Happy Holidays! Once the holidays are over, please remember that you can give your holiday tree a new use by recycling it at a Delaware State Park. Your holiday tree will be used to make wood chips, the perfect organic material to benefit soil and plant health, and make landscape maintenance easier. DNREC’s Division of Parks and Recreation will offer its annual tree recycling program, available at seven state parks, beginning on Tuesday, December 26 through Monday, January 15, each day from 8 AM to sunset. The holiday tree recycling program also provides an outlet to help citizens in New Castle County comply with the yard waste ban effective January 1.

 

Extra wood chips will be available to the public free of charge on a first-come, first-served basis beginning after January 15 at each state park. The City of Dover (McKee Run Generating Station), NRG Energy, Inc. and Conectiv Delmarva Generation, Inc. have appealed Regulation No. 1146 - Electric Generating Unit Multi-Pollutant Regulation. The reason for the new regulation is to facilitate a reduction of air emissions from Delaware’s coal and residual oil-fired power plants and protect public health, safety, and welfare from pollutants which include nitrogen oxides, sulfur oxides, and mercury. DNREC has received an application for a Coastal Zone Act Permit from SPI Pharma located at the end of Cape Henlopen Drive in Lewes. The company is seeking this permit to install new production facilities to manufacture polyol solutions. The new products are used in the food and pharmaceutical markets. The new production machinery, which will be housed in an existing building, will have air emissions which need to be offset.  The company has submitted in its application an Offset Proposal.

 

The application is presently under review at the DNREC. The public may review this application at the Hockessin, Wilmington, Lewes and Delaware City public libraries, as well as the DNREC office at 715 Grantham Lane south of New Castle and 89 Kings Highway in Dover.  If and when this application is deemed to be preliminarily, administratively complete and ready for a public hearing, there will be a second legal notice announcing the public hearing arrangements. Valero Delaware City Refinery Update Valero initiated the startup of the fluid catalytic cracking unit’s carbon monoxide boiler and new wet gas scrubber on Sunday, December 17, 2006. This is the second of the two new scrubbers mandated by the 2001 Consent Decree for the facility. This means that the cat cracker exhaust gases are now rerouted through the carbon monoxide boiler and scrubber train. The scrubber train includes a water pre-scrubber, an amine-based regenerative scrubber, and a caustic polisher. As with the 1st wet gas scrubber for the fluid coker unit, there is a visible steam plume from the stack.

 

The 1st wet gas scrubber came online in September 2006.  Both scrubbers combined are expected to reduce sulfur dioxide emissions by 37,600 tons annually from past permitted levels. In addition, the refinery will also realize reductions of over 900 tons annually of other pollutants from all aspects of the pollution control upgrade project. December 20 – Recycling Public Advisory Council (RPAC) Meeting will be held at 1:30-3:30 PM at the Brandywine Hundred Library in northern Wilmington. Agenda items include an update on yard waste ban activities, legislative initiatives, and outreach initiatives. January 4 – Yard Waste Meeting is scheduled at 7:00 AM, Newark Morning Rotary at the Blue and Gold Room, University of Delaware Campus. DNREC’s Division of Air and Waste Management is working with the Delaware Solid Waste Authority (DSWA) to present information on the Cherry Island Landfill yard waste ban, effective January 1, and the options available for homeowners. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT (BDA) FOR THE BELL FUNERAL HOME SITE IN WILMINGTON  Start Date: 12/18/2006 Notice End Date: 01/08/2007

DNREC's Site Investigation and Restoration Branch (DNREC-SIRB) negotiated a BDA with Brandywine Village, LLC regarding the Bell Funeral Home site.  A BDA is an agreement between DNREC and a Brownfields Developer that sets forth a scope of work and schedule of remedial activities for a certified Brownfields site during the development of the site. The Bell Funeral Home site consists of 1.7 acres located between 19th Street, Market Street, Race Street and Hutton Street in Wilmington. Previous investigations revealed the presence of tetrachloroethylene (PCE) and trichloroethylene (TCE) in the groundwater beneath the site.

DNREC-SIRB negotiated a BDA with Naga Food Products, Inc. for Naga Foods site, a 0.4 acre site located at 1331 North Heald Street in Wilmington. As a result of past industrial uses as several forklift repair companies, various vehicle storage facilities and a former underground storage tank (UST) removal site, the site may be contaminated with releases of hazardous substances.

NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT (BDA) FOR THE FORMER PENINSULA PLATING FACILITY SITE IN WILMINGTON  Start Date: 12/18/2006 End Date: 01/08/2007

DNREC-SIRB) negotiated a BDA with the Putnam Group regarding the Former Peninsula Plating Facility (Blades Property).  The site consists of about 5.73 acres, located between West 5th Street and River Road in Blades, Delaware. Previous investigations of the site revealed the presence of the release of hazardous substances from prior use as a plating facility, steel products company and several other smaller commercial enterprises. From August to December 1995, the USEPA conducted an emergency response action whereby seventy-eight 55-gallon drums of hazardous wastes were removed, as well as 30 cubic yards of hazardous solids and debris.

NOTIFICATION OF NEGOTIATIONS FOR A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE HARPER THIEL SITE IN WILMINGTON  DNREC-SIRB is negotiating a Brownfields Development Agreement with the City of Wilmington to develop the Harper Thiel site located at 3201 Miller Road in Wilmington, Delaware. Previous investigations at the site revealed the release of hazardous substances, including hexavalent chromium, lead, and polychlorinated biphenyls (PCBs) from its past use as an electroplating facility and/or other industrial uses. PROPOSED PLAN OF REMEDIAL ACTION FOR THE J.G. TOWNSEND FROZEN FOODS SITE IN GEORGETOWN

DNREC’s Site Investigation and Restoration Branch announced the proposed plan of remedial action for the J.G. Townsend Frozen Food site located at 316 North Race Street in Georgetown, Delaware. The site is currently owned by SAW, Inc. and is comprised of two parcels of land separated by Pepper Street in Georgetown. The main parcel is approximately four acres in size and is referred to as the Frozen Foods site. The other parcel is referred to as the Fuel Depot site, and is approximately 0.4 acres in size. Several contaminants were detected in surface soil, subsurface soil and groundwater above the restricted (commercial) use for Delaware's Uniform Risk-Based Standards (URS).

PROPOSED PLAN OF REMEDIAL ACTION FOR THE HABITAT FOR HUMANITY SITE IN WILMINGTON

Notice Start Date: 12/10/2006 Notice End Date: 01/02/2007

The Site Investigation and Restoration Branch announced the proposed plan of remedial action  for the Habitat for Humanity site located at 1303 North Heald Street in Wilmington, Delaware. The site is currently a vacant lot located one block east of Northeast Blvd., but will be the future location of eight new townhouses. The vacant lot is a certified Brownfields site as a result of its past use as a maintenance facility and/or other industrials uses. The analytical results for the investigations at the site revealed that the fill material at the site contained elevated levels of hazardous substances including polycyclic aromatic hydrocarbons and metals such as arsenic, lead, barium and manganese.

Notice has been given that Ciba Specialty Chemicals Corporation, located at 205 South James Street, Newport, Delaware, has submitted a request for a permit renewal pursuant to Regulation No. 30, Section 7 for operating permit AQM-003/00003.  Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC.

Perdue Farms Incorporated has submitted a request for a Title V permit renewal pursuant to Regulation No. 30, Section 7 for their facility located at 20621 Savannah Road, Georgetown, Delaware. Section 7 of the State Operating Permit Program pertains to permit issuance, renewal, re-openings and revisions. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC. Therefore a "draft" permit renewal has been prepared.  The "draft" permit renewal added new regulatory requirements for diesel generators, deleted two (2) cold solvent cleaners, and revised some regulatory language.

 

A public hearing concerning the permitting action will not be held unless the Secretary of DNREC receives a request for such hearing by December 26, 2006. REGULATION 1102 NATURAL MINOR PERMIT APPLICATIONS

Notice has been given that:

1.         Johnson Controls Battery Group, Inc., requests a construction permit to modify the equipment ventilation system associated with an existing pasting line at their 700 N. Broad Street, Middletown, New Castle County facility.  The pasting line is designed to apply a lead oxide-based paste to lead plates used in the production of motor vehicle batteries.  This proposed ventilation modification would result in the reactivation of an existing, but currently unused baghouse (a type of dust control device). This modification may result in an increase in actual lead emissions of up to an estimated 10.2 pounds per year, though total allowable levels of lead emissions would not be increased. 

2.         Foltz Farms, LLC, requests a permit to construct a poultry incinerator at their 2375 W. Dennys Road, Dover, Kent County facility.  The poultry incinerator has the potential to emit (PTE) particulate of 1.95 tons per year (TPY). By Permit #APC-2007/0077, actual emissions will not exceed 0.14 TPY particulate.

3.         Design Contracting, Inc., requests a construction permit to construct an Extec C-12+ jaw crusher with an associated 350 horsepower Caterpillar C-9 diesel fired engine at their 1610 Bowers Street and 3605 Downing Drive, Wilmington, Delaware facilities. The crusher and engine have the potential to emit 8.82 tons per year of carbon monoxide (CO), 9.76 tons per year of nitrogen oxides (NOx), 0.30 tons per year of volatile organic compounds (VOCs), 3.14 tons per year of sulfur oxides (SOx), and 2.27 tons per year of particulate matter (PM).  By Permit# APC-1999/0360-Construction (Amendment 2), actual emissions will not exceed 2.09 tons per year of CO, 2.32 tons per year of NOX, 0.07 tons per year of VOCs, 0.84 tons per year of SOX, and 0.54 tons per year of PM.

4.         BCBSD, Inc. (D/B/A Blue Cross Blue Shield of DE) has submitted a construction permit application for a Caterpillar Emergency Generator located at their facility at 800 Delaware Avenue in Wilmington, DE. The facility-wide PTE for emissions is as follows:  NOx: 3.35 TPY; CO:  0.15 TPY; PM10:  0.01 TPY; VOCs: 0.02 TPY; sulfur dioxide (SO2): 0.12 TPY.

5.         Allen's Hatchery, Inc. – Allen's Milling Division, requests cancellation of their Regulation No. 30 Operating Permit: APC-005/00016(R1) due to the reduction of sulfur emissions below the 100 ton per year major source threshold.  Emission reductions are from the replacement of older equipment with new equipment including two new 20.9 million British thermal units per hour (MMBTU/hr) boilers fired with No. 6 fuel oil with a sulfur content of 0.5 percent sulfur by weight, a new 1,260 tons per hour (TPH) railcar grain unloading station, and two 70 TPH hammermills at their Route 13-A, Delmar, Sussex County, Delaware facility. 

 

A public hearing on any of the above applications will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application by December 25, 2006. Requests for Proposals

 

UNDERGROUND STORAGE TANK (UST) REMOVAL, ABANDONMENT AND OVER-EXCAVATION CONTRACT REQUEST FOR PROPOSALS  Start Date: 12/12/2006  End Date: 1/12/2006

DNREC’s Tank Management Branch (TMB) issued a Request for Proposals (RFP) to participate in a professional services contract for Underground Storage Tank (UST) Removal, Abandonment and Over-excavation (Contract 07-001-TMB). This RFP will qualify contractors to receive bid requests to remove or abandon USTs, and conduct over-excavation services, at state-lead UST sites. Technical and contract-related questions will be answered at a mandatory pre-bid meeting to be held at the DNREC office at 391 Lukens Drive in New Castle, Delaware on December 20, 2006 at 10:00 AM (EST).

 

Following the meeting, the deadline for submitting questions is December 22, 2006 at 4:00 PM (EST). DNREC’s TMB also issued a RFP to participate in a professional services contract for Hydrogeologic Investigation Services (Contract 07-002-TMB). This RFP will qualify consultants to receive bid requests to conduct hydrogeologic investigations at state-lead contaminated sites.  All technical and contract related questions will be answered at a mandatory pre-bid meeting to be held at the DNREC office at 391 Lukens Drive in New Castle, Delaware on December 20, 2006 at 1:00 PM (EST).

 

Following the meeting, the deadline for submitting questions is December 22, 2006 at 4:00 PM (EST). Sarah King, formerly with the Division’s Emergency Prevention and Response Branch, was selected for an EPA Region III Partnership Award at the 2006 Emergency Preparedness and Prevention and Hazmat Spills Conference. The Conference was held December 3-6 at the Valley Forge Convention Center, Pennsylvania. The awards are designed to recognize individuals or groups who have made outstanding effort to improve safety and preparedness in their community.  Sarah was nominated for her work with systems to collect and distribute data to support emergency planning and response organizations, as well as her efforts to maintain and update web pages for the State Emergency Response Commission and Local Emergency Planning Committees.  Sarah had been a member of the Emergency Planning and Community Right-to-know Act (EPCRA) group for 10 years. She left the group in August after accepting a teaching position.

In addition, please join us in congratulating John Parker, who was promoted to Engineer IV with the Division’s Emergency Prevention and Response Branch on December 10, and Bill Miller, who was promoted to Environmental Scientist II with the Solid and Hazardous Waste Management Branch on December 10.
