News Updates

 

DNREC has Identified the Likely Source of the Millsboro Public Well Trichloroethylene (TCE) Groundwater Contamination – The probable source area is currently a vacant lot located along West DuPont Highway in Millsboro. The empty lot was previously occupied by several poultry vaccine laboratories. TCE may have been formerly used at the site as a heat transfer medium within a closed refrigeration system used for freeze-drying poultry vaccines. Millsboro’s water supply wells are located approximately a third of a mile away.

 

DNREC identified the suspected source based on the results of a comprehensive groundwater investigation in the area. The investigation identified very high screening concentrations of TCE present in the uppermost portion of the underlying aquifer, and residual contamination remaining in an underground piping system at the site.  DNREC will conduct additional investigation in the source area to delineate the extent of groundwater contamination and develop remedial options for cleanup of the groundwater.  The drinking water for Millsboro remains safe to drink after treatment. June 20 – Recycling Public Advisory Council (RPAC) will meet from 10:00 to 11:30 AM on Tuesday at the Kent County Administration Complex at 555 Bay Road in Dover. June 21 – Regulation 1142 Committee will meet from 10:00 AM to 12:00 PM at the DNREC field office located at 715 Grantham Lane, New Castle, Delaware, 19720. DNREC is considering revising Delaware Regulation 1142 (Specific Emission Control Requirements), by adding Section 2, to require new and/or additional controls on industrial boilers and process heaters with heat input capacity equal to or greater than 200 mmBTU/hour at petroleum refining facilities in Delaware. This is part of DNREC’s overall efforts to reduce volatile organic compound (VOC) and nitrogen oxides (NOx) emissions in Delaware and attain the 8-hour ozone standard. A review committee has been organized to include all stakeholders and to aid in developing Regulation 1142, Section 2. June 28 – Public Hearing to Consider Adoption of Proposed Amendments to the Delaware Regulations Governing Hazardous Waste (DRGHW) will be held from 6:00 PM to 8:00 PM at DNREC’s Richardson and Robbins Building Auditorium, 89 Kings Highway, Dover, Delaware, 19901.  The hearing is being held to consider adoption of proposed amendments to the DRGHW. The State of Delaware is authorized by the U.S. Environmental Protection Agency (EPA) to administer its own hazardous waste management program. In order for Delaware to maintain its program delegation and authority, EPA requires Delaware maintain a program that is equivalent and no less stringent than the federal program. Many of the changes DNREC is proposing to make are already in effect at the federal level. July 11 – Public Hearing on the Solid Waste Transfer Station Permit Renewal Application filed by Pine Tree Corners Transfer Station, Delaware Solid Waste Authority (DSWA) at 276 Pine Tree Road, Townsend, Delaware. The public hearing will be held beginning at 6:00 PM at the Townsend Fire Company, Inc.’s meeting hall located at 107 Main Street, Townsend, Delaware. NEGOTIATIONS ON BROWNFIELDS VOLUNTARY CLEANUP PROGRAM AGREEMENT FOR THE CHRISTINA CRESCENT SITE AND THE NORTHERN PATHWAYS SITE IN WILMINGTON – DNREC issued a public notice on June 7, 2006 announcing the negotiations for a Brownfields Voluntary Cleanup Program (VCP) Agreement between DNREC and the Delaware Department of Transportation (DelDOT) and Pettinaro for the redevelopment of the Christina Crescent site, formerly known as the West Street Project, and incorporating sites formerly referred to as the Boulevard site and Berger Brothers site. The Boulevard site is approximately 2.88 acres in size and is located at 100 South Justison Street in Wilmington. The adjacent property, located at 101 South West Street, is the former Berger Brothers site.

 

The development plan for the Christina Crescent calls for joint redevelopment with the adjoining Berger Brothers property. The development plan includes construction of an office building and a parking garage. The combined properties encompass an area of approximately 5.90 acres.   Investigations revealed that the soil at the site has been contaminated with arsenic and benzo(a) pyrene. The shallow groundwater at the site is contaminated with trichloroethylene and vinyl chloride. Benzene, toluene, ethyl benzene and naphthalene were detected in the deeper groundwater.  The groundwater contamination was determined not to have impacted the Christina River. 

 

Concurrently, DNREC negotiated a Brownfields VCP Agreement with DelDOT for the redevelopment of the Northern Pathway site. This site encompasses 0.22 acres and is southeasterly of the right-of-way line of the former Philadelphia and Reading Railroad Company and otherwise identified as "Parcel 5" in a land survey conducted by Rummel, Klepper & Kahl, LLP, dated March 1, 2006.  The currently vacant site is north of the Christina Crescent Redevelopment project. This site may be contaminated by arsenic, lead and polycyclic aromatic hydrocarbons (PAHs) from its former use as a railroad tracks/right-of-way. This site is intended to be developed for commercial development as a public pathway and fire lane for the Christina Crescent redevelopment. NEGOTIATIONS ON VOLUNTARY CLEANUP PROGRAM AGREEMENT FOR CHESTNUT HILL PLAZA SITE IN NEWARK – DNREC issued a public notice on June 14, 2006 announcing the negotiations for a Voluntary Cleanup Program (VCP) Agreement between DNREC and the Chestnut Hill Plaza Holding Corporation for the Chestnut Hill Plaza site. The site is located at 19 Chestnut Hill Plaza, Newark, Delaware and encompasses approximately 15.4 acres. NEGOTIATIONS FOR A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE NVF SITE IN WILMINGTON DNREC issued a public notice on June 18, 2006 announcing negotiations for a Brownfields Development Agreement (BDA) between DNREC and Reybold Venture Group XXVI, LLC for the National Vulcanized Fiber (NVF) site located at 700 Maryland Avenue in Wilmington, Delaware. The site is currently owned by NVF Company and may be impacted with hazardous substances at concentrations above DNREC's Uniform Risk-Based Standards (URS) for restricted (commercial use) and/or unrestricted (residential use) as a result of its past use. PROPOSED PLAN OF REMEDIAL ACTION FOR THE ION POWER SITE IN NEW CASTLE COUNTY – Notice Start Date: 06/07/2006 Notice End Date: 06/27/2006

DNREC issued a public notice on June 7, 2006 announcing the proposed plan of remedial action for the Ion Power site. The site is located at 720-750 Governor Lea Road in New Castle County, Delaware. The site is approximately 18.5 acres in size, and was used for agricultural land until the 1980s when Standard Chlorine, and later Metachem Products, LLC, used the site as a parking facility, a "change house" and administrative offices.  The final remedial investigation report, dated December 27, 2005, did not reveal any contaminants of concern above DNREC's Uniform Risk Based Standards (URS) values for restricted (commercial) use in surface soils or sediments.  However, elevated concentrations of manganese and a volatile organic compound (VOC), tetrachloroethylene (PCE), were identified in the groundwater samples collected at the site.  

 

The proposed plan for the site may be reviewed at the Bear Library, or at the office of DNREC–SIRB, 391 Lukens Drive, New Castle, DE 19720. A copy of the proposed plan is also posted on DNREC-SIRB's website at http://www.dnrec.state.de.us/DNREC2000/Brownfields.asp under the subject "Announcements."  DNREC invites verbal and written comments on this proposed plan until June 27, 2006.  A public hearing will not be held unless a meritorious request is received by DNREC on or before June 27, 2006. PROPOSED PLAN OF REMEDIAL ACTION FOR THE NORTHERN PATHWAY SITE IN WILMINGTON – Notice Start Date: 06/11/2006 Notice End Date: 07/03/2006

DNREC issued a public notice on June 11, 2006 announcing the proposed plan of remedial action for the Northern Pathway site along the Christina Riverfront section in Wilmington. The site is approximately 0.22 acres in size and is located southeasterly of the right-of-way line of the former Philadelphia and Reading Railroad Company. The Christina Crescent redevelopment project borders the site to the south, and Justison Street borders the site to the west.  The proposed future use of the site is for a public pathway and as a fire access road in support of the Christina Crescent redevelopment project.

 

Several contaminants were detected in soil above Delaware's Uniform Risk-Based Standard (URS) values for restricted (commercial) use including arsenic, lead, and benzo(a)pyrene. The groundwater at Christina Crescent is also contaminated with volatile organic compounds (VOCs).  The proposed plan is available at the Wilmington Library or at the office of DNREC–SIRB, 391 Lukens Drive, New Castle, DE 19720.  The proposed plan is also posted on DNREC's website at http://sirb.awm.dnrec.state.de.us under the subject "Announcements."  DNREC invites written and verbal comments on the plan.  The public comment period begins on June 12, 2006 and will close on July 3, 2006.  A public hearing will not be held unless a meritorious request is received by DNREC on or before July 3, 2006. HIRSH INDUSTRIES SUBMITS TITLE V PERMIT RENEWAL APPLICATION FOR MCKEE ROAD FACILITY IN DOVER – Notice Start Date: 06/11/2006 Notice End Date: 07/11/2006  Hirsh Industries, located at 1525 McKee Road, Dover, Delaware, has submitted a request for permit renewal pursuant to Regulation No. 30, Section 7 for operating permit: AQM-001/00067 (R 1).  Based on the data and certifications contained in the application, DNREC’s Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the US Environmental Protection Agency (EPA) and DNREC.  Therefore a "draft" permit renewal has been prepared. The "draft" permit renewal incorporates the requirements of 40 CFR Part 63, Subpart RRRR for surface coating of metal furniture.

 

The application, the "draft" permit renewal, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the "draft" permit renewal may be inspected at the offices of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware and 715 Grantham Lane, New Castle, Delaware.  A public hearing concerning the permitting action will not be held unless the Secretary of the DNREC receives a request for such hearing within thirty (30) days from the date of this notice, ending July 11, 2006.  A request for a hearing shall be in writing and must show a familiarity with the application and a reasoned statement of the permit renewal's probable impact. DNREC Secretary’s Orders

 

DNREC Issues Notice of Conciliation and Secretary’s Order to Free-Flow Packaging International, Inc. (FPI) for violation of Delaware’s regulations governing the control of air pollution at the FPI facility in Newark. The Order requires FPI to install and operate a continuous emission monitoring system on or before December 31, 2006.  FPI owns and operates the facility in Newark which manufactures polystyrene packing pellets from recycled polystyrene. The process includes injecting the polystyrene with blowing agent (isopentane and isobutene) for expansion into packing “peanuts.”  The evaporation of these agents produces volatile organic compounds (VOCs) which are emitted throughout the process.

 

A May 29, 2003 stack test showed emissions were reduced by 24.5 percent rather than the 62.2 percent required under FPI’s permit. That October, FPI received a Notice of Violation from DNREC. Then a March 11, 2004 stack test showed different results that indicated the facility was meeting permit requirements. The different results from the stack tests indicate that continuous monitoring compliance would likely yield the most accurate results. Therefore, the Secretary issued the Order to install and operate a continuous emissions monitoring system in lieu of a fine. FPI may be subject to additional enforcement action, including penalties, if the system is not installed in accordance with the Order. DNREC Issues an Amended Administrative Penalty and Secretary’s Order to Hanover Foods Corporation near Clayton on May 17, 2006 for failure to comply with the air quality permit requirement to maintain records conducted visible emissions test for boilers in 2003 and failure to conduct the visible emissions tests for an adequate length of time in 2004.  The penalty assessed is $7,500 plus an additional $1,383.21 in cost recovery.
