News Updates
OZONE UPDATE – The first ozone exceedance of the 2006 season occurred on May 30th. The 8-hour ozone standard of 0.08 parts per million (ppm) was exceeded at the following air quality monitoring sites in the state: Brandywine - 0.093 ppm; Summit (Lums Pond) - 0.095 ppm; Felton (Killens Pond) - 0.086 ppm; and Lewes - 0.085 ppm. There were no exceedances of the 1-hour standard of 0.12 ppm. For additional information on ozone and what you can do to make a difference, please visit: /Info/Ozone.htm.
SUMMERTIME OPEN BURNING RESTRICTIONS BEGAN ON JUNE 1 – Open burning restrictions in New Castle and Kent counties will be in effect from Thursday, June 1st to Thursday, August 31st, with open burning restricted to small fires for food preparation, ceremonial and recreational purposes. In advance of a regulatory change to include Sussex County in the summertime burn ban, DNREC is asking Sussex residents to refrain from burning brush this summer. DNREC is also considering the extension of the burning restrictions from May 1st to September 30th, adding one month at the beginning of the season and one month on the end of the season. To report illegal open-burning, call the 24-hour hotline at 800-662-8802.

Alternatives to open burning include recycling, taking non-recyclable trash to a licensed landfill for disposal and composting. It is easy to compost leaves, yard trimmings and certain food scraps. When properly composted, these wastes can be turned into natural soil additives for use on lawns and gardens, and for potting soil for house plants. June 5 – Yard Waste Composting Guidance and Standards Committee will meet from 1 to 3 PM on Monday in the Delaware Solid Waste Authority (DSWA) Conference Room, 1128 South Bradford Street, Dover, Delaware, 19901. The purpose of this meeting is to finalize the draft Guidelines for Yard Waste Composting Facilities and to develop composting standards as recommended by the Yard Waste Management Committee. June 13 – Community Involvement Advisory Council (CIAC) will meet from 9:30 to 11:30 AM at the Smyrna Rest Stop Conference Room, Route 13, Smyrna, Delaware. The agenda will include information on the Community Environmental Project Fund (CEPF). June 21 – Regulation 1142 Committee will meet from 10:00 AM to 12:00 PM at the DNREC field office located at 715 Grantham Lane, New Castle, Delaware, 19720. DNREC is considering revising Delaware Regulation 1142, by adding Section 2, to require new and/or additional controls on industrial boilers and process heaters with heat input capacity equal to or greater than 200 mmBTU/hour at petroleum refining facilities in Delaware. This is part of DNREC’s overall efforts to reduce volatile organic compound (VOC) and nitrogen oxides (NOx) emissions in Delaware and attain the 8-hour ozone standard. A review committee has been organized to include all stakeholders and to aid in developing Regulation 1142, Section 2. June 28 – Public Hearing to Consider Adoption of Proposed Amendments to the Delaware Regulations Governing Hazardous Waste (DRGHW) will be held from 6:00 PM to 8:00 PM at DNREC’s Richardson and Robbins Building Auditorium, 89 Kings Highway, Dover, Delaware, 19901. The hearing is being held to consider adoption of proposed amendments to the DRGHW. The State of Delaware is authorized by the U.S. Environmental Protection Agency (EPA) to administer its own hazardous waste management program. In order for Delaware to maintain its program delegation and authority, EPA requires Delaware maintain a program that is equivalent and no less stringent than the federal program. Many of the changes DNREC is proposing to make are already in effect at the federal level. PINE TREE CORNERS TRANSFER STATION, DELAWARE SOLID WASTE AUTHORITY (DSWA) APPLICATION FOR SOLID WASTE TRANSFER STATION PERMIT RENEWAL

DNREC provided public notice of the Pine Tree Corners Transfer Station (PTCTS) application for a permit renewal to continue operating a solid waste transfer station at 276 Pine Tree Rd, in Townsend, New Castle County, Delaware. PTCTS’s current permit expires on June 29, 2006. The facility accepts and consolidates in-state waste and transports it to acceptable recycling and/or disposal facilities. The facility’s waste receiving hours are from 7:00 AM to 5:00 PM, Monday thru Saturday. It has a current tonnage limit of 350 tons daily average during any business week and 550 tons daily maximum. DSWA requests a permit renewal for PTCTS for a term of ten (10) years with an increase tonnage to 1,100 daily maximum.
A public hearing on the above permit application will NOT be held unless the Secretary of DNREC, in care of Ting Guo, receives a meritorious request for a hearing by June 5, 2006. COKER CONCRETE REQUESTS AMENDMENT TO REGULATION 1102 PERMIT APPLICATION TO ADD NEW LOCATION IN CHESWOLD

Coker Concrete requests an amendment to their 330-TPH impact crusher, 330-TPH jaw crusher and powered screening deck permit to add a new operating location in accordance with Regulation No. 1102, Section 12.2. The new location will be at the Atlantic Concrete Company, at the intersection of Holly Oak Lane and Twin Oaks Drive in Cheswold, Kent County, Delaware. No increase in emissions or permitted emission limits will result. A public hearing on the application will NOT be held unless the Secretary of DNREC receives a request for that application by June 12, 2006. PROPOSED PLAN OF REMEDIAL ACTION ADOPTED AS FINAL PLAN FOR THE 101 BEECH STREET SITE Notice Start Date: 05/24/2006 Notice End Date: 06/13/2006
DNREC has provided public notice of the adoption of the proposed plan of remedial action as the final plan of remedial action for the 101 Beech Street site, located in Wilmington, Delaware. The site is approximately 13.7 acres, and is located between Beech Street and Maryland Avenue. The site was the location of the DuPont Engineering Services Division who used the site as an engineering laboratory since 1917. DelDOT plans to purchase the site and utilize a portion as office space for the Delaware Transit Corporation. DNREC held a public workshop to present the remedial actions which DNREC recommended in the proposed plan on Monday, May 1, 2006 at the Chase Center on the Riverfront. DNREC invited verbal and written comments on the proposed plan. The public comment period began on April 12, 2006 and originally ended on May 1, 2006, however, DNREC extended the comment period through May 10, 2006. DNREC received one comment to the proposed plan on April 25, 2006. DNREC reviewed the comment and responded that the comment did not affect the remedy in the proposed plan. The public may appeal this final plan by June 13, 2006. DNREC has provided public notice of the Central Solid Waste Management Center (CSWMC) application for a major permit modification to construct a leachate treatment system utilizing constructed wetlands and a landfill phyto-cap for Area A/B at 1107 Willow Grove Rd, in Felton, Delaware, near Sandtown, Delaware. A public hearing on the above permit application will NOT be held unless the Secretary of DNREC, in care of Ting Guo, receives a meritorious request for a hearing by June 14, 2006. NOTIFICATION OF SIGNED SECRETARY’S ORDER AMENDING REGULATION 1102, EFFECTIVE JUNE 11, 2006 – DNREC Secretary John Hughes has signed Secretary's Order No. 2006-A-0022 amending Regulation 1102-PERMITS, of the State of Delaware "Regulations Governing the Control of Air Pollution.” The amendments are: 1) minor revisions to ensure that the regulatory language is clear that all Regulation No. 1102 permits are federally enforceable, regardless of whether they are intended to limit Potential to Emit, and 2) Renumbering the regulation to be consistent with the style manual of the Code of Delaware Regulations. CHRISTINA PARK AND JOE WHITE MEMORIAL BALLFIELD REMEDIAL ACTION IN WILMINGTON – Competitive sealed bids for the Christina Park and Joe White Memorial Ballfield Remedial Action will be received by the State of Delaware, DNREC, Division of Air and Waste Management, Site Investigation and Restoration Branch, c/o Tetra Tech, 56 W. Main Street, Suite 400, Christiana, Delaware, 19702 until 2:00 PM local time on June 21, 2006, at which time they will be opened and read aloud. The two parks are located in Wilmington, Delaware. Christina Park is located south of the intersection of Church and 4th Streets. Joe White Memorial Ballfield is located at the intersection of Northeast Boulevard and Vandever Avenue.
The work requires that the contractor provide all labor, materials, equipment and supervision necessary for demolition of select ballfield equipment, placement of a one-foot thick protective barrier across the park sites, and ballfield reconstruction. A MANDATORY pre-bid meeting will be held on June 6, 2006 at the Christina Park Site in the vicinity of the ballfield diamond, at 10:00 AM local time, for the purpose of establishing the listing of subcontractors, reviewing selected project requirements and to answer questions. PAY FOR PERFORMANCE (PFP) TYPE ENVIRONMENTAL REMEDIATION CONTRACT REQUEST FOR QUALIFICATIONS – DNREC’s Tank Management Branch (TMB) is issuing a Request for Qualifications (RFQ) to participate in a Pay for Performance (PFP) Type Environmental Remediation Contract. This PFP RFQ will qualify consultants to receive bid requests to remediate state-lead contaminated sites. The Pay for Performance Type Environmental Remediation Contract, including a flow chart of the entire process, may be obtained by contacting, or visiting, the DNREC-TMB office, or, may be downloaded from the Division of Air and Waste's webpage at: /. New Faces/New Places
Congratulations to Ann Koval for her new position in DNREC’s Office of the Secretary at the Richardson and Robbins Building in Dover. As of June 12th, Ann will be the friendly voice and face of DNREC “downstate” in the Department’s front office. We wish Ann well and are most appreciative of her outstanding service and way-beyond-the-call-of-duty efforts “upstate,” with the Site Investigation and Restoration Branch in New Castle.
Congratulations also to Jennifer Roushey, who will be returning to DNREC’s Tank Management Branch, as a Program Manager I on June 26th. We are looking forward to having her back as a new manager in Tanks!
We are sorry to announce that Rachel Colella and Janet Manchester of the Solid and Hazardous Waste Management Branch are no longer with the Department. Rachel accepted a new position in Boston, and Janet has retired. We wish both of them well in their new endeavors!
