Valero Delaware City Refinery Update – The refinery began using new air pollution reduction equipment last Thursday, September 21. The equipment is expected to reduce annual sulfur dioxide emissions from the facility by 19,500 tons. The new equipment, a wet gas scrubber, was installed at the fluid coker unit, the major unit used in the refining process. This is the first of two wet gas scrubbers at the refinery, required under a 2001 federal Consent Decree. As part of the process, the scrubber will emit more visible white steam, which is less harmful than the previous emissions. EPA Posts 2005 TRI Electronic Facility Data Release (e-FDR) – The US EPA posted the most recent Toxic Release Inventory (TRI) data on EPA's TRI webpage at: http://www.epa.gov/tri-efdr/. The e-FDR is a facility-level, form-by-form release of the 2005 TRI data. The site allows users to look at the 2005 TRI data one report at a time through search fields at the bottom of the page. This data contains no analysis, totals, or trends; just an electronic version of the original TRI report for each TRI chemical at each TRI facility. October 1 – Coast Day 2006 will be held at the University of Delaware’s Hugh R. Sharp Campus near Lewes on Sunday from 11:00 AM until 5:00 PM. A showcase of more than 45 DNREC exhibits will help kids and adults discover the many programs offered by DNREC. All Divisions will be represented with hands-on activities, interactive games, and materials sure to engage and educate. Be sure to visit the Coastal Programs exhibits and learn how a major hurricane could impact our coast, or stop by the Division of Air and Waste Management’s Open Burning display to find out about the harmful effects of open burning on our air quality. The Division will also show exhibits on recycling and tank management, as well as provide information on the new wet gas scrubbers at the Valero Delaware City Refinery. October 2 – Public Hearing on Amending Regulation 41-Limiting Emissions of Volatile Organic Compounds from Consumer and Commercial Products, Section 1- Architectural and Industrial Maintenance Coatings will begin at 6:00 PM, at the DNREC Auditorium located at the Richardson and Robbins building at 89 Kings Highway in Dover, Delaware. The proposed amendments to Regulation 41 are: 1) specify a finite period for certain record retention by manufacturers; (2) revise the definition of a specialty primer, sealer, undercoater product to include sealing in efflorescence; (3) correct certain typographical errors; and (4) renumber the entire regulation to be consistent with the style manual of the Code of Delaware Regulations. October 5 – Workshop on Regulation 1142 - Section 2 (Large Boilers and Process Heaters at Refineries) will begin at 6:00 PM at DNREC’s Air Quality Management Field Office located at 715 Grantham Lane, New Castle, Delaware. DNREC is considering revising Delaware Regulation 1142, by adding Section 2, to require new and/or additional controls on industrial boilers and process heaters with heat input capacity equal to, or greater than, 200 million British Thermal Units per hour (mmBTU/hour) at petroleum refining facilities in Delaware. This is part of DNREC’s overall efforts to reduce volatile organic compound (VOC) and nitrogen oxides (NOx) emissions in Delaware to attain the 8-hour ozone standard. Harris Manufacturing Company, Inc. has submitted an application for a permit renewal pursuant to Regulation No. 30, Section 7, for their facility at 1300 South DuPont Boulevard in Smyrna, Delaware. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the Environmental Protection Agency (EPA) and DNREC. Therefore, a "draft" permit renewal has been prepared. This "draft" permit renewal replaces emission unit 1 (the boiler), increases the emission and operational limitations of the cleaning and gluing operations, and adds two natural gas heaters (insignificant activities).

IN WILMINGTON Notice Start Date: 09/03/2006 Notice End Date: 10/03/2006 DNREC has received an application for a modified Title V Synthetic Minor Permit for the Edgemoor Materials, Inc. facility, located at the intersection of 12th Street and Interstate 495, Wilmington, Delaware. The permit was modified to update the emission limits according to the most current emission factors. Edgemoor Materials, Inc. has a production limit of 750,000 tons of hot mix asphalt in a rolling twelve month period. This limit is necessary to restrict Edgemoor Materials, Inc. potential to emit air pollutants, and will be enforceable by the EPA and the state.

A BDA is an agreement between DNREC and a Brownfields Developer with respect to a certified brownfields site that sets forth a scope of work and schedule of remedial activities during the development of the site. DNREC negotiated three separate BDAs with Peninsula Ventures V, LLC, Peninsula Ventures VI, LLC and Peninsula Ventures VII, LLC to develop the Marina Overlook site.

DNREC announced the amended final plan of remedial action for the Budd Metal site. The site is located between Heald Street and New Castle Avenue in Wilmington, Delaware. The site comprises two parcels totaling about 12 acres, and is approximately 4,000 feet southeast of the Christina River.

The site is approximately 8 acres in size, situated on a 0.93-acre asphalt parking lot and a portion of a 6.94-acre manufacturing facility. DNREC is currently overseeing an Interim Removal Action (IRA) at the site to remove and properly dispose of the contaminants of concern.
