Artesian Northern Sussex Regional Water Recharge Facility (ANSRWRF)
The Artesian Northern Sussex Regional Water Recharge Facility (ANSRWRF) was permitted for construction on October 15, 2013.
On May 5, 2017, Artesian Wastewater Management, Inc. submitted an application for a permit amendment. The amendment seeks to make the following changes to the current permit: 1) constructing two storage lagoons to replace the currently permitted three lagoons, 2) delaying construction of the wastewater treatment plant and the use of three spray irrigation fields until a later date under the proposed phased construction, and 3) receiving treated effluent from the Allen-Harim Harbeson facility that will be treated to the same standards as required by the current permit.
The application was advertised in accordance with 7 Del.C. §6004: 2017 Public Notice of Application
During the advertisement period, the Department received a meritorious request for a public hearing. In accordance with 7 Del.C. §6004, the Department held a hearing on July 27, 2017.
The public hearing record was held open until Aug. 11, 2017 for public comment. Comments received are currently being summarized by the Hearing Officer. The Hearing Officer will prepare a report for the Secretary setting forth the procedural history, summarizing the record, and recommending findings of fact, conclusions, and reasons on the recommended action on the Application. Once completed, the Secretary will review the report and in a Secretary’s Order may issue a permit, issue a permit with conditions, or deny the permit application.
Through the hearing process, the Groundwater Discharges Section (GWDS) performed a comprehensive technical review of the permit application and has been working with Artesian engineers to ensure the application meets the requirements set forth in the Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems (Regulations). The GWDS sent Artesian a Review Letter on July 14, 2017 that included multiple internal memorandums in review of the application. The letter requested Artesian address all Department comments and concerns. The GWDS also forwarded a DNREC Hydro Review Memo once it was finalized.
In response, Artesian provided the GWDS with an Addendum to the Amended Design Development Report for Phase I of the proposed ANSRWRF on August 18, 2017. The Addendum is currently under review.
This project is being reviewed under the amended 2014 Regulations Governing the Design, Installation and Operation of On-Site Wastewater Treatment and Disposal Systems, which are more stringent than Regulations Governing the Land Treatment of Wastes which were in effect when the 2013 permit was issued.
