DNREC and NRG Finalize Agreement Imposing Deep Reductions In Major Air Emissions at Indian River Power Plant – DNREC entered into an agreement with NRG Energy Inc. in September that requires NRG to achieve significant emissions reductions at its coal-fired Indian River power plant in Millsboro. The agreement, a consent order filed in the Superior Court of Delaware in New Castle County, stipulates specific timelines for reducing nitrogen oxides, sulfur dioxide and mercury emissions through installation of both interim and long-term control technology, the use of lower sulfur containing coal, and shutdown of the oldest units at the plant.

By 2012, the consent order will achieve annual emissions reductions beyond those required by the multi-pollutant regulation by an estimated 4,302 tons per year of sulfur dioxide, an estimated 2,959 tons per year of nitrogen oxides, and an estimated 1,214 ounces per year of mercury.

Public Forums on Cost-Effective Ways to Manage Yard Waste – Beginning this month, New Castle County civic, community and homeowner organizations and individuals can get the scoop on cost-effective options available to help manage yard waste. The Division’s recycling program has teamed up with the Delaware Solid Waste Authority (DSWA) and University of Delaware Cooperative Extension to present open public forums of displays and information on collection, recycling and disposal of yard waste. Organizations interested in arranging a free public forum can contact Lynette Lee, with the Division’s recycling program, at (302) 739-9403 or Michael Parkowski at DSWA, (302) 739-5361. Upcoming Air and Waste-Related Hearings, Meetings & Events

 

October 22 – Consecutive Public Hearings on Proposed Amendments to the Delaware Regulations Governing Hazardous Waste (DRGHW) and the Delaware Regulations Governing Solid Waste (DRGSW) will be held at the DNREC Richardson and Robbins Building Auditorium, 89 Kings Highway in Dover. The first hearing, from 6:00 to 6:30 PM, is to consider adoption of proposed amendments to the Delaware Regulations Governing Hazardous Waste. The second public hearing will be held immediately following the first hearing, from 6:30 to 8:00 PM, to consider adoption of the proposed amendments to the Delaware Regulations Governing Solid Waste. November 3 – DSWA Household Hazardous Waste Collection Event at Frawley Stadium in Wilmington will be held between 8 AM and 4 PM, rain or shine. The Delaware Solid Waste Authority offers this collection event free for Delaware residents. Household Hazardous Wastes include bleach, chemistry kits, nail polish, polish removers, perfumes, disinfectants, drain cleaners, floor wax, mercury thermometers, moth balls, oven cleaner, smoke detectors, toilet cleaner, prescription medications, used syringes, paints (other than latex), small compressed-gas cylinders, solvents, stains, strippers, thinners, varnish, wood preservatives, fluorescent bulbs, fungicides, herbicides, pesticides, pool chemicals, antifreeze, auto batteries, degreasers, waste fuels (gasoline, kerosene) and used motor oil that has been mixed with other fuels (you can take unmixed oil to many of the Recycle Delaware Centers anytime). SERVICE TRANSPORT GROUP, INC. RENEWAL APPLICATION FOR SOLID WASTE TRANSFER STATION PERMIT IN NEW CASTLE

NOTICE START DATE: 09/28/2007 NOTICE END DATE: 10/15/2007

Service Transport Group, Inc. (STG) has applied for a solid waste facility permit renewal to continue operations of the solid waste transfer station at 58 Pyles Lane, in New Castle, New Castle County, Delaware. The facility will accept only asbestos contaminated materials (ACM) for consolidation and transport to an accepting disposal facility. STG's waste receiving hours will be from 7:00 AM to 5:00 PM Monday through Friday, and 7:00 AM to 12:00 PM on Saturdays. STG requests continuing to transfer no more than the currently maximum permitted 50 tons per day, and storing no more than 1,750 tons of asbestos waste. STG has 35 days upon receipt of asbestos waste at the transfer station to move all asbestos waste off-site to a disposal facility.

NOTIFICATION OF THE PUBLIC COMMENT PERIOD FOR THE BROWNFIELDS VOLUNTARY CLEANUP PROGRAM (VCP) AGREEMENT FOR THE FORMER CHRISTINA MARINA SITE IN WILMINGTON  NOTICE START DATE: 09/26/2007  NOTICE END DATE: 10/15/2007

DNREC negotiated a Brownfields VCP Agreement with the Wilmington UDAG Corporation regarding the Former Christina Marina site.  The site is located at 1126 East 7th Street in Wilmington, Delaware.  By certifying a property as a Brownfields site, DNREC encourages the cleanup and redevelopment of any vacant, abandoned or underutilized properties which may be contaminated with hazardous substances. When DNREC enters into a Brownfields VCP Agreement with the Brownfields site owner, it will require a remedy at the site in connection with the development project. The public comment period for this Brownfields VCP Agreement begins on September 26, 2007 and will close at the end of the business day (4:30 p.m.) on October 15, 2007. PROPOSED PLAN OF REMEDIAL ACTION FOR THE INTERSECTION OF ROUTE 13 AND ROUTE 154 SITE IN DOVER

NOTICE START DATE: 09/23/2007 NOTICE END DATE: 10/15/2007

The Division’s Site Investigation and Restoration Branch (SIRB) announced the Proposed Plan of Remedial Action for the Route 13 and Route 154 Site.  The site is 1.4 acres in size and is located at 154 North DuPont Highway (Route 13) in Dover.  SIRB certified the property as a Brownfields Site on June 23, 2006.  The plans for site redevelopment include the demolition of the existing site structure, re-grading, and the construction of a commercial office/retail center, asphalt parking lot area, concrete sidewalks and landscaping. Historically, the site has been used for a variety of commercial purposes, reportedly including a restaurant and a repair shop. In February 2007, Ten Bears Environmental, consultant to the site owner, conducted a Brownfields Investigation, which revealed the presence of petroleum-related contaminants in isolated soil samples. Ten Bears Environmental also removed a 550-gallon heating oil tank in July 2007 in accordance with DNREC's Tank Management Branch regulations. The tank did not leak and there was no contaminated soil associated with the tank.

FINAL PLAN OF REMEDIAL ACTION FOR THE 0 MILLER ROAD SITE IN WILMINGTON

NOTICE START DATE: 09/23/2007  NOTICE END DATE: 10/13/2007

SIRB adopted the Proposed Plan of Remedial Action as the Final Plan of Remedial Action for the 0 Miller Road Site.  The site is located on "Miller Road," a road that has not been built, but is shown on maps located between Center Street and Pyles Lane in New Castle, Delaware.  The site is a 2.3 acre parcel located in the Hamilton Park neighborhood in New Castle.  It is currently an undeveloped, wooded lot that DNREC certified as a Brownfields property.  The Crescent Foundry Company owned and operated at the site from 1902 to 1910.  The site was later filled with material containing elevated levels of metals.  Both the foundry operation and the filling activities likely caused elevated levels of metals in soil, including arsenic above the Delaware Default Background Standard of 11 parts per million (ppm).

TITLE V PERMIT RENEWAL AND POTENTIAL TO EMIT (PTE) PERMIT APPLICATIONS FOR CIBA SPECIALTY CHEMICALS CORPORATION IN NEWPORT

Notice is hereby given that Ciba Specialty Chemicals Corporation has submitted a request to construct a new pigment finishing facility called Building Blocks at their 205 South James Street, Newport, Delaware, facility.  The Building Blocks Project will consist of a new scrubber, spin flash-dryer, and associated equipment and has the potential to emit (PTE) 20.3 tons per year (TPY) volatile organic compounds (VOCs), 0.69 TPY nitrogen oxides (NOx), 0.58 TPY carbon monoxide (CO), and 0.05 TPY particulate matter.  By permit, actual emissions will not exceed 1.78 TPY VOCs, 0.69 TPY NOx, 0.58 TPY CO, and 0.05 TPY particulate matter.

 

In addition, the company is taking federally enforceable limits to stay below the applicability threshold of Regulation No. 1125 for Permit: APC-2007/0122-CONSTRUCTION (PTE) for their new Metasheen release coating and metallizer process.  This process has the potential to emit 41 TPY VOC.  Emissions will be limited to 15 TPY VOC.  Ciba Specialty Chemicals, Inc. will be required to route emissions from these processes to a control devices consisting of a scrubber and thermal oxidizer.  These requirements are necessary to limit Ciba Specialty Chemicals, Inc.'s potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state.

TITLE V PERMIT RENEWAL APPLICATIONS

Notice has been given that the facilities listed below have applied for Title V Permit Renewal applications. The applications, the "draft" permit renewals, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy or summary of other materials, if any, considered in preparing the "draft" permit renewals may be inspected at the office of the Division of Air and Waste Management, 156 S.   • Conectiv Delmarva Generation, has submitted permit renewal applications pursuant to Regulation No. 30, Title V operating permit program for the three (3) peaking stations in New Castle County:  Christiana Peaking Station, West Substation, and Delaware City Peaking Station.  The company also requested renewing the existing nitrogen oxides (NOx) budget permits for the above referenced peaking stations so that they coincide with the renewals of the Title V operating permits.  Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC. Therefore, "draft" permits have been prepared.  The "draft" permit renewals incorporate all applications and applicable requirements for all regulated air pollutants and require the facilities to comply with the terms and conditions of the permits and be liable for all violations of the permit conditions and applicable federal and state rules.  A public hearing concerning the permitting action will NOT be held unless the Secretary of DNREC receives a request for such hearing by October 30, 2007.  For more information, please visit: http://www.dnrec.state.de.us/dnreceis/redirect.asp?ID=2563&MsgType=P.
  • Delaware State University, having a facility at 1200 N. DuPont Highway in Dover, has submitted a request for a permit renewal pursuant to Regulation No. 30, Section 7 for their operating permit.  Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC.  Therefore a "draft" permit renewal has been prepared.  This "draft" permit renewal allows for the operation of forty-one boilers, two space heaters, eleven emergency generators and nineteen No. 2 fuel oil underground storage tanks.   • Bayhealth Medical Center-Kent General Hospital, having a facility at 640 South State Street in Dover, has submitted a request for permit renewal pursuant to Regulation No. 30, Section 7 for their operating permit.  Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC.  Therefore a "draft" permit renewal has been prepared.  This "draft" permit renewal incorporates new applicable requirements for the emergency generators. TITLE V MODIFICATION APPLICATION FOR DOW REICHHOLD, SPECIALTY LATEX, LLC OF DOVER

Dow Reichhold Specialty Latex, LLC, having a facility at 144 Fork Branch Road in Dover, has requested Regulation No. 1102 and Title V permit modifications to limit potential to emit hazardous air pollutants (HAPS) below the major source thresholds.  The permit modifications are not anticipated to increase or decrease HAP emissions.

 

A public hearing concerning the permitting action will NOT be held unless the Secretary of DNREC receives a request for a hearing by October 16, 2007.  The application, the "draft" permits, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules, and a copy of summary of other materials, if any, considered in preparing the "draft" permits may be inspected at the offices of the Division of Air and Waste Management, 156 S. TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

Notice has been given that the facilities listed below have applied for Title V Synthetic Minor Permit applications. The applications may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware. To submit comments, for additional information or for an appointment to inspect the public file, please contact Joanna Austin at the Dover Office at (302) 739-9402.

  • Independence Construction Materials has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for an amendment of their permit at 440 Twin Oaks Drive in Cheswold.  Independence Construction Materials requests an increase in the allowable recycled asphalt paving material to 35%.  There will be no increase in total estimated emissions from the facility.  A public hearing on this application will NOT be held unless the Secretary of DNREC receives a request for a hearing on the specific application by October 16, 2007.  Additional information is available at: http://www.dnrec.state.de.us/dnreceis/redirect.asp?ID=2546&MsgType=P.
  • Verisign, Inc. has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for construction of six emergency generators at 21 Boulden Circle in New Castle. Verisign, Inc. requests a limit for NOx emissions at the facility wide level.  These limits are necessary to restrict Verisign, Inc. potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state.  Total estimated emissions from the facility are:

NOx :    9.30 TPY

CO:      7.18 TPY

SOx:     1.83 TPY

PM:      0.54 TPY

VOCs: 0.40 TPY

REGULATION NO. 1102 NATURAL MINOR PERMIT APPLICATION

Notice has been given that the facility listed below has applied for a Regulation 1102 Natural Minor permit. The application may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware, or 715 Grantham Lane, New Castle, Delaware.   • Voigt & Schweitzer, Inc., requested a permit to construct and operate a hot dip zinc galvanizing facility, to be referred to as V&S Galvanizing New Castle, in the River Road Industrial Park II Subdivision on Carroll Drive in New Castle.  The galvanizing process would have the potential to emit (PTE) 0.19 tons per year (TPY) of volatile organic compounds (VOCs), 17.45 TPY particulate matter, 6.15 TPY ammonium chloride, 2.50 TPY zinc oxide, 2.86 TPY carbon monoxide, 0.46 TPY zinc chloride, 1.70 TPY oxides of nitrogen (NOx), 0.02 TPY oxides of sulfur (SOx), 0.02 TPY lead and lead compounds, 0.04 TPY hydrogen chloride (HCl), 2.84 TPY zinc ammonium chloride, and 0.011 TPY ammonia.  This application was previously opened for public review, but is being re-opened due to an increased estimate of lead emissions.  Additional information is available at: http://www.dnrec.state.de.us/dnreceis/redirect.asp?ID=2564&MsgType=P.

REGULATION NO. 2 PERMIT APPLICATION

Notice has been given that the facility listed below has applied for a Regulation 2 Permit application. The application may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware, or 715 Grantham Lane, New Castle, Delaware.   • LNH, Inc. (D/B/A HostMySite.com) has submitted a construction permit application for an SD 500 Generac Emergency Generator with a rating of 500 electrical kilowatts, Volvo Engine, located at their production facility, 350 Pencader Drive in Newark.  The generator’s potential to emit emissions is as follows:

Nitrogen Oxides (NOx): 1.47 Tons Per Year (TPY)

Carbon Monoxide (CO):  0.22 TPY

Particulate Matter (PM10):  0.03 TPY

Volatile Organics Compounds (VOCs): 0.21 TPY

Sulfur Dioxide (SO2): 0.08 TPY

Violations

 

Air Quality Management issued the following Notices of Violation:

  • September 24, Dow Reichhold Specialty Latex, LLC for a 29 pound release of butadiene on July 19, 2007.  The release occurred due to failure of a flange gasket during return to service of reactor R-36.  As a result, butadiene was released into a reactor room and then to the atmosphere.
  • September 24, Camdel Metals reported seven instances where automatic software updates interfered with recording the flame ionization detector information (exhaust concentration) and where backup charts were not obtained as required by the company’s Startup, Shutdown, and Malfunction Plan in their 2007 Semi-Annual Report dated July 30, 2007.
  • September 25, Dover Air Force Base for failure to obtain a permit prior to construction of two emergency generators. On August 1, 2007, the Department discovered that a 700 KW and a 750 KW generator were installed for use at the Air Freight Terminal presently being constructed at the facility. The project contractor had not applied for a construction permit for the generators prior to setting and wiring the equipment, although the generator engine had not been operated. Upon discovery of the violation, the facility disconnected the equipment and has made arrangements for its removal from the site.
  • USEPA Region 3 conducted a Full Compliance Audit of the St. Francis Hospital on September 20. This facility has been issued a Synthetic Minor permit based on its potential to emit more than 25 tons per year of NOx. The Department accompanied the USEPA during the audit. No deviations from the permit were noted. A final inspection report will be issued by USEPA Region 3 within two months.
  • On September 19, an Amended Notice of Administrative Penalty Assessment and Secretary’s Order No. 2007-A-0040 was issued to Arlon, Inc. for violations of Delaware’s regulations governing the control of air pollution. This Amended Order supersedes Order No. 2006-A-0043 previously issued October 4, 2006 and includes a cash penalty of $45,000 and an additional $13,500 as cost recovery reimbursement to the Department for expenses associated with its investigation.  In addition, Arlon, Inc. will undertake Environmental Improvement Projects that will cost the company a minimum of $90,000.  Arlon, Inc. has 30 days to request a public hearing.

Congratulations to Tracey Wilson, who started as an Administrative Specialist I with the Division’s Site Investigation and Restoration Branch on October 1, 2007. Congratulations also to Mike Costello (10 years - Enforcement), Suzanne Halter (15 years - Tank Management Branch) and Richard Jefferson (20 years - Enforcement), who all celebrated anniversaries with the Division in October.

 

Many kudos to the Division’s Emergency Response Team (ERT) members, Jamie Bethard and Matt Higgins, and Enforcement Officers, Matt Chamberlain, Casey Fountain and Dan Wood, for performing special duties from September 20 to September 23 at the Dover International Speedway for the NASCAR races. The special duties included bomb searches, radiation detection and on-site presence in the event of any chemical or biological incidents.
