News Updates
EPA Awards Clean School Bus USA Program Grant To Delaware’s Brandywine School District (BSD) – The EPA grant for $570,000 is the second largest grant of its kind awarded to date. The grant will allow the district to install exhaust-filtering devices, called diesel particulate matter traps, to reduce emissions on 67 of its diesel school buses by this summer. Jeff Viar, the BSD Supervisor of Transportation, applied for the grant in the summer 2005, with support from DNREC, to win the award.
Delaware City Refinery Update – Valero’s Coker Carbon Monoxide Boiler (COB) experienced a tube leak on March 25 and was taken out of service. During this time, the coker exhaust was directed through the back-up incinerator, which combusts the gases at greater than 1,700oF. Repairs to the Coker COB tube were completed by March 30, and the COB and wet gas scrubber were brought back on line by March 31. The back up incinerator continued to operate (12 to 24 hours) until the refinery operations were stable. DNREC provided regulatory oversight and requested an incident report within 30 days. Upcoming Air and Waste-Related Hearings, Meetings & Events
April 14, 2007 –Christina River Watershed Cleanup will be held from 8 AM to noon, to remove roughly 20 tons of debris from the river as part of the annual cleanup. Since 1991, this all-volunteer effort has helped to restore the Christina River and its tributaries, which currently provide fresh drinking water to almost 400,000 citizens throughout New Castle County. April 18, 2007 – Recycling Public Advisory Council Meeting will be held from 1:30 to 3:30 PM at the Department of Health and Social Services (DHSS) Georgetown State Service Center located at 546 South Bradford Street in Georgetown. April 21, 2007 – Earth Day Weekend Concert at Bellevue State Park will begin at 1:00 PM. In honor of Earth Day (Sunday, April 22), winners of the Earth Day Poster Contest will be announced and prizes will be awarded at the concert. Finalists’ posters will be displayed for one month in the Bellevue Arts Center. April 26, 2007 – Public Hearing on Proposed Adoption of Regulation No. 1148, Control of Stationary Combustion Turbine Electric Generating Unit Emissions, will begin at 6:00 PM in the DNREC auditorium at the Richardson and Robbins Building, 89 Kings Highway in Dover. The proposed adoption of the new regulation is to control the emissions of nitrogen oxides (NOx) from existing, stationary combustion turbine electric generating units, which are typically known as peaking units. Secretary’s Order
Secretary’s Order Issued Regarding Final Regulation to Amend Regulation No. 1124 in Delaware’s Regulations Governing Air Pollution Control by Adding Section 46 - Crude Oil Lightering Operations – DNREC Secretary John A. Hughes issued Secretary’s Order No. 2007-A-0011 on April 3, 2007 to regulate the release of harmful volatile organic compound (VOC) air emissions during crude oil lightering. Lightering is the transfer of cargo from larger ships to smaller ships in order to allow the larger ships to deliver the cargo to shallower locations along the Delaware Bay. The VOCs released during crude oil lightering are a major source of VOCs released in Delaware. VOCs are a major source of air pollution, particularly in the formation of ozone. The effective date of the amendment is May 11, 2007. PROPOSED PLAN OF REMEDIAL ACTION FOR THE 513 LEXINGTON AVENUE SITE IN SMYRNA

DNREC’s Site Investigation and Restoration Branch (SIRB) announced the proposed plan of remedial action for the 513 Lexington Avenue site in Smyrna, Delaware. The site is approximately 2.4 acres in size, and was utilized as a residence and a metal scrapping facility where cars, other metal, and possibly some transformers were cut up for scrap. In February 2006, DNREC certified the Site as a Brownfields site, and the developer, Juanita, LLC, entered into a Brownfields Development Agreement with DNREC. A Remedial Investigation at the site indicated contaminants of concern in soil samples including polychlorinated biphenyls (PCBs) and cadmium above DNREC's cleanup standards. An interim remedial action was completed at the site.
DNREC invites comments on the proposed plan. The public comment period begins on April 2, 2007 and will close on April 23, 2007. Copies of the proposed plan are available at the Smyrna Public Library or at the office of DNREC–SIRB, 391 Lukens Drive, New Castle, DE 19720. Notice is hereby given that EAR Specialty Composites S.B.U. Aearo Company, having a facility at 650 Dawson Drive in Newark, Delaware, has submitted a request for permit renewal pursuant to Regulation No. 30, Section 7. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the EPA and DNREC. Therefore a "draft" permit renewal has been prepared. This "draft" permit renewal incorporates all applicable requirements for all regulated air pollutants and requires the facility to comply with the terms and conditions of the permit and be liable for all violations of the permit conditions and applicable federal and state rules.
A public hearing concerning the permitting action will not be held unless the Secretary of the Department of Natural Resources and Environmental Control receives a request for such hearing by May 1, 2007. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the EPA and DNREC. Therefore, a "draft" permit renewal has been prepared. This "draft" permit renewal incorporates all applicable requirements for all regulated air pollutants and requires the facility to comply with the terms and conditions of the permit and be liable for all violations of the permit conditions and applicable federal and state rules. The "draft" permit renewal consolidates previously issued permit terms and conditions for various emission units into one single permit for the facility.

- Occidental Chemical Corporation has submitted an application, pursuant to Regulation No. 1102 (Permits), Section 2.1 (), 11.2(i), and 12.3, for a permit to operate the following equipment: two boilers, a potassium hydroxide production facility with associated salt heater, five mercury retorts, a cold solvent degreaser, a 285 gallon gasoline storage tank, two 16,000 gallon fuel oil storage tanks, and a quality assurance laboratory at 1657 River Road in the Delaware City Industrial Complex, New Castle, Delaware. Occidental Chemical Corporation is requesting a limit on the fuel usage allowed in their boilers and their salt heater. - Coastal Coatings has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3, for an amendment to their permit for a flow coating machine located at 631 Ridgley Street in Dover, Delaware. Coastal Coating requests an increase in the amount of operating hours and the removal of the annual coating volume limitation. These changes will not increase the facility's permitted volatile organic compounds (VOCs) limit of 17.0 tons per year or their 3.36 pounds of VOCs per gallon of coating restriction. REGULATION 1102 NATURAL MINOR PERMIT APPLICATIONS

Notice has been given that:
1. GE Energy (USA) LLC – Solar Technologies, requests a permit to construct a setter hood and associated dust collector at their 231 Lake Drive, Newark facility in New Castle County. The setter hood and associated dust collector have the potential to emit (PTE) 2.16 tons per year of particulate matter (PM). By permit, actual emissions will not exceed 0.02 tons per year of PM.
2. GE Energy (USA) LLC – Solar Technologies, requests a permit to construct a powder preparation operation and associated dust collector at their 231 Lake Drive, Newark facility in New Castle County. The powder preparation operation and associated dust collector have the potential to emit (PTE) 35.8 tons per year of particulate matter (PM), and 1.05 tons per year of particulate matter less than 2.5 microns (PM2.5). By permit, actual emissions will not exceed 1.05 tons per year of PM, and 1.05 tons per year of PM2.5.
3. GE Energy (USA) LLC – Solar Technologies, requests a permit to construct a silicon heat treatment operation and associated dust collector at their 231 Lake Drive, Newark facility in New Castle County. The silicon heat treatment operation and associated dust collector have the potential to emit (PTE) 3.72 tons per year of particulate matter (PM), 73.1 tons per year of argon, and 0.04 tons per year of carbon monoxide (CO). By permit, actual emissions will not exceed 0.03 tons per year of PM, 73.1 tons per year of argon, and 0.04 tons per year of CO.
4. Coatings, Inc. requests a permit to construct or operate spray paint operation at their 30 Commerce Street, Wilmington facility. The spray paint operation shall not exceed 2.5 tons per year of volatile organic compounds.
5. A. I. DuPont Hospital for Children requests permission for the operation of two (2) identical emergency generators, rated 1,341hp each at their 1600 Rockland Road, Wilmington facility.
6. Dagsboro Materials (Division of Haines & Kibblehouse, Inc.) requests a temporary permit for a diesel powered concrete crusher (crusher, screener, and conveyors) to be located at 30548 Thoro-Good Road, Dagsboro, Sussex County. The company has taken an operating hour limitation of 500 hours to reduce nitrogen oxides (NOx) emissions below the five ton per year threshold of Regulation No. 1125, Minor New Source Review.
7. Pennsy Supply, dba Pioneer Concrete, requests a Natural Minor permit to construct a ready-mix concrete plant at 1100 South Heald Street, Wilmington. Estimated emissions are 0.015 tons of particulate matter per year.
A public hearing on any of the above applications will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application by April 16, 2007.
