News Updates

Recycle Your Holiday Tree at a Yard Waste Drop-off Site or State Park Delawareans are encouraged to Go Green this holiday season by recycling their holiday tree at a yard waste drop-off site in New Castle County or a state park in Kent or Sussex County. Trees and other greens, free of ornaments, wire and tinsel, can be dropped-off at one of six locations statewide from Dec. 26 through Jan. 19. Secretary’s Order

DNREC Secretary Issues Order No. 2008-W-0061 Regarding The Premcor Refining Group, Inc. (Premcor) Application for Subaqueous Lands Act Permission to Make Emergency Repairs to Pier No. 1 at the Delaware City Refinery. Pier No. 1 is one of three piers used to transfer crude oil from ships moored in the Delaware River to the petroleum refinery. Problems with Pier No. 1 were discovered by an inspection performed during the week of October 13, 2008, Following the inspection, Pier No. 1 was removed from service due to safety and environmental concerns. The inspection found that Pier No. 1’s main loading platform pilings were severely deteriorated and/or buckled and there are cracks in the concrete encasements and on the surface of the loading platform. Premcor seeks to install five new steel “H” piles along the river side of the main loading platform in order to supplement the existing piles, and to install a steel plate on the concrete cap. In addition, Premcor proposes to remove the current breasting mooring structure and replace at an immediate upstream location with a 36’x36’x4’ concrete cap supported by six plumb piles and eighteen spur piles.  For more information, please visit: http://www.dnrec.delaware.gov/Info/Pages/SecOrders.aspx.

January 28 Public Hearing on Proposal to Amend Regulation 1141 – “Limiting Emissions of Volatile Organic Compounds (VOCs) from Commercial and Consumer Products Categories will be held at 6:00 PM at the DNREC Air Quality Management Section Office at the Priscilla Building located at 156 S. State Street in Dover. The proposed revision to Section 2.0 - Consumer Products, will regulate 23 more products/product types, which is projected to reduce VOC emissions in Delaware by up to 220 tons per year. Adding a new section, Section, 4.0 - Adhesives and Sealants, will regulate certain industrial or commercial adhesives and sealant compounds, such as those used in building houses, laying carpets, installing roofing material, etc., and is projected to reduce VOC emissions in Delaware by an additional 365 tons per year. Any person may make comments for consideration in adoption of these proposed amendments; interested parties may present statements and/or testimony at the hearing, which will be entered into the public record. Documents Available for Public Comment or Appeal

The Division’s Brownfields Development Program encourages the cleanup and redevelopment of vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a Brownfields Development Agreement (BDA) or a Brownfields Voluntary Cleanup Program (VCP) Agreement to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. A BDA is only available to parties that are not current site owners. The Brownfields VCP Agreement is available to Brownfields site owners, who, although not contributors to the contamination, may already be liable as a potentially responsible party for the site. The VCP Agreement provides a mechanism to remediate contamination while developing the Brownfields site, and receive liability protection for past releases of hazardous substances at the site. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS VOLUNTARY CLEANUP PROGRAM AGREEMENT FOR THE 900 SOUTH FRANKLIN STREET PROPERTY IN WILMINGTON  SIRB negotiated a Brownfields VCP Agreement with Anthony Casale of Casale and Associates, Inc. regarding the 900 South Franklin Street site in Wilmington. Although there have not been any investigations at the 0.58-acre site, a Sanborn insurance map identified the site as a ruin in 1901. Therefore, the site may contain historic fill, which typically contains elevated levels of metals and/or polynuclear aromatic hydrocarbons. The public comment period for this Brownfields VCP Agreement began on December 29, 2008 and will close at the end of the business day (4:30 p.m.) on January 20, 2009.  Please submit comments in writing to Todd Keyser at the office of SIRB, 391 Lukens Drive, New Castle, DE 19720. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE 222 MARYLAND AVENUE PROPERTY IN WILMINGTON  SIRB negotiated a BDA with Reybold Venture Group XXXI, LLC regarding the 222 Maryland Avenue site in Wilmington. The site is approximately 0.05-acres in size. Due to the close proximity of several contaminated sites, such as 200/206 Maryland Avenue and the Wilmington Spill Sites, the site may also have had a release of hazardous substances.  DNREC invites written public comments on this BDA. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE 2440 RED LION ROAD PROPERTY IN KIRKWOOD  SIRB negotiated a BDA with Richards Paving, Inc. for the 2440 Red Lion Road Property (formerly known as H&R Auto Facility), located at 2440 Red Lion Road in Kirkwood. The site may have had a release of hazardous substances as a result of past use as a gas station.  An Environmental Site Assessment indicated elevated levels of total petroleum hydrocarbons. After DNREC enters into a BDA with a Brownfields Developer, it will require a remedy at the site in connection with the development project.  DNREC invites written public comments on this BDA.  The public comment period began on December 22, 2008 and will close at the end of the business day (4:30 p.m.) on January 12, 2009. NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT FOR THE A AND TOWNSEND STREET PROPERTY IN WILMINGTON  SIRB negotiated a BDA with Habitat for Humanity of New Castle County for the A and Townsend Street Property, located between 1017, 1019 and 1021 A Street (a/k/a 339 Townsend Street) and 333, 335 and 337 Townsend Street in Wilmington. The site may have had a release of hazardous substances as a result of its past use as an auto body repair shop and proximity to the Diamond Oil Site. DNREC invites written public comments on this BDA.  The public comment period began on December 22, 2008 and will close at the end of the business day (4:30 p.m.) on January 12, 2009. FINAL PLAN OF REMEDIAL ACTION FOR THE FORMER CAPITOL SCRAPYARD SITE IN DOVER  SIRB adopted the Proposed Plan of Remedial Action (Proposed Plan) as the Final Plan of Remedial Action (Final Plan) for the Former Capitol Scrapyard Site. The 1.37-acre site is located on West Street between Division Street and Reed Street in Dover. Environmental contamination occurred at the site as a result of its past use as a scrap metal salvage yard. Contamination consisted of soils containing polychlorinated biphenyls (PCB) and metals. The site has undergone two (2) investigations and several interim actions (IA); including asbestos abatement of buildings slated for demolition, clearance of tires and vegetative debris on the surface, removal and disposal of scrap metal, demolition debris and drums, and removal and off-site disposal of soils containing PCBs and metals. During soil excavation and disposal, petroleum contamination was found in deeper soils. Additional petroleum-contaminated soils were excavated and disposed of at an approved facility and soils were amended with Oxygen Release Compound Advanced to stimulate natural degradation of remaining petroleum compounds. It is proposed that the site be subdivided into two (2) parcels for sale or lease by the owner, Downtown Dover Development Corporation.

DNREC invited written comments on the Proposed Plan. The public comment period began on October 19, 2008 and closed on November 8, 2008. DNREC did not receive any comments to the Proposed Plan. PROPOSED PLAN OF REMEDIAL ACTION FOR THE P&C ROOFING SITE IN WILMINGTON  SIRB announced the Proposed Plan of Remedial Action (Proposed Plan) for the P&C Roofing Site, which includes the former Riverwalk Phase V and VI Site. The 2.5-acre site is located at 720 South Justison Street (formerly Madison) in Wilmington, south of the Iron Hill Brewery and east of the Blue Rocks Stadium along the Christina River. The site is currently vacant, but was most recently occupied by P&C Roofing, Inc., a roofing contractor.  Environmental contamination occurred at the site as a result of its past use, including as a ship building yard and a rail car repair facility with historic filling activities. The site soils contain elevated levels of arsenic, lead and polycyclic aromatic hydrocarbons (PAHs) including benzo(a)anthracene, benzo(a)pyrene, benzo(b)fluoranthene, dibenz(a,h)anthracene, indeno(1,2,3-cd)pyrene. Elevated levels of iron and manganese were detected in the groundwater. Elevated arsenic in groundwater was detected in the upgradient well. The site owner plans to build a restaurant and associated asphalt parking lot with some landscaping.

DNREC is soliciting written comments on the Proposed Plan for 20 days, from December 22, 2008 until January 12, 2009. PROPOSED PLAN OF REMEDIAL ACTION FOR THE RAILROAD CROSSING SITE IN WILMINGTON  SIRB announced the Proposed Plan of Remedial Action for the Railroad Crossing site located at the intersection of 5th and Coleman Streets in Wilmington. Based upon available historical documents, the site was operated as the Wilmington Coal and Coke Company, the Keystone Coal Company and most recently (through early 2006) as the Delaware Insulation Company, a warehouse and distribution center for insulation and pipe covering. These historical operations resulted in the generation of hazardous and non-hazardous materials at the site. The several remaining single-story buildings on site were demolished in April-May 2007.  Hazardous and non-hazardous waste materials were removed from the buildings during January through February 2007 prior to demolition. Wastes removed from the building included waste oil, light ballasts, batteries, mercury switches, and numerous containers of spent/used product. In addition, several small fuel oil tanks were cleaned then cut up and removed for scrap during this time period.

PROPOSED PLAN OF REMEDIAL ACTION FOR THE LIPPINCOTT PROPERTY SITE IN WILMINGTON  SIRB announced the Proposed Plan of Remedial Action for the Lippencott Property including 300 to 318 N. Market Street; 7 and 9 E. Third Street; and 4 E. Fourth Street. The property has been historically used as the Third Street Market, Swan Hotel, Hardin Tools, barber shop, gun store, gas company office, oil cloth and carpets shop, photo shop, drugstore, liquor warehouse, bakery, ice cream shop, and offices. A small area of stained soils caused by a 500-gallon above ground storage tank was noted during a Phase I Environmental Site Assessment. Asbestos and lead risks were identified within the buildings prior to renovation. These environmental problems have been addressed during the restoration of the historical buildings. Therefore, no further cleanup action is required under HSCA.

PROPOSED PLAN OF REMEDIAL ACTION FOR THE PAVILION SITE IN WILMINGTON  SIRB announced the Proposed Plan of Remedial Action for the Pavilion Site. The site is located at the northwest corner of 5th and DuPont Streets in Wilmington and is comprised of four (4) parcels. The site has been used as a parking lot since the late 1980s/early 1990s by Saint Francis Hospital. The site was certified as a Brownfield based on limited previous investigations that indicated elevated concentrations of arsenic in the soil. A Brownfield Investigation conducted in March 2007 identified elevated concentrations of PAHs and pesticides in localized areas of the site. Interim Action activities were conducted between February 2008 and October 2008 to excavate and remove impacted soils from the site. Additional remedial activities are not necessary at the site.

PROPOSED PLAN OF REMEDIAL ACTION FOR THE BRANDYWINE FIBRE SITE IN WILMINGTON
SIRB announced the Proposed Plan of Remedial Action for the Brandywine Fibre Site.  The one-acre site is located in Wilmington and occupies the city block between 14th and 15th Streets at Clifford Brown Walk. The property, currently vacant, is the former site of various industrial facilities including a tannery.  The subsurface soil is contaminated with petroleum-related substances and tannery wastes. Under the proposed plan, all soils exhibiting hazardous characteristics will be excavated and removed for off-site disposal.  Additional contaminated soil will also be excavated to reach risk-based cleanup standards, or to a maximum depth of ten feet below ground surface.  The goal of the remediation is to make the site suitable for low-rise residential or light commercial development.

REVISED PROPOSED PLAN OF REMEDIAL ACTION FOR THE CHRISTINA LAB SITE IN WILMINGTON
SIRB announced the Revised Proposed Plan of Remedial Action for the Christina Lab Site.  The 20-acre site is located between Christina Avenue and the Christina River at the I-495 bridge in Wilmington. The property, currently vacant, is the former site of various industries including a linoleum production plant and a DuPont Company pilot production facility.  Subsurface soil consists of fill material from ore-processing at the Lobdell Car Company, which was formerly located on a parcel adjacent to the site. The Revised Proposed Plan includes covering most of the site (approximately 85%) with compacted, crushed stone or asphalt to prevent contact with surface soil and covering the rest of the site with berms or constructed drainage features as required by DNREC’s Storm Water and Sediment Program. In addition, an environmental covenant will be required to restrict digging into site soils beneath the soil cap without prior written approval of DNREC, as well as an Operation and Maintenance (O&M) Plan to minimize the potential for cap disturbance and to promote the long-term integrity of the cap.

TITLE V SYNTHETIC MINOR PERMIT APPLICATION AND REGULATION 1102 NATURAL MINOR PERMIT APPLICATION FOR DELAWARE PARK  Notice has been given that the facility listed below has applied for Title V Synthetic Minor permit and Reg. 1102 Natural Minor permit. The applications may be reviewed at the office of the Division of Air and Waste Management, 156 S. State Street, Dover, Delaware, or 715 Grantham Lane, New Castle, Delaware. A public hearing concerning the following permitting action will not be held unless the Secretary of DNREC receives a request for such hearing by January 7, 2009:

  • Delaware Park has submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for a construction permit for one distributed generator with a selective catalytic reduction system at 777 Delaware Park Drive in Wilmington. Delaware Park requests a limit of 3,000 hours of operation of the generator engine during any 12-month rolling period. This limit is necessary to restrict Delaware Park potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state.   • Delaware Park has also submitted an application, pursuant to Regulation No. 1102, Section 2.1, 11.2(i), and 12.3 for a construction permit for two emergency generators. The engines used in these generator sets comply with USEPA regulations under the provisions of 40 CFR 89, Non-Road Tier-2 emission limits. Delaware Park requests a limit for hours of operation of the emergency generators. These limits are necessary to restrict Delaware Park potential to emit air pollutants, and the limit will be enforceable by the USEPA and the state. Total estimated emissions from the two emergency generators will not exceed are 6.0 tons per year of nitrogen oxides, 1.2 tons per year of non-methane hydrocarbons, 0.04 tons per year of particulate matter, and 0.4 tons per year of carbon monoxide.   • Haines & Kibblehouse, Inc. requests to operate their existing diesel powered portable concrete crusher (crusher, screener, and conveyors) at River II, LLC located at 36393 Sussex Highway in Delmar. The Company has taken an operating hour limitation of 500 hours to reduce nitrogen oxide (NOx) emissions below the five tons per year (TPY) threshold of Regulation 1125, Minor New Source Review.  The permitted emissions are 1.8 TPY NOx, 0.27 TPY sulfur oxide (SOx), 0.33 TPY carbon monoxide (CO) , 0.080 TPY volatile organic compounds (VOCs), and 0.53 TPY particulate matter less than 10 microns in size (PM10).
  • Level3 Communications requests permission for the operation of two emergency generators, rated 688 hp and 755 hp designated as Unit 1 and Unit 2 respectively at their Interchange Blvd., Newark facility.  The maximum emissions (tpy) from these units shall not exceed the following:  Unit 1:  NOx=4.13, SO2= 0.07, CO= 0.95, VOCs= 0.12 and PM10= 0.12; Unit 2:  NOx=4.53, SO2 =0.08, CO= 1.04, VOC= 0.13 and PM10=0.13.

  • Contract Crushing/Construction, Inc. requests an amendment to their 150 tons per hour portable crusher and powered screening deck permit to add a new operating location at the Harmony Construction Company site located at 350 Salem Church Road in Newark, per Regulation No. 1102, Section 12.2. No increase in emissions or permitted emission limits will result.
  • Donovan Salvage Works, Inc. requests a permit to construct a secondary aluminum sweat furnace at their facility located at 20262 Donovans Road in Georgetown. The secondary aluminum sweat furnace has the potential to emit (PTE) 2.15 TPY of NOx, 1.80 TPY of CO, 0.14 TPY of SOx, 0.12 TPY of VOCs, and 7.18 TPY of PM. By permit, actual emissions will not exceed 0.76 TPY of NOx, 0.64 TPY of CO, 0.05 TPY of SOx, 0.04 TPY of VOCs, and 2.56 TPY of PM.

  • MacDermid Autotype, Inc. for a Minor Permit Modification for their facility in Middletown in accordance with the procedures of Regulation No. 30 of the State of Delaware “Regulations Governing the Control of Air Pollution.” The Minor Permit Modification consists of adding five chemicals to a list of 63 materials used to prepare coating solutions, and conversion of a blend tank for use as a reactor for preparing coating materials. The “draft/proposed” minor permit modification is being submitted to USEPA for concurrent processing. If there are no significant comments, the “draft/proposed” permit renewal will be issued as a final permit after expiration of the USEPA review period.   • Magellan Terminals Holdings, L.P., having a facility at 1050 Christina Avenue, Port of Wilmington, Delaware, has requested to amend two federally enforceable Regulation No. 1102 construction permits, Permit: APC-2007/0055-CONSTRUCTION (Amendment 1) for a VOL gasoline truck loading rack with an associated vapor recovery unit and vapor combustion unit as back-up and Permit: APC-2007/0056-CONSTRUCTION (Amendment 1) for a VOL marine loading terminal with an associated vapor combustion unit.  The permit amendments will increase the operating temperature of the vapor combustion control device from 14000F to 16000F increasing the VOC destruction efficiency to 99.5% and increase the product throughput for the marine loading terminal from 3 MMbbl to 6 MMbbl. The higher pollution control efficiency will reduce VOC emissions from the marine loading terminal from 2.9 TPY to 2.68 TPY.   Upon completion of construction, the Department will incorporate the operating conditions and limits of the Regulation No. 1102 Construction permit into the facility’s existing Title V permit AQM-003/00291 via an Administrative Amendment.
