draft" permit renewal has been prepared.

 

The application, the "draft" permit renewal, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the draft permit renewal may be inspected at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware 19901 and 715 Grantham Lane, New Castle, DE 19720.  A public hearing concerning the permitting action will not be held unless the Secretary of DNREC receives a request for such hearing by November 21, 2006. CONSENT DECREE BETWEEN U.S., STATE, DUPONT AND CIBA TO RESTORE WETLANDS HABITAT IN DELAWARE’S MISPILLION RIVER ECOSYSTEM  Notice Start Date: 10/12/2006 Notice End Date: 11/13/2006

The federal government and DNREC reached a settlement with chemical companies DuPont and Ciba to resolve claims relating to the release of hazardous substances from the DuPont Newport superfund site. The site contaminated wetlands in and around the Christina River ecosystem. DuPont and Ciba will pay over $1.6 million for cleanup costs, natural resource damages and restoration projects to the federal and state trustees, which include the State of Delaware, the National Oceanic and Atmospheric Administration (NOAA), and the U.S. Fish and Wildlife Service (USFWS). The agreement specifies that DuPont and Ciba will purchase an “environmental covenant,” allowing them to set aside 56 acres of private land for protection. The land is known as the Pike Property, located along the Delaware Bay, as identified in the federal and state agencies’ Damage Assessment and Restoration Plan (DARP-see notice below).

 

The consent decree is subject to a 30-day public comment period ending on November 3, 2006, and subsequent judicial approval.  The consent decree is available on the Justice Department website at: http://www.usdoj.gov/enrd/Consent_Decrees.html. NATURAL RESOURCE DAMAGE ASSESSMENT RESTORATION PLAN FOR DAMAGES AT DUPONT NEWPORT SITE

Notice Start Date: 10/4/2006 Notice End Date: 11/3/2006

DNREC; NOAA; and the USFWS; (collectively, "the Trustees") have developed a draft final DARP. The DARP is a damage assessment restoration plan that is intended to address natural resources, including ecological services that were injured, lost, or destroyed by the former operations at the DuPont Newport superfund site (Newport site) in New Castle County, Delaware.

 

The DARP describes a restoration project to be completed on a privately owned 56-acre property located in Kent and Sussex counties, which includes upland and emerging tidal lands.  The property is situated along the Mispillion River, which flows generally eastward from Milford, Delaware into Delaware Bay. A copy of the DARP is available at the Milford Public Library, or at the office of DNREC–SIRB, 391 Lukens Drive, New Castle, DE 19720.  Written comments should be submitted to Jane Biggs-Sanger at DNREC-SIRB's address above. The DARP will be finalized after the comment period closes. Penalty Assessment and Secretary’s Orders

 

The Secretary issued a Notice of Administrative Penalty Assessment and Secretary’s Order to Arlon, Inc. of Bear, Delaware on October 4 for violations of Delaware’s regulations governing the control of air pollution. The order includes a cash penalty of $90,000 and an additional $13,500 as cost recovery. The company owns and operates a manufacturing facility at 1100 Governor Lea Road in Bear that produces a range of silicone products used in the aerospace, automotive, and heating industries. During the silicone manufacturing process, various volatile organic compounds, including xylene, a hazardous air pollutant, are emitted. The company violated multiple permit emission limits in 2005 for hazardous air pollutants and volatile organic compounds. The company has 30 days to request a public hearing. The Secretary issued Order No. 2006-A-0045 on October 16, 2006, amending Regulation No. 1141 Limiting Emissions of Volatile Organic Compounds from Consumer and Commercial Products, Section 1 – Architectural and Industrial Maintenance Coatings.  The amendments specify records retention by manufacturers and revise the definition of specialty primer, and include correction of typographical errors and renumbering of the entire regulation to be consistent with the Code of Delaware Regulations. Kudos

 

Congratulations to John Cargill, who will be promoted to Environmental Scientist III within the Division’s Site Investigation and Restoration Branch at the end of October.

 

In the Division’s Solid and Hazardous Waste Management Branch, a very warm welcome back and kudos to Avery Dalton, an Environmental Scientist who just returned from military duty on October 16.  Also in the Solid and Hazardous Waste Management Branch, we are happy to welcome back Lynette Lee and wish to congratulate her on her new baby girl!

Kudos also to the Division’s Air Quality Management Section staff, which have been selected to receive the “Speed Demon” award from General Motors (GM). GM’s Boxwood Plant is awarding the “Speed Demon” on October 25 to Air Quality staff for the new Value Stream Mapping process. With a lot of hard work and effort, the staff has been using the new process over the last year, to considerably streamline air permitting. The new process reduced GM’s permit turn-around time by more than 50%! This is the first time that this award has been presented outside of General Motors.
