News Updates
Metachem Products LLC (aka Standard Chlorine of Delaware, Inc.) Site Update – USEPA contractors have completed the slurry wall (underground barrier to help control groundwater) interim remedy at the Metachem National Priorities List (NPL) site. The associated groundwater pump and treat system is still under construction with a projected early June completion date. The system will need to be extensively tested in order to ensure that it functions properly. The stabilization of the site is currently underway following the soil disturbance associated with the slurry wall construction. Delaware City Refinery Update – On May 9, the fluid catalytic cracker unit’s (FCCU’s) carbon monoxide boiler (COB) tripped following a tube rupture at the refinery. In accordance with refinery procedures and the current operating permit, operators rerouted the FCCU off-gases through a bypass stack, which bypassed the boiler and the wet gas scrubber. As required by their operating permit, Premcor initiated operational changes to achieve complete combustion in the regenerator (by a process known as promoted burn) in the regenerator within 24 hours. Higher opacity from the bypass stack was observed. During the first 24 hours, the refinery’s operating permit exempts the facility from particulate, carbon monoxide and opacity limits. Premcor reduced the unit rate and, according to the turndown factor documents previously submitted to the Department, reduced throughput below 55 thousand barrels per day (MBPD). Following repairs, the FCCU’s COB and wet gas scrubber were placed back on-line on May 18. An incident report, including emissions data, will be submitted to DNREC within 30 days for review, in accordance with standard Departmental policy for non-compliance and possible enforcement action. DNREC's Site Investigation and Restoration Branch (DNREC-SIRB) negotiated a BDA with Meyer and Meyer, Inc. for the Northwest Rose Bowl Road/North DuPont Highway property located at 154 N. DuPont Highway in Dover. The site is currently owned by T. Das Sons, Inc., and hazardous substances may have been released at the site.
DNREC invites written public comments on this BDA. The public comment period began on May 16, 2007 and will close at 4:30 PM on June 4, 2007. PROPOSED AMENDMENT TO SUBPARTS T AND RRR OF REGULATION NO. 38, EMISSION STANDARDS FOR HAZARDOUS AIR POLLUTANTS FOR SOURCE CATEGORIES Notice Start Date: 05/13/2007 Notice End Date: 06/21/2007
The purpose of the amendment to Subparts T and RRR of Regulation No. 38, is to permanently exempt the smaller area sources from Title V permitting requirements in Regulation No. 30. This is consistent with a recent federal change. Though exempted from the Title V permits, all of these type of sources are still required to have a state air permit issued under Regulation No. 1102, Permits. In addition, Subparts T and RRR of Regulation No. 38 will be converted from an "adoption by reference" format to providing the complete regulatory text and will be renumbered consistent with the Delaware Administrative Code format.
The public hearing on this proposed amendment to Regulation No. 38 will be held Thursday, June 21, 2007, beginning at 6:00 PM in the DNREC Auditorium, 89 Kings Highway, in Dover. Interested parties may submit comments in writing on this proposed amendment prior to the public hearing and/or comments may be presented either orally or in writing at the public hearing. SYNTHETIC MINOR PERMIT MODIFICATION APPLICATIONS

The following companies submitted Title V Synthetic Minor Permit Modification Applications:
- Perdue AgriRecycle, LLC has submitted an application, pursuant to Delaware Air Regulation No. 1102, Section 2.1, 11.2(i), and 12.3, for the amendment of the existing permit at the Perdue AgriRecycle, LLC facility in Blades, Delaware. Perdue AgriRecycle, LLC requests that Air Quality Management amend the above referenced permit to allow for the replacement of the existing rotary dryer control devices consisting of a core separator and thermal oxidizer with existing wet scrubbers. - The Buccini/Pollin Group, Inc. has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for a Construction/Operation permit at the I. M. Pei Building, 1105 North Market Street, Wilmington, Delaware. The Buccini/Pollin Group, Inc. requests a limit for two boilers with a rated heat input of 12.5 million BTU per hour. These limits are necessary to restrict the boilers' potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility are 4.4 tons of sulfur per year, 0.58 tons of nitrogen oxides (NOX) per year, and 0.20 tons of particulate matter per year. TITLE V RENEWAL AND PERMIT MODIFICATION APPLICATIONS

Notice is hereby given that:
- The Department of Corrections Center-Smyrna, located at Paddock Road, Smyrna Delaware, requested a Title V Permit Renewal under Regulation No. 30, Section 7(c) for an operating permit. The permit renewal will not change the emissions at the facility. The "draft" permit renewal incorporates three (3) new printers and replaces two generators listed as insignificant, with two smaller generators. - The Delaware Solid Waste Authority facility at 1107 Willow Grove Road, Felton, Delaware, has submitted a request for a Title V significant permit modification under Regulation No. 30, Section 7 for their operating permit. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC. Therefore a "draft" significant permit modification has been prepared. This "draft" significant permit modification increases the allowable flow rate to the flare and incorporates the following facility wide emission caps; 30.5 tons per year (TPY) of NOx, 239.2 TPY of CO, 11.1 TPY of non-methane organic compounds, 14.0 TPY of sulfur oxides (SOx), and 8.7 TPY of hazardous air pollutants (HAPs). TITLE V PLANTWIDE APPLICABILITY LIMIT (PAL) PERMIT APPLICATION FOR DUPONT EXPERIMENTAL STATION IN WILMINGTON

The DuPont Experimental Station in Wilmington has submitted an application, under Regulation No. 2, Section 2.1, for permit amendment to include Boiler # 6 operation. The DuPont Experimental Station also requests a limit for NOx, Sulfur Dioxides (SOx), VOCs, PM10, and Particulate Matter–Fines (PM2.5 ) emissions for the PAL. These limits are taken voluntarily to restrict DuPont Experimental Station's potential to emit (PTE) air pollutants, and the limit will be enforceable by the USEPA and the state. The limits for different pollutants are based on annual actual emissions of air pollutants over the last ten years period. The PAL will give DuPont Experimental Station operational flexibilities under Regulation No.25.Total estimated emissions from the facility are as follows:

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS

The following companies submitted Title V Synthetic Minor Applications:
- Bracebridge Corporation/Bank of America – Deerfield Complex submitted an application for the construction of a diesel fired emergency generator at 655 Paper Mill Road, Newark, Delaware. Bracebridge Corporation/Bank of America – Deerfield Complex requested the following limits under Regulation No. 1102, Section 2.1: nitrogen oxides (NOX) – 0.06 tons per year, carbon monoxide (CO) – 0.05 tons per year, sulfur dioxide (SO2) – 0.02 tons per year, particulate matter (PM) – 0.003 tons per year, and volatile organic compounds (VOCs) – 0.06 tons per year. These limits are necessary to restrict Bracebridge Corporation/Bank of America – Deerfield Complex’s potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility are 22 tons per year of NOx, 21 tons per year of CO, 2.04 tons per year of SO2, 1.25 tons per year of PM, and 4.0 tons per year of VOCs. - Medal/Alatus (Air Liquide) submitted an application under Regulation No. 1102, Section 2.1, to tie some of their operations that currently vent to the atmosphere into the thermal oxidizer and to add a backup vacuum pump to their isooctane post treatment operation at 305 Water Street, Newport, Delaware. Medal/Alatus (Air Liquide) requested limits for: hexane at 2.28 tons per year, methanol at 0.60 tons per year, isooctane at 0.64 tons per year, total volatile organic compounds (VOCs) at 19.45 tons per year, and total hazardous air pollutants (HAPs) at 8.5 tons per year. These limits are necessary to restrict Medal/Alatus’ (Air Liquide's) potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility are less than 2.28 tons per year of hexane, 0.60 tons per year of methanol, 0.64 tons per year of isooctane, 19.45 tons per year of VOCs, 8.5 tons per year of hazardous air pollutants (HAPs). The following two companies have requested applications:
- Mil-Del Corporation requests a permit amendment for its garage door production operation to update and clarify that it is a minor source of VOC emissions at its 700 McColley Street, Milford, Sussex County facility. VOC emissions remain unchanged at 8.2 TPY.
- Stonetech requests an amendment to their 400 tons per hour impact crusher and powered screening deck permit to add a new operating location at 1262 Horsepond Road, Dover, Kent County, to perform crushing operations for the Pennsy Supply, Inc., dba Tilcon Delaware facility per Regulation No. 1102, Section 12.2. No increase in emissions or permitted emission limits will result.
A public hearing on any of the above applications will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application by June 4, 2007. REGULATION 1102 NATURAL MINOR PERMIT APPLICATION FOR MILFORD GRAIN COMPANY, INC. IN MILFORD

Milford Grain Company, Inc. requested permit amendments for its grain receiving and shipping operations at their 6789 Shawnee Road, Milford, Sussex County facility. Emissions will be reduced from 3.1 tons per year (TPY) to 2.12 TPY. Actual emissions will not exceed respectively 0.7 TPY and 1.42 TPY of particulate matter less than 10 microns in size (PM10).

Many thanks to Robert Asreen, Karissa Hendershot, Robert Newsome, Matt Higgins and Bruce Cole of the Division of Air and Waste Management, Doug Rambo of the Division Water Resources, and Ed Hallock and Dr. Jerry Llewellyn of the Division of Public Health for providing their specific programmatic information on Camdel Metals and Camden’s public water wells. The information was presented to the Mayor and Town Council members, as well as citizens attending the Town of Camden Council meeting on Monday, May 7. The information helped address concerns raised by town residents about releases reported by Camdel Metals in their 2005 Toxics Release Inventory (TRI) report and the potential for impact to their drinking water supply. A special thanks also to John Parker, the Division of Air and Waste Management’s TRI coordinator, for his presentation on the TRI program at the meeting. His explanation helped the town understand the TRI program and the data reported.
