Code Orange Ozone Alert Forecast Today and Tomorrow, July 17 and July 18The hottest day of the summer so far is forecast for today with maximum temperatures reaching near 100 degrees Fahrenheit. Ozone concentrations will rise well into the Code Orange range due to a combination of clear skies and limited vertical mixing. With winds from the west, the highest concentrations will be found during the afternoon hours east of the I-95 Corridor. Humidity will rise during the day, but fine particulate matter is low region wide. Tomorrow will not be as hot, but it will be more humid with continued poor air quality. Ozone may well reach the Code Red range for the first time this summer. High levels of ozone irritate lung passages and can cause serious health problems for many people, especially children, seniors, and people with respiratory ailments. Particle pollution, another significant air pollutant in the region, consists of dust, metals, toxins and liquids and can be breathed deep into the lungs where they cause wheezing, coughing, and difficulty breathing, aggravating respiratory aliments such as bronchitis and asthma.  DNREC’s web site includes a color-coded rating chart that describes the level of ozone in the air: www.dnrec.delaware.gov. Air Quality Partnership Hosts Blue Rocks Giveaway Tomorrow to Promote Ozone/Air Quality AwarenessDNREC will be part of the region’s Air Quality Partnership effort to educate Delawareans about the hazards of ozone and particulate matter at the Wilmington Blue Rocks baseball game at Frawley Stadium in Wilmington tomorrow night, July 18. DNREC’s Air Quality Management Section, along with other members of the partnership, will host a table with air quality information and provide free soft-sided lunchboxes to people who visit the exhibit. The Air Quality Partnership table will be located on the stadium’s concourse area beginning at 7:00 PM. Gates open at 5:45 PM. Deadline for Proposals Extended to July 28 for Funding Regarding Waste Reduction ProgramsDelaware-based businesses and non-governmental organizations are encouraged to apply for funding from DNREC’s Pollution Prevention Program. This one-time grant offering is designed to promote or incorporate pollution prevention (P2) strategies and/or solutions that will best reduce or eliminate generated wastes released to the air, land or water.

 

Applications will be accepted from any Delaware-based business or non-governmental organization, such as business sector associations, homeowner associations, academia and/or non-profit assistance providers. Award recipients will be notified by August 18. July 17 – Multi-Pollutant Committee will meet from 12:30 to 3:30 PM in DNREC’s Auditorium

July 18 – Yard Waste Composting Guidance and Standards Committee will meet from 10 AM to noon on Tuesday in the conference room at Smyrna Rest Stop. The group has been formed to finalize the draft Guidelines for Yard Waste Composting Facilities. The agenda for the meeting includes discussion on: grandfathering existing municipal compost operations; exemptions for landscapers managing small quantities of yard waste; finalizing draft guidelines for yard waste composting; and commenting on draft approval document handed out at the June 5 meeting. July 19 – Early Compliance and Detection Incentive (ECDI) Meeting will be held from 9:30 to 12 noon at the DNREC field office located at 391 Lukens Drive in New Castle, Delaware. July 19 – Regulation 1142 Committee will meet from 10:00 AM to 12:00 PM at the DNREC field office located at 715 Grantham Lane, New Castle, Delaware, 19720. DNREC is considering revising Delaware Regulation 1142 (Specific Emission Control Requirements), by adding Section 2, to require new and/or additional controls on industrial boilers and process heaters with heat input capacity equal to or greater than 200 mmBTU/hour at petroleum refining facilities in Delaware. This is part of DNREC’s overall efforts to reduce volatile organic compound (VOC) and nitrogen oxides (NOx) emissions in Delaware and attain the 8-hour ozone standard. July 21 – Brownfields Advisory Committee will meet from 9:00 AM to 12:30 PM at the DNREC field office located at 391 Lukens Drive in New Castle, Delaware. August 1 – Public Hearing for Delaware Reasonably Available Control Technology (RACT) State Implementation Plan will be held from 6:00 to 9:00 PM at the Priscilla Building Conference Room, 156 South State Street, Dover, Delaware. DNREC has developed a draft RACT State Implementation Plan (SIP) revision that demonstrates: (1) it has implemented required RACT controls on all relevant stationary sources of VOC and NOx emissions, with one potential exception, in Delaware; (2) all those RACT controls have been approved by the EPA under the 1-hour ozone National Ambient Air Quality Standards (NAAQS); and (3) all those RACT controls have been certified, based on the EPA’s guidance and standards, to represent RACT control levels under the new 8-hour ozone NAAQS.  The proposed SIP revision may be inspected at the Department’s offices located at 156 S. August 3 – Leaking Underground Storage Tanks (LUST) Committee Meeting will meet from 9:00 AM to 12:00 PM at the Legislative Hall Senate Hearing Room in Dover, Delaware. This is a regularly scheduled meeting of the LUST Committee. VOLUNTARY CLEANUP PROGRAM (VCP) AGREEMENT NEGOTIATIONS FOR THE PARCELS 6, 7, AND 8 AND THE ROADS OF THE JUSTISON LANDING REDEVELOPMENT PROJECT, PHASE II, IN WILMINGTON DNREC is negotiating two VCP Agreements with the City of Wilmington and the Delaware Department of Transportation (DelDOT) for the Justison Redevelopment Project, Phase II. The site is located on a portion of 221 S. Madison Street, which comprises the roads and Parcels 6, 7 and 8, formerly the Wilmington Coal Gas North Site, as well as a portion of the former “Triangle Parcel” of the Wilmington Public Works Yard. PREMCOR SUBMITS REGULATION 1102 PERMIT APPLICATION

The Premcor Refining Group, Inc. has submitted an application to construct an enhanced petroleum coke storage and handling complex to replace their existing system. This application is required pursuant to the Administrative Order on Consent (AOC) between Premcor and the Department, dated April 3, 2006, with the intent of reducing particulate emissions (PM and PM10) resulting from the on-site handling and storage of coke. The proposed storage and handling complex will consist of a pneumatic coke transport line, four storage silos, a surge bin for railcar loading, two ball mills, and eleven baghouses. The reduced potential to emit from this project is 35.7 tons per year of PM and 26.4 tons per year of PM10.

PREMCOR SUBMITS REGULATION 1102 PERMIT AMENDMENT APPLICATION

The Premcor Refining Group, Inc. has submitted an application to amend Permit: APC-82/0981 – Construction (Amendment 5 NSPS) in order to install low nitrogen oxides (NOx) burners in the Carbon Monoxide Boiler (COB) of the Fluid Catalytic Cracking Unit (FCCU). The installation of the low NOx burners is required as part of the interim control measures to be implemented under Section II of the Administrative Order of Consent with the intent of reducing NOx emissions. A specific NOx emission level has not been specified in the application because the effectiveness of the interim measures has not been previously assessed under equivalent circumstances. The Department anticipates approximately 300 to 500 tons per year NOx reductions as a result of implementing the interim measures with no corresponding increases in any other pollutant.

FINAL PLAN OF REMEDIAL ACTION FOR THE ION POWER SITE IN NEW CASTLE COUNTY  Notice Start Date: 07/09/2006 Notice End Date: 07/29/2006

DNREC adopted the proposed plan of remedial action as the final plan of remedial action for the Ion Power site. The site is located at 720-750 Governor Lea Road in New Castle County, Delaware. The site is approximately 18.5 acres in size, and was used for agricultural land until the 1980s when Standard Chlorine, and later Metachem Products, LLC, used the site as a parking facility, a "change house" and administrative offices. The final remedial investigation report, dated December 27, 2005, did not reveal any contaminants of concern above DNREC's Uniform Risk Based Standards (URS) values for restricted (commercial) use in surface soils or sediments.  However, elevated concentrations of manganese and a volatile organic compound (VOC), tetrachloroethylene (PCE), were identified in the groundwater samples collected at the site.

FINAL PLAN OF REMEDIAL ACTION FOR THE NORTHERN PATHWAY SITE IN WILMINGTON  Notice Start Date: 07/09/2006 Notice End Date: 07/29/2006

DNREC adopted the proposed plan of remedial action as the final plan of remedial action for the Northern Pathway Site, located along the Christina Riverfront section in Wilmington. The site is approximately 0.22 acres in size and is located southeasterly of the right-of-way line of the former Philadelphia and Reading Railroad Company. The Christina Crescent redevelopment project borders the site to the south, and Justison Street borders the site to the west. The proposed future use of the site is for a public pathway and as a fire access road in support of the Christina Crescent redevelopment project.

 

Several contaminants were detected in soil above Delaware's Uniform Risk-Based Standard (URS) values for restricted (commercial) use including arsenic, lead, and benzo(a)pyrene. The groundwater at Christina Crescent is also contaminated with volatile organic compounds (VOCs).  The proposed and final plans are available at the Wilmington Library or at the office of DNREC–SIRB, 391 Lukens Drive, New Castle, DE 19720.  DNREC invited written and verbal comments on the plan; the public comment period began on June 11, 2006 and closed on July 3, 2006.  DNREC did not receive any public comments on the proposed plan. The public may appeal this final plan by July 29, 2006. Secretary’s Orders

 

DNREC SECRETARY HUGHES ISSUES ADMINISTRATIVE ORDER ON CONSENT TO PREMCOR REFINING GROUP INC., settling an appeal pending before the Environmental Appeals Board that will result in reductions of nearly 800 tons per year of nitrogen oxides (NOx) from the refinery. Premcor is required to install a wet gas scrubber at the refinery’s fluid catalytic cracking unit – one of the major units used in the refinery process – under an earlier consent agreement in federal court. The new consent order resolves issues in the company’s permit appeal relating to the fluid catalytic cracking unit and wet gas scrubber and sets out a timeframe for Premcor to significantly decrease its NOx emissions. Ultimately, the order requires a reduction of NOx emissions to 20 parts per million from the fluid catalytic cracking unit by May 1, 2009. Unanticipated delays, including those caused by the permitting process or other factors, could cause this date to be moved to the next scheduled turnaround after 2009 (or no later than 3 years from the resolution of any material permit appeal). In the interim, Premcor will begin implementing measures expected to reduce NOx emissions by 300 to 500 tons per year by the turnaround of 2006 and no later than May 1, 2008.

CHRISTINA PARK AND JOE WHITE MEMORIAL BALL FIELD REMEDIAL ACTION IN WILMINGTON – Competitive sealed bids for the Christina Park and Joe White Memorial Ball Field Remedial Action will be received by the State of Delaware, DNREC, Division of Air and Waste Management, Site Investigation and Restoration Branch, c/o Tetra Tech, 56 W. Main Street, Suite 400, Christiana, Delaware, 19702 until 2:00 PM local time on July 31, 2006, at which time they will be opened and read aloud. In Wilmington, Christina Park is located south of the intersection of Church and 4th Streets. Joe White Memorial Ball Field is located at the intersection of Northeast Boulevard and Vandever Avenue.

 

The work requires that the contractor provide all labor, materials, equipment and supervision necessary for demolition of select ball field equipment, placement of a one-foot thick protective barrier across the park sites, and ball field reconstruction. A MANDATORY pre-bid meeting will be held on July 24, 2006 at the Christina Park Site in the vicinity of the ball field diamond, at 10:00 AM local time, for the purpose of establishing the listing of subcontractors, reviewing selected project requirements and to answer questions. PROFESSIONAL SERVICES CONTRACT FOR REMEDIATION SERVICESREQUEST FOR PROPOSALS DNREC is seeking requests for proposals (RFP) from qualified consultants regarding professional services for remediation services for four (4) separate contracts known as Contract Numbers 06-374-MS-A, 06-374-MS-B, 06-374-MS-C and 06-374-MS-D.  Each RFP for professional services is issued pursuant to 29 Del. C. §§ 6981, 6982 and 6986.  Each RFP covers one of four tasks. Contract # 06-374-MS-A is for Site Investigations and Assessments; Contract # 06-374-MS-B is for Human Health Based Risk Assessments and Toxicology, Contract # 06-374-MS-C is for Ecological Consulting Services and Contract # 06-374-MS-D is for Environmental Engineering Services.  

 

The proposal must conform to the requirements of the Proposal Procedures and the Required Information Sections of the RFP.
