Recycle Analog TVs Through DSWA’s Electronic Goods Recycling Program In preparation for the February 2009 switch to digital television, the Delaware Solid Waste Authority (DSWA) is encouraging Delawareans that no longer want their old analog televisions to recycle them through DSWA’s Electronic Goods Recycling Program.  DSWA's Electronic Goods Recycling Program allows residents to conveniently drop off their unwanted electronic items for free, with 24 recycling locations throughout the state. The drop-off program is designed to accept electronic goods, telecommunications equipment, toys, radios, televisions, and electroacoustic equipment such as calculators, computers and their parts, keyboards, printers, copiers, cables, phones, fax machines, answering machines, and VCRs.  For more information on DSWA’s Electronic Goods Recycling Program or any other DSWA programs or facilities, please call the Citizens’ Response Line at 1-800-404-7080 or visit: http://www.dswa.com/programs_electronic.asp.

Kaneka Heavy Industrial Site Declared Abandoned Under Coastal Zone Act The Acting Secretary of DNREC, David S. Small, declared the Kaneka Delaware heavy industrial site to be abandoned. The site is located at 1685 River Road near Delaware City. Heavy industrial use of the site predated the signing of the Coastal Zone Act. Upcoming Air and Waste-Related Hearings, Meetings & Events

January 28 Public Hearing on Proposal to Amend Regulation 1141 – “Limiting Emissions of Volatile Organic Compounds (VOCs) from Commercial and Consumer Products Categories will be held at 6:00 PM at the DNREC Air Quality Management Section Office at the Priscilla Building located at 156 S. State Street in Dover. The proposed revision to Section 2.0 - Consumer Products, will regulate 23 more products/product types, which is projected to reduce VOC emissions in Delaware by up to 220 tons per year. Adding a new section, Section, 4.0 - Adhesives and Sealants, will regulate certain industrial or commercial adhesives and sealant compounds, such as those used in building houses, laying carpets, installing roofing material, etc., and is projected to reduce VOC emissions in Delaware by an additional 365 tons per year. Any person may make comments for consideration in adoption of these proposed amendments; interested parties may present statements and/or testimony at the hearing, which will be entered into the public record. January 28 The Source Water Protection Citizens and Technical Advisory Committee (CTAC) of the Source Water Assessment and Protection Program will meet from 9 AM to noon in Conference Room 220 A&B of the Kent County Administrative Offices on Bay Road in Dover. The agenda includes: an overview of some draft changes to the Delaware Underground Storage Tank Regulations; Peter McLaughlin of the Delaware Geological Survey updating the committee on the survey’s work on the confined aquifers in Sussex County and the unconfined aquifer in Kent County; and a presentation by Chris Weeks of the Becker Morgan Group on Leadership in Energy and Environmental Design (LEED) with a focus on water conservation practices. Secretary’s Orders

Final Plan of Remedial Action and Secretary’s Order for DuPont Hay Road Sludge Drying “Iron Rich” Site DNREC issued Secretary’s Order No. 2009-A-0005 on January 16, 2009, adopting the Proposed Plan of Remedial Action as the Final Plan of Remedial Action for the DuPont Hay Road Sludge Drying “Iron Rich” Site. The site is located at 1200 Hay Road in Wilmington, Delaware, and has been used for stockpiling or storage of a byproduct of DuPont’s titanium dioxide manufacturing process which DuPont calls Iron Rich© material (“IRM”). Approximately 500,000 tons of IRM remain on the site, which is underlain by dredge material.

Copies of the Final Plan, the Secretary’s Order, and the Hearing Officer’s Report and DNREC’s Technical Response to Public Comments are available at the Wilmington Public Library. Secretary’s Order No. 2009-A-0004 Amending Regulation 1138 - Emission Standards for Hazardous Air Pollutants for Source Categories was issued by DNREC Secretary John A. Hughes on January 14. The amendment reduces the emissions of ethylene oxide, a probable human carcinogen, from hospital ethylene oxide sterilizersThe effective date of the amendment is February 11. BROWNFIELDS DEVELOPMENT PROGRAM The Division’s Brownfields Development Program encourages the cleanup and redevelopment of vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a Brownfields Development Agreement (BDA) or a Brownfields Voluntary Cleanup Program (VCP) Agreement to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. A BDA is only available to parties that are not current site owners. The Brownfields VCP Agreement is available to Brownfields site owners, who, although not contributors to the contamination, may already be liable as a potentially responsible party for the site. The VCP Agreement provides a mechanism to remediate contamination while developing the Brownfields site, and receive liability protection for past releases of hazardous substances at the site. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS VOLUNTARY CLEANUP PROGRAM AGREEMENT  SIRB negotiated the following Brownfields VCP Agreement with:

PROPOSED PLAN OF REMEDIAL ACTION 300 GREENHILL AVENUE SITE IN WILMINGTON SIRB announced the Proposed Plan of Remedial Action for the 300 Greenhill Avenue Site. The 0.58 acre site is a carwash that is going through remodeling with a detailing center and self-wash bays. Environmental contamination with arsenic was detected at the site, likely as a result of its historic tannery use. In addition, remedial action related to petroleum contamination was performed under the oversight of DNREC’s Tank Management Branch due to the former use of the site as a gas station. Delaware Offices, LLC and GHCW, LLC, the current owners of the property, have proposed redevelopment of the site for the renovation of the car wash.

PROPOSED PLAN OF REMEDIAL ACTION FOR THE HEALTHWAYS INC., SITE, OPERABLE UNIT 2, IN ODESSA  SIRB announced the Proposed Plan of Remedial Action for the Healthways, Inc. Site, Operable Unit 2 (OU2). The Healthways OU2 site consists of an unnamed tributary to the Appoquinimink River, and associated tidal marshes just outside of the town limits of Odessa, downstream from the former Healthways, Inc., salvage yard. The salvage yard was designated as OU1, and remedial action was completed there. Environmental contamination was suspected at OU2 as a result of the salvage yard operations, which resulted in contamination of soils, groundwater, surface water, and sediments at OU1 with metals, including lead and petroleum-related hydrocarbons. SIRB conducted a Remedial Investigation (RI), including an Ecological Risk Assessment, of OU2. The RI revealed no adverse environmental impacts on OU2 attributable to the OU1 site. Therefore, DNREC proposes to require no further action with respect to OU2.

FINAL PLAN OF REMEDIAL ACTION FOR THE HOWARD STREET PROPERTY  SIRB adopted the Proposed Plan of Remedial Action as the Final Plan of Remedial Action for the Howard Street Property. The 8.4 acre site is located between South Market Street and South Walnut Street in Wilmington, Delaware. Environmental contamination resulted from historic use, including as the former Penn Del Recycling Company, a metal salvage yard. In addition, the fill originally used to fill the low lying areas contributed to soil contamination. Primary contaminants of concern for the Howard Street Property are polychlorinated biphenyls (PCBs), arsenic, lead, and to a lesser extent, polycyclic aromatic hydrocarbons (PAHs).

DNREC invited written comments on the Proposed Plan. The public comment period began on October 29, 2007 and closed on November 19, 2007. DNREC did not receive any comments to the Proposed Plan. Therefore, the Proposed Plan was adopted as the Final Plan. FINAL PLAN OF REMEDIAL ACTION FOR THE RAILROAD CROSSING SITE IN WILMINGTON SIRB announced the Final Plan of Remedial Action for the Railroad Crossing Site.  The 1.75 acre site is located at the intersection of 5th and Coleman Streets in Wilmington. The site was historically operated as the Wilmington Coal and Coke Company; the Keystone Coal Company; and most recently (through early 2006) as the Delaware Insulation Company, a warehouse and distribution center for insulation and pipe covering. These historical operations resulted in the generation of hazardous and non-hazardous materials at the site. The remaining single-story buildings on site were demolished in April-May 2007.

DNREC invited written comments on the Proposed Plan. No comments were received. Therefore, the Proposed Plan has been issued as the Final Plan. The public appeal period for the Final Plan began on January 18, 2009 and will close on February 9, 2009.

FINAL PLAN OF REMEDIAL ACTION FOR THE LIPPINCOTT PROPERTY SITE IN WILMINGTON  SIRB announced the Final Plan of Remedial Action for the Lippencott Property Site. The quarter-acre site is located in the City of Wilmington, and includes 300 to 318 N. Market Street; 7 and 9 E. Third Street; and 4 E. Fourth Street. The historical property use includes the Third Street Market, Swan Hotel, Hardin Tools, a barber shop, a gun store, gas company office, oil cloth and carpets shop, photo shop, drugstore, liquor warehouse, bakery, ice cream shop, and offices.  A small area of stained soils caused by a 500-gallon above ground storage tank was noted during a Phase I Environmental Site Assessment.  Asbestos and lead risks were identified within the buildings prior to renovation.  These environmental problems have been addressed during the restoration of the historical buildings.

DNREC invited written comments on the Proposed Plan. The public comment period began on December 7, 2008 and closed on January 7, 2009.  DNREC did not receive any comments on the Proposed Plan.  Therefore, the Proposed Plan has been issued as the Final Plan. FINAL PLAN OF REMEDIAL ACTION FOR THE BRANDYWINE FIBRE SITE IN WILMINGTON SIRB announced the Final Plan of Remedial Action for the Brandywine Fibre Site. The one-acre site is located in the City of Wilmington, and occupies the city block between 14th and 15th Streets at Clifford Brown Walk. The property is currently vacant, however, it is the former site of various industrial facilities including a tannery.  Subsurface soil is contaminated with petroleum-related substances and tannery wastes.  The goal of the remediation is to make the site suitable for low-rise residential or light commercial development, characteristic of the surrounding area.

DNREC invited written comments on the Proposed Plan. The public comment period began on December 15, 2008 and closed on January 12, 2009.  DNREC received comments related to public health and safety precautions to be taken during the proposed remedial activities.  The comments will be addressed in the Remedial Action Work Plan and the Health and Safety Plan. Therefore, the Proposed Plan was adopted as the Final Plan. The public may appeal the Final Plan. FINAL PLAN OF REMEDIAL ACTION FOR THE PAVILION SITE IN WILMINGTON
  SIRB announced the Final Plan of Remedial Action for the Pavilion Site. The site is located at the northwest corner of the intersection of 5th Street and DuPont Streets in Wilmington, Delaware.  The site, approximately 0.3 acres in size, has been used as a parking lot since the late 1980s/early 1990s by Saint Francis Hospital.  The Site was certified as a brownfields, based on limited previous investigations that indicated elevated concentrations of arsenic in the soil. A Brownfield Investigation conducted in March 2007 identified polycyclic aromatic hydrocarbons (PAHs) and pesticides in localized areas of the site (in soil).


DNREC invited written comments on the Proposed Plan. The public comment period began on December 7, 2008 and closed on January 7, 2009.  DNREC did not receive any comments on the Proposed Plan. Therefore, the Proposed Plan has been issued as the Final Plan. The public may appeal the Final Plan. REVISED FINAL PLAN OF REMEDIAL ACTION FOR THE CHRISTINA LAB SITE IN WILMINGTON
SIRB announced the Revised Final Plan of Remedial Action for the Christina Lab Site. The 20-acre site is located in the City of Wilmington between Christina Avenue and the Christina River at the I-495 bridge.  The property, currently vacant, is the former site of various industries including a linoleum production plant and a DuPont Company pilot production facility.  Subsurface soil consists of fill material from ore processing at the Lobdell Car Company, which was formerly located on a parcel adjacent to the site. The DuPont Company investigated the site under the Delaware Voluntary Cleanup Program.  In 2005, DNREC issued a Final Plan for the site requiring “Installation of a cap over the entire site consisting of clean fill, stone base and asphalt cover.”  This wording is not consistent with current best management practices for storm water on the site, to prevent sediment discharge to the Christina River. 

DNREC invited written comments on the Revised Final Plan.  The public comment period began on December 15, 2008 and closed on January 12, 2009.  DNREC did not receive any comments on the Revised Final Plan. Therefore, the Revised Final Plan has been adopted for the site. The public may appeal the Revised Final Plan.   • Rohm and Haas Electronic Materials CMP Inc., located at 351 Bellevue Road in Newark, has submitted permit amendment applications to allow the ventilation of two (2) cold degreasers units to comply with the OSHA standard. The total volatile organic compound (VOC) emissions from the units will not exceed 0.13 tons per year.
  • Stonetech requests an amendment to their 400-Tons Per Hour impact crusher and powered-screening deck permit, per Regulation No. 1102, Section 12.2, to add two new operating locations at: the Pennsy Supply, dba Pioneer Concrete B&O Block facility, located at 140 Southern Blvd. in Camden-Wyoming, and the Pennsy Supply, dba, Pioneer Concrete Blades facility located at 26020 River Road in Seaford. No increase in emissions or permitted emission limits will result. 

TITLE V SYNTHETIC MINOR PERMIT APPLICATIONS  Notice has been given that the facilities listed below have applied for Title V Synthetic Minor permits. The applications may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware, or 715 Grantham Lane, New Castle, Delaware. For additional information, or for an appointment to review the applications, please contact Joanna Austin at the Dover Office at (302) 739-9402. A public hearing concerning the following permitting action will not be held unless the Secretary of DNREC receives a request for such hearing by February 4, 2009:

  • Proctor & Gamble Dover Wipes Company (Proctor & Gamble) has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for a permit amendment at 1340 West North Street in Dover. Proctor & Gamble requests limits for operating hours for Boiler No. 2. These limits are necessary to restrict Proctor & Gamble’s potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state.   • Color Works Painting, Inc. submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for an amendment to construct a cartridge pulse jet dust collector for their sandblaster at 251 Edwards Ave. in New Castle. The dust collector has the potential to emit (PTE) 820 TPY PM. By permit, actual emissions will not exceed 1 lb/year PM. Color Works Painting, Inc. also requested a limit for total particulate matter. These limits are necessary to restrict Color Works Painting, Inc. potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility are 831 TPY PM and 46 TPY volatile organic compounds (VOCs).
