NEWS UPDATES:

Delaware City RefineryDNREC issued a second stipulated penalty to the Premcor Refining Group on April 3, for failing to complete construction of the new pneumatic coke storage and handling system. Timely construction is now more than three months overdue.  Premcor has 60 days from receipt of the demand to submit payment. April 21DNREC Public Hearing on Proposed Revisions to Delaware Administrative Code 1351, Delaware Regulations Governing Underground Storage Tank Systems, will be held at 7:00 p.m. in the conference room at the DNREC field office located at 391 Lukens Drive in New Castle. May 6 – Public Hearing for Grantham Lane Associates, LLC Application for a Coastal Zone Permit and will be held at the DNREC field office located at 391 Lukens Drive beginning at 6:00 PM. The hearing, originally set for Tuesday, April 14, was rescheduled to May 6, because the company submitted an amended application to DNREC that was different from the application on public display. May Meetings of the Local Emergency Planning Committees (LEPCs) – The LEPCs were appointed by the Delaware State Emergency Response Commission. The LEPC provides a forum for interaction and information sharing among businesses, government officials, emergency    organizations, and the public. The meetings will be held at the following times and locations:

VIOLATIONS AND PENALTIES:

DNREC Issued $15,000 Notice of Penalty to Baltimore Aircoil Company of Milford for Propane Tank-Related Violations – DNREC issued a Notice of Administrative Penalty Assessment and Secretary’s Order to Baltimore Aircoil Company (BAC) for violations of the Delaware Code and Delaware environmental regulations in an incident involving a propane release. Environmental Violations at INVISTA’s Seaford Plant Resolved Through Consent Decree Filed in District Court DNREC joined the U.S. Department of Justice on behalf of the U.S. Environmental Protection Agency, the South Carolina Department of Health and Environmental Control and the Chattanooga-Hamilton County Air Pollution Control Board in a settlement with INVISTA S.à r.l which resolves environmental violations found through audit at various INVISTA facilities, including the INVISTA-Seaford Plant. For more information, please visit: http://www.dnrec.delaware.gov/News/Pages/EnvironmentalViolationsatINVISTA’sSeafordPlant.aspx.

BROWNFIELDS DEVELOPMENT PROGRAM The Division’s Brownfields Development Program encourages the cleanup and redevelopment of vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a Brownfields Development Agreement (BDA) or a Brownfields Voluntary Cleanup Program (VCP) Agreement to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. AMENDED FINAL PLAN OF REMEDIAL ACTION FOR SUNDAY BREAKFAST MISSION SITE (DE-1083) OPERABLE UNIT 1  The Department has adopted the amended final plan to clean up the Sunday Breakfast Mission Site – Operable Unit 1 at 100 to 110 North Poplar Street in Wilmington. The other portion of the site is located at 1216 D Street and 700 South Heald Street in Wilmington. The public comment period began on April 8, 2009 and will close at the end of the business day (4:30 p.m.) on April 28, 2009. AIR QUALITY MANAGEMENT PERMITTING PROGRAM Notice has been given that the facilities listed below have submitted applications for air quality management permits. The applications, the “draft/proposed” permits, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the “draft/proposed” permit may be inspected at the offices of the Division of Air and Waste Management, 156 S. FEDERALLY ENFORCEABLE 7 DE ADMIN. CODE 1102 APPLICATIONSDover Air Force Base has requested a federally enforceable 7 DE Admin.
