DNREC’s Polly Drummond Hill Yard Waste Drop-off Site Remains Temporarily Closed through Nov. 7 – The site is located in the Pike Creek area on Polly Drummond Hill Road, about ½-mile north of the Kirkwood Highway near Newark. The site is closed for crews to finish grinding the yard waste into free, usable mulch. The mulch will be available for pick up by New Castle County residents when the site reopens at 8:30 AM on Friday, Nov. 7. New Castle County residents who would like to drop off yard waste while the Polly Drummond Hill site is closed can drop off yard waste at one of DNREC’s other yard waste sites – the Brandywine Hundred site located north of Wilmington or the DART Mid-County site near Bear. Evraz Claymont Steel: Notice of Violation for Electric Arc Furnace and Associated Equipment – The Division’s Air Quality Management Section issued the notice for operating the Electric Arc Furnace and associated equipment in violation of the permit under the State of Delaware “Regulations Governing the Control of Air Pollution.” Recently, the Division submitted “Comments on Dust Study Progress and Mercury Reduction Order Progress” to the facility. Delaware City Refinery: Notice of Violation Issued to The Premcor Refining Group Inc. – The Division’s Air Quality Management Section issued the notice for excess emissions that occurred between May 27 and June 8, 2008 from its Fluid Coking Unit (FCU). On May 27, Premcor was in the process of restarting its FCU after its turnaround. The loss of a wet gas compressor triggered a flaring event. At the same time, a leak was discovered in an expansion joint in the exhaust ductwork leading to the carbon monoxide boiler (COB). In order to repair this leak, the COB had to be shut down and, consequently, the downstream pollution control equipment had to be bypassed. Although, the back up incinerator was started up, there was a brief period of 5 hours when it, too, tripped. All of the above contributing factors caused excess emissions from the FCU. Scrap Tire Control and Cleanup at Fitzgerald’s Salvage Yard in Lincoln – The Division’s Solid and Hazardous Waste Management Branch’s (SHWMB) Scrap Tire Control & Cleanup Program began its fourth cleanup project with Fitzgerald’s Salvage Yard. The cleanup of the 1st portion of the yard includes approximately 240,000 mixed passenger vehicle and truck tires (approximately 3,000 tons). This is the start of an ongoing project to remediate over one million tires at the site. The project is expected to take six weeks for completion, and will cost an estimated $313,000. The scrap tire pile cleanups are funded by a fee on tires sold in Delaware of $2 per tire. November 12 – Public Hearing on TA Instruments’ Coastal Zone Act Application will be held at 6 PM at the DNREC office building at 391 Lukens Drive, New Castle. TA Instruments – Waters LLC wants to relocate their existing operation from 109 Lukens Drive to a new building built on Parcel 32, Lukens Drive in the Riveredge Industrial Park in New Castle. TA Instruments is seeking a Coastal Zone Act Permit to continue manufacturing 125 rheological and 600 thermal instruments per year in their new building. The proposed operation would generate 30 gallons per year of spent isopropyl alcohol from cleaning parts in the manufacturing process, as well as regular office trash and cardboard waste. The company’s offset proposal includes a plan to recycle the isopropyl alcohol using a licensed recycler of hazardous waste and also to recycle the waste cardboard and spent light bulbs off site. November 14 – Brownfields Advisory Committee Meeting will meet from 9:00 AM to 12:30 PM at the DNREC field office located at 391 Lukens Drive in New Castle. November Public Workshop Meetings for Regulation 1351, State of Delaware Regulations Governing Underground Storage Tank (UST) Systems – DNREC’s Division of Air and Waste Management, Tank Management Branch, will conduct three public workshops on the proposed amendments to Regulation 1351, State of Delaware Regulations Governing Underground Storage Tank Systems, to implement operator training regulations as required by the Federal 2005 Energy Policy Act, to clarify existing requirements and to prohibit locating new UST facilities in close proximity to drinking water supplies. The workshops will be held at the following times and locations:

Documents Available for Public Comment or Appeal
The Division’s Brownfields Development Program encourages the cleanup and redevelopment of vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a Brownfields Development Agreement (BDA) or a Brownfields Voluntary Cleanup Program (VCP) Agreement to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. A BDA is only available to parties that are not current site owners. The Brownfields VCP Agreement is available to Brownfields site owners, who, although not contributors to the contamination, may already be liable as a potentially responsible party for the site. The VCP Agreement provides a mechanism to remediate contamination while developing the Brownfields site, and receive liability protection for past releases of hazardous substances at the site. Environmental contamination occurred at the 1.37-acre site as a result of its past use as a scrap metal salvage yard. DNREC invites written comments on the Proposed Plan. PROPOSED PLAN OF REMEDIAL ACTION FOR THE KRIEGER-FINGER PROPERTY IN WILMINGTON SIRB announced the Proposed Plan of Remedial Action for the Krieger-Finger Property site located approximately 400 feet southeast of the intersection of South Walnut Street and A Street in Wilmington. This site is currently a vacant property, but was originally a wetlands area that received fill periodically since the 1800s, as did much of the surrounding area. In 1985, excess contaminated soil from a construction project was disposed of at the site. The USEPA and DNREC investigated the soils and determined that the soil contained polychlorinated biphenyls (PCBs). The USEPA recommended at the time that the site should not be use for residential construction, but industrial development would not present a problem. DNREC invites written comments on the Proposed Plan. The public comment period began on Oct. 19, 2008 and will close on Nov. 8, 2008. FINAL PLAN OF REMEDIAL ACTION FOR THE PEPUP/CALHOUN SITE IN GEORGETOWN
SIRB announced the Proposed Plan of Remedial Action as the Final Plan of Remedial Action for the Pepup/Calhoun site located at 22297 South DuPont Boulevard in Georgetown. Environmental contamination occurred at the 13-acre site, caused by a leaking underground storage tank and abandoned agricultural chemicals due to its past use including as a gas station and a warehouse. The site will be redeveloped as a commercial center. DNREC invited written comments on the Proposed Plan. The public comment period began on Oct. 1, 2008 and closed on Oct. 24, 2008. No Comments were received; therefore, the Proposed Plan was adopted as the Final Plan. The public may appeal the Final Plan by Nov. 22, 2008. FINAL PLAN OF REMEDIAL ACTION FOR THE 00 MOUNT VERNON STREET SITE IN SMYRNA SIRB announced the Proposed Plan of Remedial Action as the Final Plan of Remedial Action for the 00 Mt. Vernon Street site. The 0.54-acre site is located in Smyrna. Environmental contamination occurred at the site as a result of its past use as a storage facility for coal and wood. Ducts Unlimited will redevelop the property for commercial use. DNREC invited written comments on the Proposed Plan. The public comment period began on September 28, 2008 and closed on October 18, 2008. DNREC did not receive any comments on the Proposed Plan; therefore, the Proposed Plan was adopted as the Final Plan. The public may appeal the Final Plan by Nov. 22, 2008. - Sea Watch International, Ltd. has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for permit Amendment for their 242 South Rehoboth Boulevard facility in Milford. Sea Watch International Ltd. requests a rolling twelve month limit of 300,000 gallons of No. 5 fuel oil, and 600,000 gallons of No. 5 fuel oil for Boiler No. 1 and No. 3, respectively and the capability to combust natural gas. These limits are necessary to restrict Sea Watch International Ltd.’s potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility are 44.57 tons per year (TPY) of nitrogen oxides (NOx), 20.22 TPY of carbon monoxide (CO), 37.84 TPY of sulfur dioxide (SOx), 6.49 TPY of particulate matter (PM), and 1.52 TPY of volatile organic compounds (VOCs). - American Air Liquide has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3, for the construction of an outdoor combustion test platform at Glasgow Business Community, 200 GBC Drive in Newark. American Air Liquide requests a limit for: NOx= 2.08 TPY; SO2 = 2.03 TPY; CO = 0.63 TPY; PM = 0.31 TPY; VOCs= 0.11 TPY. These limits are necessary to restrict American Air Liquide potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the facility are: NOx= 13.61TPY; SO2 = 2.24 TPY; CO = 8.70 TPY; PM = 1.14 TPY; VOC= 18.61 TPY. REGULATION 1102 NATURAL MINOR PERMIT APPLICATIONS Notice has been given that the facilities listed below have applied for Regulation 1102 Natural Minor permits. - Delmarva Aggregates, LLC requests an operating permit to operate an aggregate transfer facility at 26056 River Road in Seaford. The aggregate transfer facility has the potential to emit 58.2 tons per year (TPY) of particulate matter less than 10 microns in size (PM-10). By permit, actual emissions will not exceed 2.1 TPY PM-10.
- Delaware Solid Waste Authority (DSWA) submitted a construction air permit application for its ongoing expansion project to expand the existing landfill gas management system at the Cherry Island Landfill located in Wilmington. The air permit application proposes the continuation of the existing landfill gas management system for the expansion project to provide continuous landfill gas collection throughout the life of the landfill. The previously approved expansion project air permit was issued to DSWA in January 2006 for three years.
- Kent County Levy Court requests a construction permit to construct a scrubber to service three biosolids dryers at their Kent County Regional Wastewater Treatment Facility located at 139 Milford Neck Rd, Milford. The scrubber has the potential to emit 0.91 TPY of PM-10. By permit, actual emissions will not exceed 0.65 TPY PM-10.
- The University of Delaware requests a construction permit to construct a pathological waste (non-infectious) incinerator fired by propane at their Georgetown Research and Education Center located at 16483 County Seat Highway, Georgetown. The incinerator has the potential to emit 1.0 TPY PM-10, 2.2 TPY carbon monoxide (CO), 0.55 TPY sulfur dioxide (SOx), 0.66 TPY nitrogen oxides (NOx), and 0.66 TPY of volatile organic compounds (VOCs). By permit, actual emissions will not exceed 0.019 TPY PM-10, 0.040 TPY CO, 0.010 TPY SO2, 0.012 TPY NOx, and 0.012 TPY VOCs.
- The Premcor Refining Group Inc. has submitted applications to restrict the annual electric power output to the electric grid to less than or equal to 10% of the annual electric power generation of the following equipment: Boilers 1, 2, 3 and 4 and two combined cycle units with heat recovery steam generators at the Delaware City Power Plant located in Delaware City. The above restrictions will exempt these units from the applicability of Delaware Regulation 1147.
- Rocket Construction Company requests a Regulation No. 1102 permit to operate a non-metallic mineral portable crusher at 1657 River Road in New Castle. The crusher has the potential to emit 0.32 ton per year of PM, 0.53 TPY of SOx, 12.3 TPY of NOx, 3.84 TPY of CO, and 0.46 TPY of VOCs. By permit, actual emissions will not exceed 0.06 tons per year of PM, 0.01 TPY of SOx, 0.22 TPY of NOx, 0.06 TPY of CO, and 0.01 TPY of VOCs.
