News Updates

 

New DNREC Website for Regulation No. 1146, Electric Generating Unit (EGU) Multi-Pollutant Regulation Development DNREC has begun the development of a new regulation that will reduce air emission from Delaware's coal and residual oil-fired power plants. The reason for the new regulation is to protect public health, safety, and welfare from pollutants which include nitrogen oxides (NOx), sulfur oxides (SOx), and mercury. To aid in the development of the regulatory requirements, a review committee has been established. The review committee is made up of DNREC personnel, persons with environmental interests, persons impacted by the emissions from power plants, and power plant owners and operators. USEPA issues New Fact Sheet regarding Tybouts Corner Landfill Site As detailed in the fact sheet, DNREC and the USEPA have agreed that shutting down the three remaining groundwater extraction wells is appropriate at the site in New Castle County, based on current and historic groundwater analytical results. The USEPA is preparing a revised Operations and Maintenance Plan to ensure adequate monitoring of landfill gasses so that soil vapor intrusion will not be a future issue for development of surrounding properties.  For additional information on the site, please contact John Cargill at (302) 395-2600. Upcoming Air and Waste Related Hearings, Meetings & Events

July 11 – Public Hearing on the Solid Waste Transfer Station Permit Renewal Application filed by Pine Tree Corners Transfer Station, Delaware Solid Waste Authority (DSWA) at 276 Pine Tree Road, Townsend, Delaware. The public hearing will be held beginning at 6:00 PM at the Townsend Fire Company, Inc.’s meeting hall located at 107 Main Street, Townsend, Delaware. July 18 – Yard Waste Composting Guidance and Standards Committee will meet from 10 AM to noon on Tuesday in the conference room at Smyrna Rest Stop. The group has been formed to finalize the draft Guidelines for Yard Waste Composting Facilities. The agenda for the meeting includes discussion on: grandfathering existing municipal compost operations; exemptions for landscapers managing small quantities of yard waste; finalizing draft guidelines for yard waste composting; and commenting on draft approval document handed out at the June 5 meeting. July 19 – Early Compliance and Detection Incentive (ECDI) Meeting will be held from 9:30 to 12 noon at the DNREC field office located at 391 Lukens Drive in New Castle, Delaware. The committee will review ECDI application reimbursements for approval. July 19 – Regulation 1142 Committee will meet from 10:00 AM to 12:00 PM at the DNREC field office located at 715 Grantham Lane, New Castle, Delaware, 19720. DNREC is considering revising Delaware Regulation 1142 (Specific Emission Control Requirements), by adding Section 2, to require new and/or additional controls on industrial boilers and process heaters with heat input capacity equal to or greater than 200 mmBTU/hour at petroleum refining facilities in Delaware. This is part of DNREC’s overall efforts to reduce volatile organic compound (VOC) and nitrogen oxides (NOx) emissions in Delaware and attain the 8-hour ozone standard. VOLUNTARY CLEANUP PROGRAM AGREEMENT NEGOTIATIONS FOR THE 250 SOUTH MADISON SITE AND THE 300 SOUTH MADISON SITE, PHASE I JUSTISON LANDING REDEVELOPMENT PROJECT IN WILMINGTONDNREC is negotiating Voluntary Cleanup Program (VCP) Agreements with the City of Wilmington and the Delaware Department of Transportation (DelDOT) for 300 S. Madison Street, formerly known as the Public Works Yard, and 250 S. DELAWARE SOLID WASTE AUTHORITY REQUESTS REGULATION 1102 NATURAL MINOR PERMIT TO CONSTRUCT LANDFILL GAS EXTRACTION AND COLLECTION SYSTEM IN GEORGETOWNNotice Start Date: 06/25/2006 Notice End Date: 07/10/2006

The Delaware Solid Waste Authority (DSWA) has requested a permit to construct a landfill gas extraction and collection system for the Cell 4 disposal area at the Southern Solid Waste Management Center in Georgetown. There will be no change in emissions.  The application for this permit may be reviewed at the offices of the Division of Air and Waste Management, 156 S. HIRSH INDUSTRIES SUBMITS TITLE V PERMIT RENEWAL APPLICATION FOR MCKEE ROAD FACILITY IN DOVER – Notice Start Date: 06/11/2006 Notice End Date: 07/11/2006  Hirsh Industries, located at 1525 McKee Road, Dover, Delaware, has submitted a request for permit renewal pursuant to Regulation No. 30, Section 7. Based on the data and certifications contained in the application, DNREC’s Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the US Environmental Protection Agency and DNREC.  Therefore a "draft" permit renewal has been prepared.

 

The application, the "draft" permit renewal, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the "draft" permit renewal may be inspected at the offices of the Division of Air and Waste Management, 156 S. DNREC Secretary’s Orders

 

DNREC Issues Notice of $5,000 Penalty Assessment to Simonds Excavating, Inc. in Gumboro for Air Permit and Pollution ViolationsDNREC Secretary John A. Hughes issued a Notice of Administrative Penalty Assessment and Secretary's Order to Simonds Excavating, Inc. for violations of Delaware’s regulations governing the control of air pollution. The Order includes a penalty of $5,000 and an additional $1,187.06 as cost recovery reimbursement to the Department for expenses associated with its investigation. The assessment is for violations which occurred in July and August 2005.  Simonds Excavating, Inc. owns and operates a portable crusher and one screener at the Pennsy Supply, Inc. (d/b/a Tilcon Delaware) site located at 20139 Lowes Road in Gumboro. The Company crushes asphalt in its 275 ton per hour crusher and screens the resulting material. The Company has 30 days to request a public hearing. DNREC Approves Permit Changes for New Castle County Wastewater Treatment PlantDNREC Secretary John A. Hughes signed a Secretary’s Order allowing New Castle County to renew and modify its surface water discharge permit and to amend its land treatment system permit for its Middletown-Odessa-Townsend Regional Wastewater Treatment Plant Water Farm No. 1 near Odessa. The water farm is unique in having two possible methods for the discharge of wastewater from treated domestic sewage: spray irrigation onto designated and buffered spray fields and surface water discharge, in this case into the Appoquinimink River.

 

The spray discharge method uses equipment similar to the familiar crop irrigation systems to release treated liquid wastewater on the water farm’s spray fields. The Order responds to New Castle County’s request to amend its permit with the state to reduce the buffer zone that surrounds the plant’s land treatment system.
