NEWS UPDATES:
ANNUAL STATE TRI DATA AND REPORTS SHOW DECREASES IN EMISSIONS; COMPANIES' ANTI-POLLUTION EFFORTS, ECONOMIC CONDITIONS ARE FACTORS - The annual Toxics Release Inventory (TRI) data and reports for 2009 from Delaware’s industrial facilities as compiled by DNREC show a significant decrease in reported emissions over 2008 and continued trend in reduction since 1998 – a baseline year when TRI reporting requirements expanded significantly and more facilities began reporting to the program. In this the 23d year of TRI data collection from facilities for distribution to the public, the 2009 data also reflects an impact that economic conditions have played in the decrease in emissions from lower power production as well as the closing of three reporting facilities. Statewide, TRI total on-site releases reported in Delaware for 2009 were lower by 44 percent compared to 2008. For 2009, reported on-site releases totaled 5.31 million pounds, down from the 9.52 million pounds reported for 2008, and down 55 percent from the 11.86 million pounds reported for 1998. Economic factors may have contributed to over half of the reduction in on-site releases for 2009. DNREC, OTHER STATE AND FEDERAL AGENCIES TO RECEIVE $27.5 MILLION TO RESTORE DELAWARE RIVER FROM 2004 ATHOS I OIL SPILL IMPACTS - State and federal natural resource agencies including Delaware’s Department of Natural Resources and Environmental Control (DNREC) have reached a settlement of $27.5 million for ecological restoration of the Delaware River following an oil spill six years ago from the tanker Athos I. DNREC, along with the National Oceanic and Atmospheric Administration (NOAA), the U.S. Fish and Wildlife Service, and the states of Pennsylvania and New Jersey will collectively receive the funds from the U.S. Coast Guard’s Oil Spill Liability Trust Fund (OSLTF) to implement 10 restoration projects, including three in Delaware. On November 26, 2004, the single-hulled tanker struck three submerged objects, including a large anchor, while preparing to dock in Paulsboro, N.J. The anchor punctured the hull, spilling nearly 265,000 gallons of crude oil into the Delaware River. The spill’s impact extended to more than 280 miles of the shoreline, affecting habitats, aquatic organisms, birds and other wildlife, as well as impairing recreational use of the river and its shores. Under the Natural Resource Damage Assessment and Restoration (NRDAR) provisions of the federal Oil Pollution Act (OPA), state and federal natural resource agencies serve as natural resource trustees to evaluate the loss of resources due to a spill and to restore the habitat and resources to pre-spill conditions. WATER PERMITTING PROGRAM - The Division of Water monitors, manages and protects Delaware’s ground and surface waters, tidal wetlands and underwater lands. The Division is a link to the Delaware Estuary Program, Inland Bays Estuary Program and the Delaware River Basin Commission, and provides centralized computer and geographic information system services. The Division also provides public education and outreach programs.
SUBAQUEOUS LANDS PERMIT APPLICATIONS:
Divison of Fish and Wildlife-To rebuild 65 linear feet of bulkhead and construct a 5 foot by 35 foot dock in the Murderkill River at the US Coast Guard Auxiliary Station at the end of Murderkill Ave. Bowers Beach.
Delaware Pipeline Company–To place erosion control matting and stone riprap to stabilize 450 linear feet of the Delaware River bank at Fox Point State Park, and to stabilize a pipeline by placing 110 cubic yards of stone riprap in Holly Oak Creek, near Bellefonte.
WETLANDS PERMIT
Prime Hook National Wildlife Refuge-To restore up to 4,000 linear feet of sand dunes on lands owned by the Refuge and by Frank and Marilyn Draper, using sand deposited in overwash areas within the marsh west of the dune line, along the Delaware Bay south of Fowler Beach Road, at Prime Hook National Wildlife Refuge, 11978 Turkle Pond Road, Milton.
AMENDMENT TO A STATEWIDE ACTIVITY APPROVAL
To amend the Statewide Activity Approval (SAA) for Sediment Removal from Streams in New Castle County, which authorizes New Castle County and the New Castle Conservation District to remove minor accumulated sediment blockages from streams, associated with debris jams, bridge crossings, culverted road crossings, outfall structures and dams, by allowing the City of Newark or their contractors to also perform this work, and to extend the expiration date of this SAA to January 29, 2017

WELL PERMITS:
Raymond Lynch needs to construct two irrigation wells. The wells are proposed to be 90 feet deep and 8 inches in diameter. This well is are located approximately 400’ north of Cr 466 and 2600’ south of Cr 466. The wells are about 4 miles north east of Laurel. The desired capacity of these wells is1000 gpm.
Liberty Holding Corp needs to construct a dewatering system for 75 well points that are 20 feet deep 1.5 inch in diameter and are 3 feet apart. The system is to install new fuel tanks. The discharge water will be sent to an existing ditch. The site is located about 5 miles south of Townsend. The desired capacity of this well point system is 375 gpm.

Richard Carmine needs to construct an irrigation well. The well is proposed to be 90 feet deep and 8 inches in diameter. This well is located approximately 640’ east of Cr 461 and 2110 north of Gordy road. The wells are about a mile south east of Laurel. The desired capacity of this well is 500 gpm.
Barcroft Co. needs to construct a dewatering system for 90 well points that are 16 feet deep 1.5 inch in diameter and are 3 feet apart. The system is to install water lines. The discharge water will be sent to an existing storm drain. The site is located in the town limits of Lewes. The desired capacity of this well point system is 250 gpm.
A public hearing on the above applications will NOT be held unless the Secretary of DNREC determines that a hearing is in the public interest or if a written meritorious objection to the application is received by December 6, 2010.
