News Updates
DNREC’s Emergency Response Team (ERT) Responds to Used Oil Spill on the Christina River – On the evening of Saturday, July 15, DNREC’s ERT responded to the reported 2,100 gallon release of used oil into the Christina River from the US Filter/International Petroleum Company (IPC) facility in Wilmington, Delaware. The release happened during a tank to tank transfer. The US Coast Guard (USCG) and DNREC managed the initial response through the following Tuesday, July 18, when the US Environmental Protection Agency (EPA) took over from the USCG. EPA, along with DNREC’s ERT is managing cleanup of the oil from the Christina River, from Newport to the mouth of the Brandywine Creek at the Delaware River. The City of Wilmington’s Emergency Management and Fire Departments also responded to the oil spill. The cleanup work, which was conducted by contractors hired by the facility, is in the final stages of the response. A 30-day monitoring plan will be in effect to take care of any oil that may show up in the river after the response phase of the spill is closed. For more information on DNREC’s ERT, please visit: /. Update on Independent Third-party Evaluation of the DuPont Hay Road Sludge Drying ("Iron Rich") Site – An environmental contractor, Schnabel Engineering North, LLC, has been hired for the third-party environmental evaluation of the "Iron Rich" site, as required by House Concurrent Resolution No. 22. Schnabel entered into the contract with DNREC on May 30, 2006 and will complete the evaluation by September 30, 2006.

August 2 – Multi-Pollutant Regulation Public Workshop will be held from 6:00 to 9:00 PM at the University of Delaware, Albert N. and Ann V. Carvel Research and Education Center, 16483 County Seat Highway in Georgetown, Delaware. This workshop is last of three being held on the proposed Multi-Pollutant Regulation No. 1146. The proposed regulation will facilitate a reduction of air emissions from Delaware’s coal and residual oil fired power plants. A public hearing is tentatively scheduled for September 21 at the DNREC Auditorium located at the Richardson and Robbins building at 89 Kings Highway in Dover, Delaware. August 3 – Leaking Underground Storage Tanks (LUST) Committee Meeting will meet from 9:00 AM to 12:00 PM at the Legislative Hall Senate Hearing Room in Dover, Delaware. This is a regularly scheduled meeting of the LUST Committee. The statutory purpose of the Committee is to guide the development of regulations and other requirements of Title 7, Chapter 74 of the Delaware Code. August 4 – Regulation 24 “Control of Volatile Organic Compound Emissions” Workgroup will meet from 9:30 AM to 12:00 PM at the DNREC field office located at 715 Grantham Lane, New Castle, Delaware, 19720. Air Quality Management (AQM) Section is proposing to amend Regulation 24 by adding a new section that will require the control of volatile organic compounds (VOCs) emissions from lightering operations. Lightering is the transfer of cargo (usually crude oil) from ocean going vessels to service barges and ships, thereby decreasing the draft of the ocean going vessel and allowing them to proceed up the Delaware River. A subgroup from the larger regulatory workgroup recently revised the originally proposed regulatory language. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE NVF-WILMINGTON SITE – DNREC is negotiating a Brownfields Development Agreement (BDA) with Reybold Venture Group XI-F, LLC for the NVF-Wilmington Site, located at 700 Maryland Avenue in Wilmington, Delaware. The site is currently owned by National Vulcanized Fiber (NVF) Company and may contain containing hazardous contaminants above the values for DNREC's Uniform Risk-Based Standards (URS) for restricted (commercial use) and/or unrestricted (residential use), as a result of its past use as a former manufacturing facility and/or other industrial uses. PROPOSED PLAN OF REMEDIAL ACTION FOR THE SOIL AND WATER CONSERVATION DREDGE OPERATION FACILITY-OPERABLE UNIT-I IN LEWES

DNREC announced the proposed plan of remedial action for the DNREC Soil and Water Conservation Dredge Facility-Operable Unit-I site. The site located is located on Pilottown Road in the town of Lewes, Delaware. The site is the location of the former Doxsee seafood processing plant, and consists of approximately 9.5 acres in Sussex County. Following the proposed cleanup at the site, DNREC's Division of Soil and Water will build a new Operations Facility on the northwest half of the Site, and DNREC's Division of Fish and Wildlife will construct a new recreational boat ramp on the southeast half of the property. The new boat ramp will replace the current boat ramp located in downtown Lewes.
DNREC’s contractor, Tetra Tech, Inc. (Tetra Tech) conducted several activities at the site during the autumn of 2003 and winter, 2003-2004, including sampling waste containers, a remedial investigation and a feasibility study in order to investigate the potential risk posed to public health, welfare and the environment at the site. The results of the RI revealed that chlordane and other chlorinated pesticides had impacted site soils. PROPOSED PLAN OF REMEDIAL ACTION FOR FORMER TIMMONS MARINA SITE IN SUSSEX COUNTY

DNREC announced the proposed plan of remedial action for the Former Timmons Marina Site. The site is located off Piney Neck Road, adjacent to Pepper Creek in Dagsboro, Sussex County, Delaware. The site is approximately 43 acres, with the marina area encompassing 7 acres. The Site is currently used for agriculture purposes. SK Pepper Creek, LLC, the owner of the site, wishes to develop the agricultural and wooded acreage as a residential community and rehabilitate the marina.
A Brownfield Investigation (BFI) was performed to evaluate risk to human health and the environment. The BFI revealed that the site's sediment contained metal concentrations, such as arsenic, barium, copper, lead, nickel and zinc that exceeded the URS values for unrestricted (residential) use. Groundwater results indicated the presence of nitrate/nitrite and certain metals such as iron and aluminum, but were within Delaware's natural background levels, however, further evaluation is required if groundwater is to be used for human consumption. Secretary’s Orders
DNREC SECRETARY HUGHES ISSUES SECRETARY’S ORDER ON THE DELAWARE SOLID WASTE AUTHORITY’S (DSWA) PINE TREE CORNERS TRANSFER STATION – The Secretary’s Order and the Permit allow for the operation of the facility for a term of ten (10) years and a daily tonnage limit of 1,100 tons with waste receiving hours from 7:00 AM to 5:00 PM, Monday through Saturday. The Secretary also required the DSWA to operate the facility in compliance with state and federal laws and regulations. DNREC’s Solid and Hazardous Waste Management Branch issued Permit SW-06/04 in response to the Order.
